Lisa Rosenthal and Marlene Douglas, representing Peninsula Parent, a moa[hly nevspaper serving the Daly City to Palo Alto area, are reques[ing a special permit to loca[e the newspaper office in a classroom at Hoover School. The office would be open five days a veek, 9 to 5, vi[h tvo full time and one part time employees. No printing or distribution will take place from this site. The publication is distributed free and is supported by advertising. Planning Commission approved this special use permit at its meeting of July 14. City Planner noted nine letters in support of [his use were received after the s[aff report was prepared. Mayor Mangini opened the public heariag. Marlene Douglas, applicant, reviewed that this is a newspaper focused o¢ education and she felt it appropriate for a school site. The paper highlights news of importance to parents and childrea, lists library programs for example. They take advertising which helps pay for the nevspaper, they are not a nanprofit organiza[ion hut so far they are not a money making organization either. The school board has given approval and she hoped council would approve also. Mayor Mangini closed the public hearing. Councilman Amstrup noted he had called this up for reviev, his concern was [hat this was setting a precedent in alloving affice use in residential areas. He did not questian the value of the paper but thought it vould be better located in a commercial area. Councilman Lembi said the use is consistent and compatible vith a school site. The school board has given approval and it doeS no[ do so lightly, they are very concerned about use being campatible with the school neighborhood. Other council members agreed. Councilman Lembi moved to uphold the Planning Commission approval. Conditions considered by the Planning Commission: 1. that the area leased for office use shall not exceed 939 SF and shall be limited in use to 9:00 A.M, to 5:00 P.M., Monday through Friday, with a maximum of two full time and one part time employees; 2. that all parking shall be provided in marked spaces on site, and no staff or visitors shall use the parking on the Hutnick easement; 3. that the joint use of the bathroom facilities shall be satisfactorily worked out with other tenants on the site; and 4. that this use permit shall be amended for any changes in operation, amount of space leased or number of employees and shall be reviewed for compliance with required conditions in one year (July, 1987). Action Alternatives; 1. Council may uphold the Planning Commission's approval of the use permit with conditions. Affirmative action should be by resolution. 2. Council may reverse the Planning Commission action and deny the use permit. Reasons for such action should be clearly stated. 3. Council may deny the request without prejudice. If this alternative is pursued Council should give clear direction about desired changes in the project to the applicant and staff. BACKGROUND• Lisa Rosenthal and Marlene Douglas, representing Peninsula Parent, Inc., a monthly newspaper serving the Daly City to Palo Alto area, are requesting a special permit to locate the newspaper office in a 939 SF classroom at Hoover School, 2220 Summit Drive, zoned R-1 (Code Sec. 25. 56.020). The office would be open five days a week, Monday through Friday, 9:00 A.M, to 5:00 P.M. with two full time and one part time employees. No printing or distribution would be done from this site. The publication is free, has a monthly circulation of about 27,000 copies, and is supported by advertising. -2- In 1980 the city adopted Ordinance 1182 regulating the use of vacant school sites (Code Sec. 25.56). Under this chapter of the code all uses on school sites, other than public education or administration of public education, require a use permit (Code Sec. 25.56.020). The code goes on to describe the things that will be considered in reviewing and granting such a use permit: neighborhood character; access to major streets and public transportation; facilities available to lessee; type of activity, hours of operation, number of regular visitors to the site and number of employees; parking and traffic impacts on adjacent streets; changes to the existing school district facility; possible continued use of the school site facilities by neighborhood children and adults; and any criteria developed by the school district (attached). PlanninQ Commission Action At their meeting of July 14, 1986 the Planning Commission voted 4-1 (Commissioner Graham dissenting) to approve a use permit for office use of a 939 SF area of Hoover School. In their discussion the Commissioners noted: no complaints have been received regarding the existing (two day care centers and a church/bible college) occupants of the school; proposed use only employs two people and one part time, not a problem; not object to organization oriented to children