Britton 1036 Cabrillo Avenue Burlingame, CA 94010 Dear Mr. Britton, Since there was no appeal to or suspension by the City Council, the May 24, 2004 Planning Commission approval of your application for floor area ratio variance became effective June 3, 2004. This application was to allow for construction of a new detached two-car garage at 1036 Cabrillo Avenue, zoned R-1. The May 24, 2004 minutes of the Planning Commission state your application was approved with the following conditions: 1. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped Apri129, 2004, sheets A.1, E.1 and Boundary and Topographic Survey, and date stamped May 17, 2004, sheet A.2, with the garage door pattern as shown on the North Elevation, and that any changes to the footprint or floor area of the building shall require an amendment to this permit; 2. that if the detached garage or single family dwelling on this site is ever expanded, the floor area ratio variance shall become void and a new application shall be submitted for Planning Commission review; if the detached garage and/or single family dwelling is ever demolished or destroyed by catastrophe or natural disaster, the property owner shall be allowed to rebuild the existing detached garage andlor single family dwelling at the same location, with the same footprint, floor area, setbacks, height, finished floor and plate heights, and exterior materials as the existing house and garage; 3. that the conditions of the City Engineer's and the Recycling Specialist's April 12, 2004, memos shall be met; 4. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration projects to submit a Waste Reduction Plan and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall require a demolition permit; and 5. that the proj ect shall meet all the requirements of the California Building and Uniform Fire Codes, 2001 Edition, as amended by the City of Burlingame. �- . June 4, 2004 1036 Cabrillo Avenue page 2 All site improvements and construction work will require separate application to the Building Deparhnent. This approval is valid for one year during which time a building permit must be issued. One extension of up to one year may be considered by the Planning Commission if application is made before the end of the first year. The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section 1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or federal law.
