Environmental Review Status: The project is Categorically Exempt from review pursuant to the California
Environmental Quality Act (CEQA), per Section 15303 (a) of the CEQA Guidelines, which states that
construction of a limited number of new, small facilities or structures, including one single-family residence, or a
second dwelling unit in a residential zone, is exempt from environmental review. In urbanized areas, this
exemption may be applied to the construction or conversion of up to three (3) single-family residences as part of
a project.
Project Description: The subject site is an irregularly-shaped lot with 70 feet of frontage on Cabrillo Avenue.
The width of the lot increases to 100 feet at the rear of the parcel. Sanchez Creek runs along the right side of
the property.
The applicant is proposing to demolish the existing single-family dwelling and accessory structures on site. A
new, two-story single-family dwelling with a detached garage is proposed on the site. The proposed floor area of
the dwelling and the detached garage is 5,086 SF (0.45 FAR) where a maximum of 5,096 (0.45) FAR is allowed.
The proposed project is within 1% if of the maximum allowable floor area.
The applicant submitted an arborist report date stamped September 9, 2014, from Kielty Arborist Services.
There are five protected-size trees on the site (numbered 3, 4, 6, 7, and 8 on Sheet A.2). The applicant is
proposing to remove the two Oak trees that are on site (numbers 4 and 7). The Parks Division received a
Protected Size Tree Removal Permit for these trees (see attached permit application, date stamped October 7,
2014). In the October 10, 2014 Project Comments, the Parks Division notes that the Tree Removal Permit will
be approved and the trees can be removed only after the plans for the project are approved by the Planning
Commission and the ten day appeal period has ended.
Three existing protected-size trees will remain on site, two Redwood trees and a Black Acacia tree, and the
arborist report details protection measures for these trees during demolition and construction.
The applicant is proposing a two-story house with 6 bedrooms. Two covered parking spaces and one uncovered
parking space are required for a 6-bedroom house. A detached garage is proposed at the rear, left side of the
property and provides two covered parking spaces (20' x 20'). There is a single uncovered parking space in the
driveway leading to the garage (9' x 20').
A conditional use permit is requested for a toilet in an accessory structure. There is a 76 SF space (12'-0" x 6'-
4") proposed at the right side of the detached garage, adjacent to the backyard. This space will contain a 36 SF
half bathroom with a toilet and a sink and a 40 SF storage space. The applicant is not proposing a shower in the
detached accessory structure; any changes to the structure in the future to accommodate a shower or uses
other than parking and a half bathroom would require permits and be subject to all current Planning and Building
Code requirements, and any unauthorized changes would be subject to code enforcement action.
All other Zoning Code requirements have been met. The applicant is requesting the following applications:
■ Design Review for construction of a new, single-family residence (C.S.25.57.010(a)(1)); and
■ Conditional Use Permit for an accessory structure that will contain a toilet (C.S.25.60.010Q)).

Parks Division, and Stormwater Division.
Design Review Study Meeting: At the Planning Commission Design Review Study meeting on October 27,
2014 the Commission had comments and suggestions regarding the design of the house and the proposed half
bathroom in the garage (refer to the October 27, 2014 Planning Commission Minutes for a complete list of
comments) and voted to place this item on the regular action calendar when all information has been submitted
and reviewed by the Planning Division.
The applicant submitted a response letter dated November 10, 2014, and revised plans date stamped November
4, 2014, to address the concerns of the Planning Commission and the neighbors to the right and left of the
subject property. The applicant also submitted two emails sent to the neighbor at 1015 Cabrillo Avenue, to the
left of the subject property (see attachments).
Staff would note that while the design details and the landscaping for the proposed project have been revised by

