During the foilowing week, the Chief [3uilding Inspector informed the company leasing this sign, Fred Harvey, fnc. for Airport P1arina Hotel, that a permit was r�equired for the new sign copy. On Octobe►- 28, 1975 an application for a Sign Permit was submitt�d to the Planning Commission by Airport tlarina Hotel, with the I:nowledge of and consent.by the property owner, Mr. Earl E. Svaanson. At the Plannirg Commission Nearing tdovember 10, 1975 this application was denied 6-0 (one Commissioner absent). The present appeal is made by Mr. D. C. Johnson of Fred Fiarvey with refererce to this denial. BACKGROUND The building at 866 Burlway Road was constructed approximately 20 years ago. In March, 1962 an application was filed with the City by Swanson Construction Company for a new 35'4" high pole si�n. The body of the sign was to be 32'6" long by 5'4" tall (172 square feet in area . The height and size of the sign were necessary fior the sign to be legible from the adjacent freeway, it was argued by Amco Sign Company during the hearing. Municipal Ordinance No. of 20'. Ordinance No. 618 permitted roof signs, subject to their the roof line. The Swanson building is approximately 22' tall was proposed for its roof. The body of the sign was to be 20' {20G square feet). To increase the new restaurant's advertising exposure, Tia Maria signed a lease with Earl Swanson for the existing roof sign at 866 Burlway Road. And fio conform to staff's interpretation of the code prohibition on off premise advertising, Tia Maria extended the sign lease to include office space in the buiiding. New copy for the sign was approved on ihis basis. That ministeriai decision was not reviewed by the Planning Commissi�n. � 8 -2- The existing roof sign has recently been leased by ttie �,irport Marina Hotel, together with 40Q square feet of office space. The lease runs from October 1, 1975 to September 30, 1976. ihe 400 SF room at 866 Buriway is presently being used for dead storage. Tt�e roof sign is presently advertising food and services c�nly available 900' away afi the hotei on Baysliore Highway. Details of the present sign are as follows: Sign area: 220 SF per face Copy: (1) Airport ��larina liotet (2) Reader board (at 10/31/75 "Coffee Shop 6anquets" and "Prime Rib Specials 4,95") (3) Direction advice ("Next Ex i t' `) Max. height: 42-1/2' 10'x20' plus "exit" sign (Exhibit C) Approx. 120 SF Approx. 80 SF Approx. 20 SF Illumination: Neo� Hours: "Alt times" Pft�SENT S I GPd ORD I NANCE Sec. 22.12.040 of the Sign Code states: "Any sign now or hereafter existing which no tonger advertis�s a bona �ide business conducted or products sold on the premises where the sign exists shall be taken down by the owner or tenant of the building ..." Sec. 22.20.010(d) defines as a prohibited sign: "Signs carrying the advertising of a person, product or service other than that of the occupant of ... the building to which it is attached . . ." Sec. 22.24.020 further prohibits advertising dispiays adjacent to a freeway if such advertising is designed to be viewed primarily from the freeway, not a local road. This would appear to be true for this sign. Finally, Ordinance No. 1023, adopted December 2, 1974, defines and prohibits roof signs. SUMMARY After reviewing the above, fihe Planning Commission found that the present Airport Marina advertising on the roof sig� at 866 Burlway Road does not reflect goo�s or services available at that address (Sec. 2?_.20.010(d)); and that in its present form it is a prohibited advertising display next to a freeway (Sec. 22.24.020}.
