SummarY:
The applicant (for "To The Elk, Inc.") is requesting a special
permit to hold traffic school classes on the second floor at 866
Burlway Road, zoned M-1. The classes would be held on Tuesday and
Wednesday evenings from 6:OOpm to 10:OOpm and on Saturdays and
every other Sunday from 8:OOam to 4:OOpm. The maximum number of
students expected to attend during one class is 40 with one
instructor.
The applicant has shown a total of 32 parking spaces on-site which
is inadequate for on-site parking of all 40 students and one
instructor. A parking variance is required for the nine (9) spaces
not available on-site. The applicant states in his letter that the
students park on the street and in the parking lot. This is a code
enforcement item. The complaint was brought by a person wanting to
locate a similar business in the area.

Staff Comments: The Chief Building Official and the Fire Marshal
had similar concerns about exiting stated in their memos dated May
17, 1993. On May 24, 1993 the Fire Marshal went out to 866 Burlway
Road to field check the exiting from the second floor. Based on
field observation his concerns and those of the Chief Building
Official were alleviated. The Fire Marshal made one additional note
that there must be a clear exit to the street from the exterior
exit stairs. The City Engineer comments in his May 17, 1993 memo;
that since this business occurs after normal working hours, he has
no concerns about the parking impact.
Study Meetinq: At the June 14, 1993 Planning Commission Meeting the
Planning Commissioners had comments and questions regarding this
project (see P.C. Minutes, June 14, 1993).
The other tenants hours were included in the original report. The
tenants under the following addresses are all located in the same
building as 866 Burlway: 858, 864 and 868 who have tenants
occupying them at this time and 858 A and 860 which are vacant at
this time. Please see the 'List of other tenants in building' for
their type of business and hours of operation. The present tenants
at 858 and 864 Burlway rely on Saturday business hours for portions
of their business activities.
The property owner is out of town and unavailable for an answer to
whether he would be willing to prohibit Saturday hours for the two
empty tenant spaces.
Required Findinqs for a Special Permit:
In order to grant a Special Permit the Planning Commission must
find that the following conditions exist on the property (Code
Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be
detrimental or injurious to property or improvements in the
vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;

(b) the proposed use will be located and conducted in a manner in
accord with the Burlingame general plan and the purposes of
this title;
(c) the Planning Commission may impose such reasonable conditions
or restrictions as it deems necessary to secure the purposes
of this title and to assure operation of the use in a manner
compatible with the aesthetics, mass, bulk and character of
existing and potential uses on adjoining properties in the
general vicinity.
Findinqs for a variance:
In order to grant a variance the Planning Commission must find that
the following conditions exist on the property (Code Section
25.54.020 a-d):
(a) there are exceptional or extraordinary circumstances or
conditions applicable to the property involved that do not
apply generally to property in the same district;
(b) the granting of the application is necessary for the preserva-
tion and enjoyment of a substantial property right of the
applicant, and to prevent unreasonable property loss or
unnecessary hardship;
(c) the granting of the application will not be detrimental or
injurious to property or improvements in the vicinity and will
not be detrimental to the public health, safety,
general welfare or convenience;
(d) that the use of the property will be compatible with the
aesthetics, mass, bulk and character of existing and potential
uses of properties in the general vicinity.
Planninq Commission Action: The Planning Commission should hold a
public hearing. Affirmative action should be taken by resolution.
The reasons for any action should be clearly stated. At the public
hearing the following condition should be considered:
Conditions:
1. that the project shall conform to the business plan set forth
in the Commercial Applications form and the Letter of
Explanation date stamped May 13, 1993;
2. that the conditions set forth in the Fire Marshal's memo dated
May 24, 1993 shall be met; and
3. that the project shall meet all the requirements of the
Uniform Building and Uniform Fire Codes as amended by the City
of Burlingame. .

Prior to your review of our application, I'd like to explain our
intentions.My company provides all facets of traffic school operations to
schools contracted with us. I obtain the leases, hire and train the
employees, and basically handie all day to day operations. In the City of
Burlingame, we found that the 866 B;zrlway prroperty offerred an opportunity
to lea�e large, spacious offices to conduct our traffiuc school classes.
As our Ii1d1T1 administrative of f ices are in other p-�rts of the state , we
oniy needed the Burlingame facility on a very par�-time basis, thus only
folding chairs and c_�alkboards were rioved in. 'i�iere is no need for
telephones or equipment, as the only reason �ve lease the site scems from
the savings over simply renting hotel meeting rooms (ie. Foster City
Holida•y Inn) for the same use.
C�ur classes around the state and in your city are held 95 0 of the time on
Saturdays. � o are held on Sundays and weeknights, and lo are held on
weekdays. In Burlingame our use will be limited to every Saturday, every
other Sunday froni 8 am -4pm, and two nights a week twice a month fro-n 6pm
-lOp�n. Oar students are affluent, educated, insured drivers, who are
controlled by highly trained and professional teachers. The schools we
represent attract mostly professional people. 'P�riere are never problems with
th�ft, vandali�m, or nois�.. Each school is licensed and regulated by the
State Df�partment of Motor V�•hic�es, so quality is basically assured.
If parking is a concern, please look at the adjoing parking lot(s) and the
more than adequate B�arlway street parking. Remember, these classes are
always after nor�i�l working ahours and on weekends.
Please review our application and allow us to conduct quality educational
traffic safety classes in Burlingame as we do .in -30 other cities in the
state.

The CITY OF BIIRLINGAME PLANNING COMMISSION announces the

RESOLUTION NO.
RESOLUTION APPROVING CATEGORICAL EXEMPTION,
SPECIAL PERMIT AND PARKING VARIANCE
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application
has been made for a special permit for classes in the M-1 zone and a
parking variance for nine stalls at 866 Burlwav Road (APN 026-111-010�•
(nropertv owner: Nicholas A& Stella Crisafi 808 Burlway Road #200�
Burlinqame, CA 94010 �; and
WHEREAS, said matters were heard by the Planning Commission of the
City of Burlingame on June 28. 1993 , at which time it reviewed
and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning
Commission that:
1. On the basis of the Initial Study and the documents submitted
and reviewed, and comments received and addressed by this.commission, it
is hereby found that there is no substantial evidence that the project
set forth above will have a significant effect on the environment, and a
categorical exemption, Sec. 15301 - Existing facilities, Class 1(a),
Interior or exterior alterations ..., is hereby approved.
2. Said special permit and parking variance are approved subject
to the conditions set forth in Exhibit "A" attached hereto. Findings for
such approval are as set forth in the minutes and recording of said
meeting.
3. It is further directed that a certified copy of this resolution
be recorded in the official records of the County of San Mateo.