the applicant, these revisions did not result in any substantial changes to the setbacks and other measurable
standards shown in the table above; therefore, the table does not include the customary "Previously Proposed"
column of data from the plans reviewed at the Design Review Study hearing.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on April 20, 1998 are outlined as follows:
Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;
4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit, the Planning Commission
must find that the following conditions exist on the property (Code Section 25.52.020, a-c):
(a) The proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or
convenience;
(b) The proposed use will be located and conducted in a manner in accord with the Burlingame general plan
and the purposes of this title;
(c) The planning commission may impose such reasonable conditions or restrictions as it deems necessary
to secure the purposes of this title and to assure operation of the use in a manner compatible with the
aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general
vicinity.
Planning Commission Action:
The Planning Commission should conduct a public hearing on the application, and consider public testimony and
the analysis contained within the staff report. Action should include specific findings supporting the Planning
Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any
action should be stated clearly for the record. At the public hearing the following conditions should be
considered:
that the project shall be built as shown on the plans submitted to the Planning Division date stamped
November 6, 2014, sheets A.1 — A.7, N.2, L1.0 and L2.0 and Boundary Survey and Topographic Map;
2. that any changes to building materials, exterior finishes, windows, architectural features, roof height or
pitch, and amount or type of hardscape materials shall be subject to Planning Division or Planning
Commission review (FYI or amendment to be determined by Planning staffl;
3. that any changes to the size or envelope of the first or second floors, or garage, which would include
adding or enlarging a dormer(s), shall require an amendment to this permit;
4. that if the detached garage with a half bathroom accessory structure is demolished or the envelope or the
approved uses are changed at a later date, the Conditional Use Permit granted must be amended as
required by the current Municipal Code requirements;

5. that the conditions of the Engineering Divisions September 9, 2014 memo, the Building Division's August
29 and October 7, 2014 memos, the Fire Division's August 28, 2014 memo, the Parks Division's
September 2 and October 10, 2014 memos, and the Stormwater Divisions September 4 and October 9,
2014 memos shall be met;
6. that any recycling containers, debris boxes or dumpsters for the construction project shall be placed upon
the private property, if feasible, as determined by the Community Development Director;
7. that demolition for removal of the existing structures and any grading or earth moving on the site shall not
occur until a building permit has been issued and such site work shall be required to comply with all the
regulations of the Bay Area Air Quality Management District;
8. that prior to issuance of a building permit for construction of the project, the project construction plans shall
be modified to include a cover sheet listing all conditions of approval adopted by the Planning Commission,
or City Council on appeal; which shall remain a part of all sets of approved plans throughout the
construction process. Compliance with all conditions of approval is required; the conditions of approval
shall not be modified or changed without the approval of the Planning Commission, or City Council on
appeal;
9. that demolition for removal of the existing structures and any grading or earth moving on the site shall not
occur until a building permit has been issued and tree protection measures are installed on site for any
protected-size tree shown in the plans to remain on site, and these measures are inspected and approved
by the Parks Supervisor; any protected-size tree that is proposed to be removed, or that is damaged and
must be removed as a result of demolition or construction, will require a Protected Tree Permit and may
require further Planning Division or Planning Commission review;
10. that in the event any protected-size tree shown to remain on site in the approved plans will have roots cut
during the demolition, excavation, or construction process, a Certified Arborist is required to be on site to
monitor and approve any roots over 4 inches that are proposed to be cut;
11. that prior to issuance of a building permit for demolition or construction of the project, the project
construction plans shall be modified to include a cover sheet and a landscape plan that list the Kielty
Arborist report, date stamped September 9, 2014, and recommendations;
12. that the Protected-size trees shown to be removed on the approved plans can be removed only after the
plans for the project are approved by the Planning Commission, the ten day appeal period has ended, and
the Protected Tree Removal Permit has been issued;
13. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single termination and
installed on the portions of the roof not visible from the street; and that these venting details shall be
included and approved in the construction plans before a Building permit is issued;
14. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan
and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall
require a demolition permit;
15. that during demolition of the existing residence, site preparation and construction ofthe new residence, the
applicant shall use all applicable "best management practices" as identified in Burlingame's Storm Water
Ordinance, to prevent erosion and off-site sedimentation of storm water runoff;
16. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2013
Edition, as amended by the City of Burlingame;

THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION PROCESS PRIOR
TO THE INSPECTIONS NOTED IN EACH CONDITION:
17. that prior to scheduling the framing inspection the applicant shall provide a certification by the project
architect or residential designer, or another architect or residential design professional, that demonstrates
that the project falls at or below the maximum approved floor area ratio for the property;
18. that prior to scheduling the foundation inspection, a licensed surveyor shall locate the property corners, set
the building footprint and certify the first floor elevation of the new structure(s) based on the elevation at the
top of the form boards per the approved plans; this survey shall be accepted by the City Engineer;
19. that prior to scheduling the framing inspection the project architect or residential designer, or another
architect or residential design professional, shall provide an architectural certification that the architectural
details shown in the approved design which should be evident at framing, such as window locations and
bays, are built as shown on the approved plans; architectural certification documenting framing compliance
with approved design shall be submitted to the Building Division before the final framing inspection shall be
scheduled;
20. that prior to scheduling the roof deck inspection, a licensed surveyor shall shoot the height of the roof ridge
and provide certification of that height to the Building Division; and
21. that prior to final inspection, Planning Division staff will inspect and note compliance of the architectural
details (trim materials, window type, etc.) to verify that the project has been built according to the approved
Planning and Building plans.

Dear Planning Commissioner:
Per your design review comments, we have revised the exterior to reduce the mass/bulk of the residence
by changing the roof pitch and brought the roof down from 2°d floor to 1 st floor plate at front and at rear
of the residence. We also changed some of the gable ends roof form to hip, again to further reduce the
bulk at rear and right side of the proposed.
After last Planning Commission's meeting we had an opportunity to meet with our neighbor to the left,
Mr. Dan Griffin and made the following changes to accommodate his request and revised plan was sent
on Nov. 4th:
1. Replaced the French door at Den with window.
2. Relocate the side entrance to the rear of the residence.
3. Relocate the laundry window from side to rear.
4. Added privacy screening trees along the driveway with shrub underneath, please see landscape
plan.
The revised landscape plan also included the additional privacy screening trees along the creek to
accommodate our neighbor's concern to our right.

All Commissioners had visited the property. Commissioner DeMartini reported that he had met with the
owner of 1015 Cabrillo Avenue. There were no other ex-parte communications to report.
Questions of staff.� None.
James Chu (designer) and Michael Callan (landscape architect) represented the applicant:
> Client has talked to neighbors. Majority seem to like project, except for neighbor to left.
> Mitigate privacy concerns with tree planting.
Commission questions/comments:
> Has a consistent ring of second-floor plate all around. Massing /ooks like a two-story ring around the
top, with just a few gestures and e/ements that are one-story. On sides it stretches out and looks very
long.
> Front elevation could have roof brought down, let dormer to right pop out. Would bring down overall
height and he/p with massing.
> Tudor revival sty/e with brick is handsome, nicely detailed.
> IYs a large lot, should look at if there is a way to shift the house over to allow more planting area
a/ong the driveway. Focus is towards the lush srde of the creek but fhe /eft side is barren. (Chu:
Driveway is 12 feet wide but code only requires 9'-6", so there is plenty of room to add planting.)(Callan:

sudden oak, but there are not oak trees on the property anymore. Could work with the arborist if there is
another tree that would be preferable.)

Neighbor also has a swimming pool on her lot. This house will not be seen from Carmelita since there is
a house in befween.

> Is the 400 sq ft exemption for the detached garage factored in the total floor area? (Hurin: There can
be a credit of 400 square feet for the garage.)
> Massing needs to be addressed. House could fit into the neighborhood wifh changes.

