Dear Mr. Daley,
Since there was no appeal to or suspension by the City Council, the January 22, 1996 Planning
Commission approval of your special permit became effective February 6, 1996. This
application was to allow an automobile broker at 808 Burlway Road, Unit #2, zoned O-M.
The January 22, 1996 minutes of the Planning Commission state your application was approved
with the following conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped December 1, 1995, Site Plan (81/z" X 11") and floor plan (81h" X
11°
);
2. that the conditions of the Fire Marshal's December 18, 1995 memo shall be met;
3. that none of the uncovered on site parking shall be used for automobile display or to
store cars for sale from this business, and none of the required parking spaces shall be
signed or designated to Unit #2; none of the pazking on site shall be leased for a fee to
any other business, use or activity without amendment to this use permit;
4. that the business shall be open 1:00 p.m. to 5:00 p.m., Monday through Friday and
12:00 p.m. to 4:00 p.m., Saturday with a maximum of two employees on site at any one
time including the proprietor;
5. that at least one space for displaying a vehicle shall be provided inside the building in
accordance with the Department of Motor Vehicle dealer's license requirements;

6. that vehicles to be sold or displayed by this business shall be delivered before or after
regular business hours of other tenants on site; no cazs shall be off loaded on the public
street, in shared driveways or in such a way that required on site parking is blocked;
7 that any changes to this business operation and floor area (square footage) as outlined in
the application materials date stamped December 1, 1995, shall require an amendment
to this special permit; and
8. that the project shall meet all the requirements of the Uniform Building and Uniform Fire
Codes as amended by the City of Burlingame.
All site improvements and construction work will require separate application to the Building
Department. This approval is valid for one year during which time a building permit must be
issued. One extension of up to one year may be considered by the Planning Commission if
application is made before the end of the first year.
(Erection of the signage will require separate application to the Building Department.)

..COVENANT TO GRANT EASEMENT
Nicholas A. Crisafi (hereinafter referred to as "Crisafi")
and the City of Burlingame, a municipal corporation
(hereinafter referred to as '"City"), hereby agree as follows•
Whereas, Crisafi is the owner of the real property known
as 808,826 Burlway Road and 1461 Bayshore Highway, Burlingame,
California, more particularly described on Exhibit "A" as
Parcel One, and 860 Burlway Road, Burlingame, California
more particularly described on Exhibit "A" as Parcel Two
attached hereto and made a part hereof; and
Whereas, Crisafi intends to build upon said land and as
a condition to obtaining the building permit the City
requires Crisafi to convenant to grant a non-exclusive
easement for ingress and egress over a portion of his land
fo`r the benefit of another portion of his land. Both
pieces are currently owned by Crisafi and said easement
would merge with the fee title.
Therefore; ^risafi hereby convenants't�o grant a
non-exclusive easement for ingress and egress over the
property described in Exhibit "B" should any part of the
property be sold to a third party.

AUTHORIZING EXECUTION OF COVENANT TO GRANT EASEMENT -
860 BURLWAY
RESOLVED by the City Council of the City of Burlingame,
California, and this Council does hereby FIND, ORDER and DETERMINE
as follows:
1. The public interest and convenience require execution of
the agreement cited in the title above.
2. The City Manager be, and he is hereby, authorized to sign
said agreement for and on behalf of the City of Burlingame.
3. The City Clerk is hereby ordered and instructed to attest
such signature. 1
