Summary: Albert Aubry, representing Tresser's Towing, is requesting a special permit for automobile storage at 868 Burlway Road #200, zoned M-1 (CS 25.43.030-17, 18). The towing company has had a business license with the City of Burlingame since 1988 for towing, but not for storage. According to the applicant, the company began storing automobiles at this site about two years ago. The City did not know of the automobile storage until the Planning Department recently processed a special permit and parking variance application for a traffic school. This business is located in a building with five other addresses/tenant spaces. The office portion of this particular tenant space was sublet to Orchid Gallery and Custom Design, a clothing design company, however, it is currently vacant. The warehouse portion of this tenant space is used for indoor storage of automobiles towed from the streets of Burlingame. Indoor storage is typically reserved for vehicles involved in a crime or those which would otherwise be targeted for crime if left outdoors. Outdoor storage currently occurs on the unpaved area between the building and side property line. Tresser's Towing has no employees working at the site. Tow truck drivers would be on site as needed to drop off towed vehicles or to tow unclaimed vehicles to San Mateo for dismantling. In addition, a Tresser's employee occasionally meets at the site with vehicle owners claiming their cars. The tow trucks are stored at the company's site at 120 S. Amphlett Boulevard in San Mateo. All dismantling is done at the San Mateo site. No dismantling is done at 868 Burlway. 1 � . r, SPSCIAL PSRXZT 868 BuzZway Road This tenant space was previously used for storage for a painting contractor. The change in use to automobile storage does not affect parking requirements, although a special permit is required for this particular type of storage. Al1 other zoning code requirements have been met. Backqround: There are six addresses at this site: 858, 858A, 860, 864, 866 and 868 Burlway Road. In June, 1993, the Burlingame Planning Commission approved a special permit and nine-stall parking variance for traffic school classes at 866 Burlway (refer to letter of approval and partial staff report). Classes take place on weekday nights and on the weekends, with a maximum of 40 students. ADD. Due to the proximity of the creek, the catch basins will be required to have petroleum absorbent pillows which would be maintained by the applicant. The Building Official and Fire Marshal both noted that 1-hour fire separation is required between the auto storage area and other B-2 occupancies in the building. In addition, they both noted that adequate ventilation for the storage area be provided in accordance with the Uniform Building Code. Required Findiaqs for a Special Permit: In order to grant a Special Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planninq Commission Action: The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution. The reasons for any action should be clearly stated. The June 28, 1993 minutes of the Planning Commission state your application was approved with the following conditions: l. that the project shall conform to the business plan set forth in the Commercial Applications form and the Letter of E}cplanation date stamped May 13, 1993, except that weekday classes shall not begin before 6:15 P.M. and the applicant must provide lighting in the parking lot from twilight to 15 minutes after the close of any evening classes; 2. that the conditions set forth in the Fire Marshal's memo dated May 24, 1993 shall be met; and 3. that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Any site improvements or construction work will require separate application to the Building Department. This approval is valid for one year during which time a building permit must be issued. One extension of up to one year may be considered by the Planning Commission if application is made before the end of the first year. The maximum number of students expected to attend during one class is 40 with one instructor. The applicant has shown a total of 32 parking spaces on-site which is inadequate for on-site parking of all 40 students and one instructor. A parking variance is required for the nine (9) spaces not available on-site. The applicant states in his letter that the students park on the street and in the parking lot. This is a code enforcement item. The complaint was brought by a person wanting to locate a similar business in the area. Staff Comments: The Chief Building Official and the Fire Marshal had similar concerns about exiting stated in their memos dated May 17, 1993. On May 24, 1993 the Fire Marshal went out to 866 Burlway Road to field check the exiting from the second floor. Based on field observation his concerns and those of the Chief Building Official were alleviated. The Fire Marshal made one additional note that there must be a clear exit to the street from the exterior exit stairs. The City Engineer comments in his May 17, 1993 memo; that since�'this business occurs after normal working hours, he has no concerns about the parking impact. Study Meetinq: At the June 14, 1993 Planning Commission Meeting the Planning Commissioners had comments and questions regarding this project (see P.C. Minutes, June 14, 1993). The other tenants hours were included in the original report. The tenants under the following addresses are all located in the same building as 866 Burlway: 858, 864 and 868 who have tenants occupying them at this time and 858 A and 860 which are vacant at this time. Please see the 'List of other tenants in building' for their type of business and hours of operation. The present tenants at 858 and 864 Burlway rely on Saturday business hours for portions of their business activities. The property owner is out of town and unavailable for an answer to whether he would be willing to prohibit Saturday hours for the two empty tenant spaces. Required Findinqs for a Special Permit: In order to grant a Special Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; 2 1 SPSCIAL PSRXIT AND VARIANCS 866 BDRLWAY ROAD (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. As our main administrative offices are in other p.�rts of the state, we oniy needed the Burlingame facility on a very par�-time basis, thus only folding chairs and c_zalkboards were rtoved in, 'i�iere is no need for telephones or equipment, as the only reason we lease the site s�ems from the savings over sirlply renting hotel meeting rooms (ie. Foster City Holida�� Inn) for the same use. ��ur classes around the state and in your city are held 95 o of the time on Saturdays. 4 o are held on Sundays and weeknights, and lo are held on weekdays. In Burlingame our use will be limited to every Saturday, every other Sunday from 8 am -4pm, and two nights a week twice a month fra-n 6pm -lOp�n. Oar students are affluent, educated, insured drivers, who are controlled by highly trained and professional teachers. The schools we represent attract mostly professional people. T�riere are never problems with theft, vandalisM, or noise., Each school is licensed and regulated by the State DF�partment of Motor V�:hic�.es, so quality is basically assured. If parking is a concern, please look at the adjoing parking lot(s) and the more than adequate Barlway street parking. Remember, these classes are always after norn�i working ahours and on weekends.