and schools but opposed to commercial endeavor on school site, this appears to be strictly a business; schools need revenue from vacant sites, this use appears to have a minor impact, even though it is a business use in an R-1 zone it has a school connection and a limited number of employees. GUIDELINES FOR LEASING — HOOVER SCHOOL It is the intent of the Burlingame School District Board of Trustees to limit the use of this school premise, when considering prospective lessees, to the following conditions: 1. The applicant's business is compatible with the facility and its neighbor— hood location. Such businesses can include: a. Preferred uses are: a school(s), i.e., private tutbring, pre—school nurserp, art, dancing or theater, religious, adult/college level and a training schooI for industry. b. Acceptable uses are: (1) offices, i.e., non—profit organizations in such categories as Red Cross, American Cancer Society, Crippled Children's Association, Hospice, an answering service, publishing firm. (2) Storage space, such as 'mini storage'. 2. The playground shall be accessible for neighborhood recreational uses and maintained for such utilization. 3. Traffic should be minimal. 4. On street parking is preferred but limited use of the playground for park— ing is acceptable. 5. The hours of use shall be limited to normal daytime business hours and some occasional night usage. 6. Noise from activities at the school site shall be minimal. 9/10/84 P.C. 7/14/86 Item #1 MEMO T0: PLANNING COMMISSION FROM: CITY PLANNER SUBJECT: SPECIAL PERMIT FOR AN OFFICE USE AT HOOVER SCHOOL, 2220 SUMMIT DRIVE, ZONED R-1 Lisa Rosenthal and Marlene Douglas representing Peninsula Parent, Inc., a monthly newspaper serving the Daly City to Palo Alto area, are requesting a special use permit to locate the newspaper office in a 939 SF classroom at Hoover Elementary School, 2220 Summit Drive, zoned R-1 (25.56.020). The office would be open five days a week, Monday through Friday, 9:00 a.m. to 5:00 p.m., with two full-time and one part-time employees. No printing would be done on this site. The newspaper is a monthly publi- cation provided at no charge and with a circulation of about 27,000 copies. Distribu- tion is handled from a partner's home in San Mateo. STAFF REVIEW City staff have reviewed this application. The Chief Building Inspector (June 9, 1986 memo) and Fire Marshal (June 6, 1986 memo) had no comments. The City Engineer (June 9, 1986 memo) notes that the total parking demands for the site need to be reviewed. Planning staff would note that an office use such as proposed would not normally be allowed in an R-1 zone. Home occupation permits, for example, allow only one house- hold employee on site regularly. However, in the passage of Ordinance 1182 on July 7, 1980 (Code Sec. 25.56), it was noted by the City Attorney, "This ordinance will allow any use of rented or leased vacant school property, but will require that such a use shall have a use permit from the City after a noticed hearing." (City Attorney staff memo June 5, 1980.) APPLICANT'S LETTER In their letter of June 12, 1986, the applicants noted that the classroom leased will be used for the office and organizational base for the Peninsula Parent newspaper, a monthly publication. Printing is done in San Jose. Hours of operation would be 9:00 a.m. to 5:00 p.m., Monday through Friday. They would park in the Hoover parking lot. The two full-time employees now bring their pre-school children to the child care center at Hoover School. The applicants also included a copy of a letter they wrote to Dr. Black, Superintendent of Schools, describing their publication's content and the need for additional space so that they could relocate from a home office. QUESTION AT STUDY At their meeting on June 23, 1986, the Planning Commission studied this application and asked a number of questions (Planning Commission minutes June 23, 1986). It is a bit difficult to identify the number of people who are currently parking on the site all day from trips generated to the site. In her memo, the Planner notes that on weekdays there are 90 children in day care centers, plus 10 Bible students on site. Staff for these centers, plus the Chinese Bible Evangel School, take 11 all-day parking spaces. To this would be added 3 from the newspaper office, for a total demand of 14 long-term parking spaces. The YMCA day care facility (accommo- -2- dating 30 children and employing 3 adults) operates between September and June. Most of their children are bused to the site. The use permit for the Hoover children's center does not discuss busing or carpooling; this center serves pre-school children. The use permit does note that there will be no parking on the Hutnick easement, and all parking shall be on site. On-site parking is to be provided on the playing fields, but in such a way that leaves the center