Dear City Council and Planning Commission,
My name is Daniel Griffin and I have been living in Burlingame for about 25 years now. It was
always my family's dream to live here some day and now my whole family is here. We enjoy it very
much. I would like to take this opportunity to thank the city council for their work on the leaf blower
noise ordinance. You have restored peace and quiet to our homes. I really appreciate it and so does
everyone else that I have discussed it with. Thank you very much.
I am here tonight to express my concerns about the proposed house at 1025 Cabrillo Ave,
Burlingame, CA. At approximately 5000 sq. ft. and tall height from street level, I find it large and
intrusive. To me, it resembles a four unit apartment complex. It has a long driveway with parking and a
garage in the back. I live right next door and am very concerned about the noise and loss of privacy
caused by the proposed parking, the size of the windows and doors on the south side. I am also
concerned that the excessive height of the building will block my existing view and the amount of
natural light that I currently have.
We had noise issues with the previous owners which I was hoping to avoid with the future
owners. The doors facing our house allow us to hear anyone entering or exiting the premises. Thank
you for taking the time to read about my concerns.

List of Concerns:
--proposed height of the building will block my view and natural light.
--proposed bathroom in the garage seems to leave space for further development of a potential in-law
or maid's quarters.
--very large two-story south facing window creates a lack of privacy for my home since the neighbor will
have a direct view of my home from a high vantage point.
--the proposed location and length of the garage and driveway on the south side creates noise problems
as I can easily hear the vehicles coming and going, the alarms and car doors slamming.
--the proposed south side entry door also creates a lack of privacy.
--the size of the home at 5000 sq. ft. is very large and feels more like an apartment complex.
--proposed location of the AC compressor may cause excessive noise.
--width of the driveway leaves no room for privacy hedges.

Other exterior changes were made to address Planning Commissioners' concern, mainly the mass/bulk.
I'm still waiting for revised landscape from our landscape architect, who's cc in this email, which should be
done today or tomorrow the latest.

Mr. Griffin,
I am the landscape architect for the project at 1025 Cabrillo and as James Chu, the house designer, mentioned I
have integrated his revised floor plan into my plan. I have also created a 2' planting area between the driveway
and fence line so that I can fit seven 24" box Evergreen Privacy trees along our shared property line. I have
attached a picture of these trees which are my favorite for neighbor screening and have actually used them at
my own house to serve the same purpose. These trees can get to 25' tall and about 12' wide and require minimal
maintenance. I have also added Pittosporum tenuifolium shrubs as understory plantings in this same planting
strip which should help reduce sound from our driveway since it is a very dense hedge that can grow up to 8' 10'
tall. Along the house I have also added a Climbing Rose vine which should also grow up towards the 2nd story.

As requested on Friday, September 5, 2014, I visitecl the above site ior the purpase of inspectin{;
and commenting on the trees. A new landscape and some construction is planned far this site
and your concern as to the future health and safety has prompted this visit.
Method:
All inspections were made from the ground; the tree was not climbcd for this inspection. The
tree in question was located on a map prnvided by you. The tree was then tneasured for diameter
at 54 inches above ground level (DBH or diameter at breast hei�ht). The tree was given a
condition ratin� for form and vitality. The trees' condition rating is bascd on 50 pereent vitality
and �0 percent form, using the followins scale.

T`he height of the tree was measured usin� a Nikon Forestry S50 Hypsometer. The sprcad was

Summary:
The trees on site are a mix of native oal:s and iniportcd trees. The imported trees consist of
rcdwoods, acacia, magnolias and maples. The imparted trees are in fair condition with no
e�cellent trees. The acacia is in fair condition and has fair farm for the species. The redwoods
are the dominant trees on thc property and have causcd other trees to grow with suppressed form.
The oaks have �rown with heavy leans away from the redwoods. The two aaks both grow al 45
degree angles and arc immediate hazards. The oaks should be removed as trimming within
ANSI standards cannot improve the oal:s hazazd rating. The trees to be retained should be
protected and the foilowing tree protection plan will help to reduce impacts to the trees.

