15302 - Replacement or Reconstruction Class 2(b), Replacement of a commercial structure with
a new structure of substantially the same size, purpose, and capacity.
Summary: In September of this year a fire destroyed the second floor of the two story office
building at 808 Burlway Road. The property owner decided not to rebuild the second floor and
instead repair, expand and change the uses on the first floor so to be office/wazehousing. The
remaining first floor portion of the building is 7, 850 SF, the proposed addition to the first floor
is 7,471 SF for a total of 15,231 SF (2,009 SF office and 13,222 SF wazehouse). The side
setback variance is required for an existing non-conforming 0'-0" setback along the North
property line where 10'-0" is required. The office manufacturing (O-1V� district requires that
15% of the lot be suitably landscaped. The lot is 31,086 SF is area which would require 4,663
SF of landscaping. The landscape variance is required for the proposed 2,638 SF of landscaping
which is 8.5 %, where 15 % is required.
The proposal splits the remodeled structure into 8 office/warehouse units each approximately
1,900 SF. The office area constitutes 229 SF (12%) of each unit and the remaining 1,671 SF
is warehouse. The applicant's first proposal showed a site plan with 21 parking spaces and
landscaping islands constituting 13 % of the lot area. Since the November 28, 1994 Planning
Commission Study meeting the property owner decided he would like to have more parking and
less landscaping, the new proposal is for 29 parking spaces and 8.5 % landscaping. A new site
plan (see 11" X 17" plan dated October 21, 1994) shows 29 parking spaces on-site, 2 of which
are disabled accessible van spaces and 4 aze compact spaces. The proposed 2,009 SF of office
space requires 7 parking spaces and the 13,222 SF of wazehouse requires 13 parking spaces for
a total of 20 spaces where 29 are proposed. Parking spaces 15 - 29 back up into a shared access
driveway. If the shared driveway aisle were to be blocked along the property line parking
spaces 15 through 29 would no longer be useable and the site would have 14 legal parking
spaces. The property owner owns both properties which share the driveway access. With the
increase in number of parking spaces the landscaping area has been reduced 4.5 % from the
previously proposed 13 % to 8.5 %.

Staff comments: The Chief Building Official commenterl in his memo dated October 24, 1994
that the two disabled accessible parking spaces are required and at least one must be a van space
with the following dimensions; 9' wide parking space and 8' wide unloading area. The
unloading area can be shared by two disabled accessible spaces. All units and restrooms, if
provided, must meet disabled access requirements. If the building is not sprinklered then a
description of the construction and an area analysis will be required.
The Fire Marshal commented that the building shall be provided with an automatic fire sprinkler
system. The fire sprinkler system shall be monitored by an approved Central Station. The
Associate Civil Engineer had no comments. Planning Staff has determined that the damage
affected more than half the value of the structure so the repair/remodel is effectively a new
building.
Study Meeting: At the November 28, 1994 Planning Commission meeting the Planning
Commissioners asked several questions (P.C. Minutes November 28, 1994). The property
owner respondetl to the Planning Commission's questions in his letter dated December 5, 1994.
The property owner states if the building was rebuilt to its previous conditions the non-
conformity would still remain.
The fire damaged 80 % of the second floor and the first floor had water damage. The ceiling
height of the proposed single story structure is 14'-6". The property owner speculates that the
new tenants will be service people and small contractors who will drive sma11 vans and trucks.
Fie believes that all loading and unloading will take place at or inside the roll-up door to each
unit.
The existing number of parking spaces on site is 51. The applicant would like to change the
number of proposed parking spaces from the previous proposal from 21 to 29 spaces. The 29
parking spaces are shown on the attached 11" X 17" site plan dated October 21, 1994. The
applicant would rather have more parking on-site than try to meet the 15 % landscaping
requirement for the O-M zone. The addition of 8 spaces in the place of the landscaping islands
reduces the amount of on-site landscaping to from 13% (4,038 SF) to 8.5% (2,638 SF).

The property owner states that merging the two lots which shaze the common driveway in not
possible because the two parcels have separate loans. The property owner states that he is
proposing the change in use on tlus site to accommodate the demand for more warehousing.
�ndings for a Variance:
In order to grant a variance the Planning Commission must find that the following conditions
exist on the property (Code Section 25.54.020 a-d):
(a) there are exceptional or extraordinary circumstances or conditions applicable to the
property, involved that do not apply generally to property in the same district;
(b) the granting of the application is necessary for the preservation and enjoyment of a
substantial property right of the applicant, and to prevent unreasonable property loss or
unnecessary hardship;
(c) the granting of the application will not be detrimental or injurious to property or
improvements in the vicinity and will not be detrimental to the public health, safety,
general welfare or convenience;
(d) that the use of the property will be compatible with the aesthetics, mass, bulk and
character of existing and potential uses of properties in the general vicinity.
Planning Commission Action:
The Planning Commission should hold a public hearing. Action should be taken by resolution
with findings made for the variances requested. Reasons for any action should be clearly stated.
At the public hearing the following conditions should be considered:
1. that the project shall be built as shown on the plans submitted to the Planning Department
and date stamped October 21, 1994 Parking Layout with 8.5% landscaping (2,638 SF)
and November 17, 1994, Sheet 2, Floor Plan;
2. that the driveway easement shall be recorded on both properties so if either pazcel is sold
the shazed back up aisle remains for parking spaces 15 through 29;
3. that the project shall meet all conditions set forth in the Fire Marshal's memo dated
October 24, 1994 and the Building Official's memo dated October 24, 1994; and
4. that the project shall meet all Uniform Building and Uniform Fire Code requirements as
amended by the City.