open for playground use. Fire lanes are marked on the access to this area to keep people from parking so equipment is blocked from entry. The Hutnick easement is the area where Summit and Easton Drives merge, where parking is striped on the pavement outside of the school site. The applicant told the Planner that the circulation of this monthly newspaper was 27,000. The copies are delivered to someone's home in San Mateo, where four drivers pick them up and deliver them to distribution points. The paper is not delivered door-to-door. The applicant will provide a copy of the publication at the public hearing. PLANNING COMMISSION ACTION The Planning Commission should hold a public hearing. Affirmative action should be taken by Resolution. The reason for any action should be clearly noted. As Burling�ne parents of two young children, we find very appropriate the use of school space for the administrative offices of this parent newsletter. Peninsula Parent provides informative, well-researched articles relevant to children and child'-rearing. It is the only comprehensive source of information on local programs and services for parents and children. The content of the newsletter itself is then surely appropriate in relation to the use of school space. Apparently a question has been raised over the profit-making nature of the newsletter. In this instance, we cannot see how the profit status precludes usage of school space. With only two full time employees, the owners of the paper, this is hardly a large.corporate venture. Profit in this case seems to mean simply that advertising is acce�ted and the revenue from that advertising is used to pay for the cost of publishing the paper. It does not seem unreasonable that people be reimbursed for a service they offer. Further, we feel that much of the advertising itself is a service to parents as many advertisers are small, local businesses with products or services for families and children and which have few outlets for advertising these services. [de had a wonderful birthday party for our four year old through a service advertised only in Peninsula Parent and similarily, we found music and swim lessons for our ehildren through advertisements in Peninsula Parent. This is the only newspaper in which we review the ads as thoroughly as the articles: Articles and advertisements both provide useful information. We thus feel Peninsula Parent is a definite plus in our co�unity, is dixectly related to the concerns of parents and children and is very appropriately seeking space in a surplus school site. We would also like to note that our oldest child is enrolled in an after-school program at Hoover School and we do not in the least feel that that program will be in any way harmed by having the office of Peninsula Parent as a neighbor in the building. The School Board and District Superintendent, in agreeing to lease space to Peninsula Parent, apparently concur with us in this matter, as did the Planning Commission in giving majority approval to the use permit. The August 26, 1985 minutes of the Planning Comnission state the permit was approved with the following conditions: 1. that the conditions of the Fire Marshal's July 19, 1985 memo and the City Engineer's August 8, 1985 memo shall be met; 2. that the daycare facility shall be operated from 7:00 A.M. to 9:30 A.P4. and from 11:00 A.P4. to 6:00 P.M., Monday through Friday, September through June to serve a maximum of 30 children with a staff of three adults; 3. that the majority of the children shall arrive at the site by bus, and carpooling shall be actively encouraged by the YMCA for homebound trips; 4. that the joint use of the playground and bathroom facilities shall be satisfac- torily worked out with the other tenants on the site and the playground facilities will continue to be available to the residents of the adjacent area; and �5. that this use permit shall be reviewed for compliance with all conditions and review of any complaints received in June, 1986. Any site improvements or construction work will require separate application to the Building Department. In review of previous application for this site, I have related concerns as to number of trips generated by this site's usage, especially at peak hours. This application will add some additional demands to the intersection and the roadways. The amount is not at all clear from the application. The exact cumulative demand shou7d be considered to determine if it is acceptable. It may now be above that of original Hoover School usage, although I am not aware of any complaints. The following are conditions wf!ich should 'ue attached to any approvals: 1. As with previous applications, all parking shall be on site or in the designated parking areas. 2. All loading and unloading of children shall be done on site to avoid U-turns and children crossing the street. 3.