Tree Protcction Plan:
Tree protection zones should be established and maintained throughout the entire length of the
project. Fencing for the protection zones should bc 6 foot tall metal chain link type supported
my 2 inch metal poles pounded into the ground by no less than 2 feet. The support poles should
be spaced no more than 10 feet apart on center. The location for the protection fencin� should be
as close to the dripline as possible still allowing room for construction to safely continue. Signs
should be placed on fencing signifying "Tree Protection Zone - Keep Out". No macerials or
equipment should be stored or cleaned inside the tree protection zones. Area.s outside the
fencing but still beneath the driPline of protected trecs, where foot traffic is expected to be heavy,
should be mulched with 4 to 6 inches of chipper chips. Tree protection for the trees on the
perimeter where construction will not affect the trees can be of oran�e plastic fencing support�d
by metal stakes.
Trenching for irrigation, electrical, draina�e or any other reason should be hand du� when
beneath the driplines of protected trees. Hand digging and carefully laying pipes below or beside
protected roots will dramatically reduce root loss of desired trees thus reducing trauma to the
entire tree. Trenches should be backfilled as soon as possible with nativc material and
compacted to near its original level. Trenches that must be left exposed for a period of time
should also be covered with layers of burlap or straw wattle and kept moist. Plywood over the
top of the trench will also help protect exposed roots below.
Normal imgation should be maintained throubhout the entire length of the project. The imported
trees on this site will require irrigation during the warm season months. Some irrigation may be
required during the winter months dependin� on the seasonal rainfall. During the stimmer
months the trees on this site should receive heavy flood type irrigation 2 times a month. During
the fall and winter 1 time a month should suffice. Mulchinb the root zone of protected trees will
help the soil retain moisture, thus reducing water consumption.

submitted to the Public Works Engineering Division with the parcel map

13 The project shall submit a condominium map to the Engineering Divisions
in accordance with the requirements of the Subdivision Map Act.
14 The project shall, at its own cost, design and construct frontage public
improvements including curb, gutter, sidewalk and other necessary
appurtenant work.
15 The project sha11, at its own cost, design and construct frontage streetscape
improvements including sidewalk, curb, gutters, parking meters and poles,
trees, and streetlights in accordance with streetscape master plan.
16 By the preliminary review of plans, it appears that the proj ect may cause
adverse impacts during construction to vehicular traffic, pedestrian traffic
and public on street parking. The project shall identify these impacts and
provide mitigation measure acceptable to the City.
17 The project shall submit hydrologic calculations from a registered civil
engineer for the proposed creek enclosure. The hydraulic calculations
must show that the proposed creek enclosure doesn't cause any adverse
impact to both upstream and downstream properties. The hydrologic
calculations shall accompany a site map showing the area of the 100-year
flood and existing improvements with proposed improvements.
18 Any work within the drainage area, creek, or creek banks requires a State
Department of Fish and Game Permit and Army Corps of Engineers
Permits.

20 � The project shall comply with the City's NPDES permit requirement to
prevent storm water pollution.
21 The project does not show the dimensions of existing driveways, re-

December 31, 2013 then this project must comply with the 2013 California
Building Codes.
2) Specify on the plans that this project will comply with the 2013 California Energy
Efficiency Standards.

the location of all structures on the property, existing driveways, and on-site
parking.
8) This project will be considered a New Building because, according to the City of
Burlingame Municipal code, "when additions, alterations or repairs within any
twelve-month period exceed fifty percent of the current replacement value of an
existing building or structure, as determined by the building official, such building
or structure shall be made in its entirety to conform with the requirements for new
buildings or structures." This building must comply with the 2013 California
Building Code for new structures. BMC 18.07.020
Note: Any revisions to the plans approved by the Building Division must be
submitted to, and approved by, the Building Division prior to the implementation
of any work not specifically shown on the plans. Significant delays can occur if
changes made in the field, without City approval, necessitate further review by
City departments or the Planning Commission. Inspections cannot be scheduled
and will not be performed for work that is not shown on the Approved plans.
9) Due to the extensive nature of this construction project the Certificate of
Occupancy will be rescinded once construction begins. A new Certificate
of Occupancy will be issued after the project has been finaled. No
occupancy of the building is to occur until a new Certificate of Occupancy
has been issued.
10)When you submit your plans to the Building Division for plan review provide a
completed Supplemental Demolition Permit Application. NOTE: The Demolition
Permit will not be issued until a Building Permit is issued for the project.

