FROM: ASSISTANT CITY PLANNER
SUBJECT: REQUEST BY AZTEC RENT-A-CAR AND LEASING, INC. (LOS ANGELES)
TO REASSIGN 1976 SPECIAL PERMIT
P.C. 8/28/78
Item No. 6
The Planning Commission approved a Special Permit to "Daryl Nick for Aztec Rent-A-Car/
Ryder Truck Rentals" August 22, 1977. The franchise for this business has recently
been repurchased from Charles Nick (Daryl and Srian Nick's father) by Aztec Rent-A-Car
and Leasing, Inc. (Los Angeles). Aztec proposes to continue the car rental agency at
808 Burlway Road as a"company owned store" with a local manager, Bill Nagel. This
request is therefore to reassign the 1977 Permit to the parent company, Aztec (Los Angeles).
Copies of the following letters are attached for Commission review:
1. Letter dated August 7, 1978 from Vincent N. Po1eo, Operations Manager,
Aztec Rent-A-Car and Leasing (Los Angeles) requesting transfer of 1977 Permit.
2. Letter dated August 7, 1978 from Dominic J. Accetta, Corporate Office Director,
Aztec (Los Angeles) transmitting photocopy of Aztec letter to Ryder Truck
Rentals (San Francisco).
3. Letter dated July 27, 1978 from Vincent N. Poleo, Aztec (Los Angeles) to Ryder
Truck Rental, Inc. (San Francisco) advising no further contract exists between
Aztec Rent-A-Car and Ryder Truck Rental.
4. Letter dated Augus t 8, 1978 from Lynne I. Shirley, Property Manager for
University Real Estate Fund, Ltd. (property owner of 808 Burlway Road)
aaproving "with pleasure" the requested transfer of the 1977 Permit.
5. Letter dated August 23, 1978 from Vincent N. Poleo with details of the current
Aztec (Los Angeles) agency operation at 808 Burlway Road.
Past experiences with Daryl and Brian Nick convince staff that this requested reassignment
is in the best interests of the property owner, Aztec, other tenants at 808 Burlway Road
and the City of Burlingame. Staff recommends that this request be approved to Aztec
Rent-A-Car and Leasing, Inc. (Los Angeles) subject to 5 of the original 6 conditions of
the 1977 Special Permit:
1.
2.
3.
4.
5.
( to b e
omitted)
that there be a single lease agreement with the landowners of 808 Burlway
Road and 855 Mahler Road which includes no less than eight parking spaces
at 808 Burlway and 25 at 855 Mahler for the exclusive use of Aztec Rent-A-Car;
that these spaces be properly strioed and marked;
that no servicing or washing of vehicles take place at either location;
the lease to be subject to approval of the City Attorney; and
the special permit not to take effect until these conditions are met.
- that no more than four trucks be stored over any 24 hour period.
The Corrnission may wish to consider the additional requirement that "vehicle parking shall
be subject to annual review and report;" a condition of this type has been attached to
several recent approvals, most recently for Trans Rent-A-Car, Inc. at 1755 Bayshore
Highway (May 22, 1978).