WILL BE SERVICE AND SMALL CONTRACTORS. LOADING AND UNLOADING
WILL BE SMALL PICK UP TRUCKS THAT WILL BE LOADED IN THEIR ROLL
UP DOORS OR IN THE WAREHOUSE AREA.
4. SECOND FLOOR WAS 80% DESTROYED BY THE FIRE. THE FIRST FLOOR
HAD WATER DAMAGE ONLY.
5.FIRST FLOOR CEILING HEIGHT WILL BE 14 FEET 6 INCHES.

AND LANDING GOING INTO THE OFFICE. THIS SPACE OCCUPIES 288
SQUARE FEET. WE PLAN TO RE-LANDSCAPE THE ENTIRE FRONT FACING
BURLWAY ROAD. LANDSCAPING WILL BE INSTALLED AT THE ENTRANCE
OF EACH UNIT, AND AT THE REAR OF THE PARKING AREA. I WOULD
LIKE TO REQUEST THAT THE COMMISSION ALLOW ME TO USE THE
EIGHT SPACES SHOWN FOR PARKING RATHER THAN LANDSCAPING.
8. EXISTING BUILDING THAT DOES NOT MEET SIDE SETBACK AND
LANDSCAPING CAN BE REBUILT AS IS. THE REASON WE WANT TO REMOVE
THE TOP FLOOR AND BUILD SMALL WAREHOUSES IS ONE OF ECONOMICS.
THERE IS EXCESS OFFICE SPACE IN THIS AREA. DEMAND IS FOR
SMALL AREHOUSE OF THE TYPE WE ARE PLANNING TO BUILD. THE NEW
BUILDING WILL BE CONSTRUCTED AGAINST THE EXISTING CINDER BLOCK
WALL. THE FOOTPRINT OF THE NEW BUILDING WILL BE SIMILAR AT

RFSOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a

Summary: In September of this year a fire destroyed the second floor of the two story
office/warehouse building at 808 Burlway Road. The property owner decided not to rebuild the
second floor and instead repair, expand and change the uses on the first floor to include
storage/warehousing. The remaining first floor portion of the building is 7, 850 SF, the proposed
addition to the first floor is 7,471 SF for a total of 15,231 SF (2,009 SF office and 13,222 SF
warehouse). The side setback variance is required for the existing non-conforming 0'-0" setback
along the North property line where 10'-0" is required. The office manufacturing district
requires that 15% (4,663 SF) of the lot be suitably landscaped. The lot is 31,086 SF is area
which would require 4,700 SF of landscaping. The landscape variance is required for the
proposed 4,038 SF of landscaping which is 13 % of the lot area.
The proposal splits the remodeled structure into 8 office/warehouse units each approximately
1,900 SF. The office area constitutes 229 SF of each unit and the remaining 1,671 SF is
warehouse. The applicant proposed a total of 21 parking spaces, 2 of which are disabled
accessible van spaces. The 2,009 SF of office space requires 7 parking spaces and the 13,222
SF of warehouse requires 13 spaces for a total of 20 required parking spaces. Parking spaces
11-19 back up into a shared access driveway. The property owner owns both properties which
share the driveway access.

Staff comments: The Chief Building Official commented in his memo dated October 24, 1994
that the two disabled accessible parking spaces are required at least one must be a van space with
dimensions 9' wide parking space and 8' wide unloading area. The unloading area can be
shared by two disabled accessible spaces. All units and restrooms, if provided, must meet
disabled access requirements. If the building is not sprinklered then a description of the
construction and an area analysis will be required.
The Fire Marshal commented that the building shall be provided with an automatic fire sprinkler
system. The fire sprinkler system shall be monitored by an approved Central Station. The
Associate Civil Engineer had no comments.

BACKGROUND:
Recently Nicholas Crisafi, the owner of 808-826 Burlway was granted
setback and landscaping variances for that property. The site
consists of two adjacent lots with parking on either side of the
joint property line. The required back up space for the parking on
each lot crosses over into the other. It is necessary that there
be mutual restriction on the properties so that if one is sold the
back up space is required to remain. This cannot be done with an
easement because the owner of one property cannot grant an easement
to himself as the owner of the other.
Instead of an easement, the title companies will accept a"Covenant
to Grant Easement" to accomplish the same thing. This is basically
a recorded agreement to grant the required easement if either
property is ever sold. We recommend the execution of the enclosed
document so that the easement may be assured and so that Mr.
Crisafi may receive final approval of his project.