)If horing walls are proposed, indicate on the plans that, at the time of Building
Permit application, plans and engineering will be submitted for shoring as
required by 2013 CBC, Chapter 31 regarding the protection of adjacent property
and as required by OSHA. On the plans, indicate that the following will be
addressed:
a. The walls of the proposed basement shall be properly shored, prior to construction
activity. This excavation may need temporary shoring. A competent contractor shall be
consulted for recommendations and design of shoring scheme for the excavation. The
recommended design type of shoring shall be approved by the engineer of record or
soils engineer prior to usage.
b. All appropriate guidelines of OSHA shall be incorporated into the shoring design by
the contractar. Where space permits, temporary construction slopes may be utilized in
lieu of shoring. Maximum allowable vertical cut for the subject project will be five (5)
feet. Beyond that horizontal benches of 5 feet wide will be required. Temporary shores
shall not exceed 1 to 1(horizontal to vertical). In some areas due to high moisture
content / water table, flatter slopes will be required which will be recommended by the
soils engineer in the field.
c. If shoring is required, specify on the plans the licensed design professional that has
sole responsibility to design and provide adequate shoring, bracing, formwork, etc. as
required for the protection of life and property during construction of the building.
d. Shoring and bracing shall remain in place until floors, roof, and wall sheathing have
been entirely constructed.
e. Shoring plans shall be wet-stamped and signed by the engineer-of-record and
submitted to the city for review prior to construction. If applicable, include surcharge
loads from adjacent structures that are within the zone of influence (45 degree wedge up
_ the slope from the base of the retaining wall) and / or driveway surcharge loads.

Arborist is required to be on site to monitor and approve any roots over 4 inches that are
proposed to be cut;
11. that prior to issuance of a building permit for demolition or construction of the project, the
project construction plans shall be modified to include a cover sheet and a landscape plan
that list the Kielty Arborist report, date stamped September 9, 2014, and
recommendations;
12. that the Protected-size trees shown to be removed on the approved plans can be removed
only after the plans for the project are approved by the Planning Commission, the ten day
appeal period has ended, and the Protected Tree Removal Permit has been issued;
13. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single
termination and installed on the portions of the roof not visible from the street; and that
these venting details shall be included and approved in the construction plans before a
Building permit is issued;
14. that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to
submit a Waste Reduction plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit;
15. that during demolition of the existing residence, site preparation and construction of the
new residence, the applicant shall use all applicable "best management practices" as
identified in Burlingame's Storm Water Ordinance, to prevent erosion and off-site
sedimentation of storm water runoff;
16. that the project shall meet all the requirements of the California Building and Uniform Fire
Codes, 2013 Edition, as amended by the City of Burlingame;
THE FOLLOWING CONDITIONS SHALL BE MET DURING THE BUILDING INSPECTION
PROCESS PRIOR TO THE INSPECTIONS NOTED IN EACH CONDITION:
17. that prior to scheduling the framing inspection the applicant shall provide a certification by

Project Description: The subject site is an irregularly-shaped lot with 70 feet of frontage on Cabrillo Avenue.
The width of the lot increases to 100 feet at the rear of the parcel. Sanchez Creek runs along the right side of
the property.
The applicant is proposing to demolish the existing single-family dwelling and accessory structures on site. A
new, two-story single-family dwelling with a detached garage is proposed on the site. The proposed floor area of
the dwelling and the detached garage is 5,036 SF (0.453 FAR) where a maximum of 5,060 (0.46) FAR is
allowed. The proposed project is within 1% if of the maximum allowable floor area.
The applicant submitted an arborist report date stamped September 9, 2014, from Kielty Arborist Services.
There are five protected-size trees on the site (numbered 3, 4, 6, 7, and 8 on Sheet A.2). The applicant is
proposing to remove the two Oak trees that are on-site (numbers 4 and 7). The Parks Division received a
Protected Size Tree Removal Permit for these trees (see attached permit application, date stamped October 7,
2014). In the October 10, 2014 Project Comments, the Parks Division notes that the Tree Removal Permit will
be approved and the trees can be removed only after the plans for the project are approved by the Planning
Commission and the ten day appeal period has ended.
Three existing protected-size trees will remain on site, two Redwood trees and a Black Acacia tree, and the
arborist report details protection measures for these trees during demolition and construction.
The applicant is proposing a two-story house with 6 bedrooms. Two covered parking spaces and one uncovered
parking space are required for a 6-bedroom house. A detached garage is proposed at the rear, left side of the
property and provides two covered parking spaces (20' x 20'). There is a single uncovered parking space in the
driveway leading to the garage (9' x 20').
A conditional use permit is requested for a toilet in an accessory structure. A half bathroom, with a toilet and a
sink, is proposed at the right side of the detached garage, adjacent to the rear yard for the property. All other
Zoning Code requirements have been met.
The applicant is requesting the following applications:

