HomeMy WebLinkAbout2220 Summit Drive 2 of 4 - Staff Report� � . � , , � P.C. 9/14/81 Item No. 7 MEMO T0: PLANNING COh4�1ISSI0N FROM: ACTING CITY PLANNER SUBJECT: AMENDMENT OF CONDITIINV OF SPECIAL PERMIT INCREASING RESIDENT STUDENTS AT CHINESE BIBLE EVANGEL, INC., FROM THREE TO FIVE AT HOOVER SCHOOL SITE, 2220 SUMMIT DRIVE On October 15, 1980 the Planning Commission approved a special permit with conditions for the Chinese Bible Evangel, Inc. to use a part of Hoover School for a church and bible school. Condition #3 of this approval indicated that a maximum of three students would be allowed to live on the site. On July 2, 1981, the Planning staff received a request from Pastor Sen Wong of the Chinese Bible Evangel to increase the number of students resident on the site from three to five. In support of this application, James Black of the Burlingame School District wrote a letter dated July 27 indicating that the Board of Education supports the increase in resident students, contingent upon a change in the special permit granted by the City. A memo from the Chief Building Inspector dated September 3, 1981, indicates that four of the original conditions to allow occupancy of three students on the site had not been met at the time of the inspection. Two memos (Augustl8 and 21) from the Fire Marshal indicate that Fire Code violations also existed at the time of inspection (August 21). The Fire Department has expressed concern about the absence of Item #9 (see list attached to Building Inspector's memo). Mr. Sen Wong has contacted the Building Department and resolved some of the problems which he felt were his responsibility (the shower and vent). He indicated to the Chief Building Inspector that the remaining problems (Items 3, 4 and 8) were the responsibility of the School District. The range hood (Item 9) is unresolved since the applicant maintains the improvement is unnecessary since food is not cooked but only heated on the stove. The Building Department feels any use should require the vent. The Fire Department is also concerned about the absence of a hood. Planning staff notes it is not illegal to have students resident on .this site because of the R-1 zoning; however, safe living conditions should be required. In light of the above, if the Planning Commission finds it appropriate to increase resident students to five, the approval should be subject to the following conditions: (1) all code requirements of the Building and Fire Departments be met to the respective department's satisfaction on the site prior to occupancy by the two additional students; and (2) that the residency increase be reviewed with the next six month review (November, 1981) to ensure a continuation of compliance with codes, particularly as they affect the safety and welfare of the resident students and other tenants.
