The existing structure was built 2'-6" from the side property line, Code Sec. 25.66.060 requires a minimum of 3'. The proposed addition will have a side yard setback of 6'-6" to the wall of the addition. Al1 other zoning requirements for lot coverage, height and parking are met by the proposal. Staff have reviewed the request. The City Engineer (June 3, 1983 memo), the Chief Building Inspector (June 6, 1983 memo) and the Fire Marshal (June 6, 1983 memo) had no comments. In her May 23, 1983 letter`the app'licant states her reasons for the request. The porch which extends wihi;n 2'-6" of`the, property line; has been remodeled but was a part of the original':construction,o.f thehouse when they purchased it'. Removal of the porch would leave the fiouse without a rear.exit She intends to continue to use this home as a single family residence. - To grant a variance Coe;Se:c: 25.4:020 r.equires theCommission to. make the following findings of fact based`:on p'hysY,cal .haracte.ristics of the property:- a. that there are excep'tional' _or extraorctinary circums_tances' applicable to the property or ,c'lass of u:ses, in the distrlct,' so ,that a denial of the appl i cati on woul d'r'esul tYn;; undue _proqerty 1 oss; ; b. that such variance would be necessary for the preservation and enjoyment of a property;ri.ght of.the owner of the property involved; : ; to the publ ic heaFlth, safety o_r` welfare, not be mate'ria-1,ly' detrimental c. that the granting of.such: variance'would' or.injurious to the_ property or improvements of oth'er propert owners, or the quiet enjoyment of such property or improvements;'and' - _ _ d. that the granting of such"variance wiTlnot adversely affect {ie comprehensive zoning. pl_an of the c_tity. To review the application, removal of'the existi'ng enclosed porch would result in a relocation of the back daor`or'secona exYtfrom the`building; it is typical for a home in Burlingame to have three bedrooms or equivalent and this addition would not make this structure larger than typical; the proposal would maintain the current level of safety on this property without significantly affecting neighbors or extending the nonconformity; and this addition does not add a second unit to this single family home or exceed any other development requirements beside adding to a structure with an existing nonconforming side yard. , -2- The Planning Commission should hold a public hearing at which the following condition should be considered: 1. that the project be developed according to the plans date stamped May 31, 1983. -/1 r I Margaret Monroe City Planner MM/s 6/21/83 cc: Martha Costa Steven Graf, 1138 Nimitz Way, Foster City PROJECT APPLICATION b CEQA ASSESSMENT Application received ( 5/31/83 Staff review/acceptance ( CITY . ° 1112 CABRILLO AVENUE BURLINGAME projec '..,.o„.•' Projec aaaress name - ir any i.