Council on April 20, 1998 are outlined as follows:
Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
3. Architectural style and mass and bulk of structure;
4. InterFace of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit, the Planning Commission
must find that the following conditions exist on the property (Code Section 25.52.020, a-c):
(a) The proposed use, at the proposed location, will not be detrimental or injurious to property or

The trees on site aze a mix of native oa.ks and imported trees. T1�e impartcd trees cansist of
redwoods, aeacia, magnolias and mapl�s. The innported trees are in fair ccanditiQn with no
e.r•celIent trees. The ac�cia is in fair candition and l�as fair farm for the s�ecies. The redwoods
are tl�e dominant trees on th� property and ha�e causec� other trees to grow witEi suppressed form.
Tl�� oaks have grown cvith heavy leans away f�om the redwauds. The twa aaks both grow at 45
degree angles and are immediate ilazards. The oal:s s}�ould be removed as trimming within
ANSI standards cannot improve the oal:s hazard rating. The trees t� be retained should be
protected and the f�llo�ving tree pra#ection plan will help to reduce impacis to the trees.

Tree Protection Plan:
Tree protectian zones should be established and maintained tliroughout the entire lci�gth of the
project. Fencing for the protectian zones shauld be 6 foot tall metal chain link type supported
my 2 inch metal poles paunded into the graund by no less than 2 feet. The support poles should
be spaced no more than 10 feet apart on center. The location for tl�e protection fencing should be
as ciose to the dripline as possible still allowing room for construction to safely cantinue. Signs
should be placed on fencing signifying "Tree Protection Zone - Keep Out". No materials or
equipment should be stored ar cleaned inside th� tree protection zones. Areas outside the
fencing but still beneath the dripline of protected trees, where faot traffic is expected to be heavy,
shauld be mu�ched with 4 to 6 inches of chippec chips. Tree protection for the trees on the
perimeter where construction will not affect the trees can be of orange piastic fencin� supported
by metal stakes.
Trercching for irrigation, electrical, drainage or any other reason should be hand dug when
beneath the driplines of protected trees. Hand dig�;ing and carefully taying pipes below or beside
protected roots will drarnatically reduce roat toss of desired trees thus reducing trauma to the
entire tree. Trenches should be backfilled as soon as pvssible with nati�e material and
compacted ta near its original level. Trenehes that must be left exposed for a periad of time
should also be covered with layers af burlap or straw wattle and kept moist. Plywaod over th�
tap of the trench will also help protect exposed roots helow.
Normal irrigatian should be mainiained throughout the entire length of the project. The imported
trees on this site will require irrigation during the wartn season montlis. Some irrigation may be
required during the winter months depending on the seasanaa rainFall. During the st�mmer
months the trees an this site should receive heavy flood type irrigatian 2 times a month. During
the fall and w-inter 1 time a manth should suffice. Mu3chin� the root zone of protected trees will
heIp the soil retain moisture, thus reducing water conswtnption.

11. A latest preliminary title report of the subject parcel of land shall be
submitted to the Public Works Engineering Division with the parcel map
for reviews.
12 Map closure/lot closure calculations shall be submitted with the parcel
map.
13 The project shall submit a condominium map to the Engineering Divisions
in accordance with the requirements of the Subdivision Map Act.
14 The project shall, at its own cost, design and construct frontage public
improvements including curb, gutter, sidewalk and other necessary
appurtenant work.
15 The project shall, at its own cost, design and construct frontage streetscape
improvements including sidewalk, curb, gutters, parking meters and poles,
trees, and streetlights in accordance with sireetscape master plan.
16 By the preliminary review of plans, it appears that the proj ect may cause
adverse impacts during construction to vehicular traffic, pedestrian traffic
and public on street parking. The project shall identify these impacts and
provide mitigation measure acceptable to the City.
17 The project shall submit hydrologic calculations from a registered civil
engineer for the proposed creek enclosure. The hydraulic calculations
must show that the proposed creek enclosure doesn't cause any adverse
impact to both upstream and downstream properties. The hydrologic
calculations shall accompany a site map showing the axea of the 100-year
flood and existing improvements with proposed improvements.
18 Any work within the drainage area, creek, or creek banks requires a State
Department of Fish and Game Permit and Army Corps of Engineers
Pernuts.
19 � No construction debris shall be allowed into the creek.
20 � The project shall comply with the City's NPDES permit requirement to
prevent storm water pollution.
21 The project does not show the dimensions of existing driveways, re-
submit plans with driveway dimensions. Also clarify if the proj ect is
proposing to widen the driveway. Any widening of the driveway is subject
to City Engineer's approval.

buildings or structures." This building must comply with the 2013 California
Building Code for new structures. BMC 18.07.020
Note: Any revisions to the plans approved by the Building Division must be
submitted to, and approved by, the Building Division prior fo the implementafion
of any work not specifically shown on fhe plans. Significant delays can occur if
changes made in the field, without City approval, necessitate further review by
City departments or the Planning Commission. Inspections cannot be scheduled
and will not be performed for work that is not shown on the Approved plans.
9) Due to the extensive nature of this construction project the Certificate of
Occupancy will be rescinded once construction begins. A new Certificate
of Occupancy will be issued after the project has been finaled. No
occupancy of the building is to occur until a new Certificate of Occupancy
has been issued.

completed Supplemental Demolition Permit Application. NOTE: The Demolition
Permit will not be issued until a Building Permit is issued for the project.

)If horing walls are proposed, indicate on the plans that, at the time of Building
Permit application, plans and engineering will be submitted for shoring as
required by 2013 CBC, Chapter 31 regarding the protection of adjacent property
and as required by OSHA. On the plans, indicate that the following will be
addressed:
a. The walls of the proposed basement shall be properly shored, prior to construction
activity. This excavation may need temporary shoring. A competent contractor shall be
consulted for recommendations and design of shoring scheme for the excavation. The
recommended design type of shoring shall be approved by the engineer of record or
soils engineer prior to usage.
b. All appropriate guidelines of OSHA shall be incorporated into the shoring design by
the contractor. Where space permits, temporary construction slopes may be utilized in
lieu of shoring. Maximum allowable vertical cut for the subject project will be five (5)
feet. Beyond that horizontal benches of 5 feet wide will be required. Temporary shores
shall not exceed 1 to 1(horizontal to vertical). In some areas due to high moisture
content / water table, flatter slopes will be required which will be recommended by the
soils engineer in the field.
c. If shoring is required, specify on the plans the licensed design professional that has
sole responsibility to design and provide adequate shoring, bracing, formwork, etc. as
required for the protection of life and properiy during construction of the building.
d. Shoring and bracing shall remain in place until floors, roof, and wall sheathing have
been entirely constructed.
e. Shoring plans shall be wet-stamped and signed by the engineer-of-record and
submitted to the city for review prior to construction. If applicable, include surcharge
loads from adjacent structures that are within the zone of influence (45 degree wedge up
the slope from the base of the retaining wall) and / or driveway surcharge loads.
