demand in the area from Rhinette south to a block past
Broadway, west to Chula Vista and east to the city portion
of the CalTrain parking area. There are a total of 222
parking spaces in the total area. At the time of the
counts the lowest vacancy rate was 46� on Friday at noon;
the highest vacancy rate was 76� on Friday at 5:00 pm.
Parking demand is not, however, evenly distributed through
the area. There is little parking available on Rhinette
all the time. The city lots at Rhinette and on the east
side of California are always under used, possibly because
there is a charge for all day parking. Parking is clearly
in high demand on the lower two blocks of Broadway as
well.
The toilets provided in the Goodwill store will be
disabled accessible according to the requirements of the
Uniform Building Code. The applicant told planning staff
that almost all employees come to work by mass transit.
If they drive they are required to park on the street.

CEQA Status: Section 15301 - Existing Facilities, Class 1(d), Restoration or rehabilitation of
deteriorated or damaged structures, facilities, or mechanical equipment to meet current standazds of
public health and safety.
Summary: This site is located at the corner oF Sequoia Avenue and Garden Drive. The site contains a
two-story apartment building with pazking on the ground level. The applicant is requesting a front
setback variance to install a stnxctural wall to support the lower floor of the aparhnent building. The
structural wall would enclose a steel seismic reinforcing brace. The applicant notes that when the
apartment building was constructed lateral reinforcing was not provided. Recent experience has shown
that in the event of a major earthquake, the lower gazage level may collapse causing the two apartment
levels above to collapse as well. The proposed brace would provide the resistance and bracing
necessary to avert such damage.
The proposed shuctural wall would be located perpendicular to Ogden Drive and pazallel to the
driveway to the covered pazking azea. Plauning staff would note that for setback purposes, the frontage
along Garden Drive is considered to be the lot front since it is the shorter street frontage. The bottom
portion of the structural wall would begin at 4'-2" from the front properiy line, angle up to a height of
8'-6" from adjacent grade, and then connect to the existing apartment wall which is setback 18'-0" from
the front property line (the proposed wall would extend a total of 13'-10" from the apartment building
wall). A front setback variance is required (4'-2" proposed where 15'-0" is the minimum required).
The structural wall would be clad with stucco to match the exterior material on the existing apartment
building and painted to match (see building elevations and photographs, date stamped January 24,
2006). The photographs show how the structural will look from several viewpoints. The proposed
brace would not interfere with any pazking spaces or driveway aisles. The Public Works Department
reviewed the request and deternuned that because the wall slopes downwazd towazds the street, the
wall would not affect site lines for vehicles entering and exiting the site. All other zoning code
requirements have been met. The applicant is requesting the following:
• Front setback variance for a structural wall at an existing aparhnent building (4'-2" proposed
where 15'-0" is the minimum required) (C.S. 2532.075, 1, a).

Staff Comments: See attached. Plaz�ning staff would note that since this request is to install a
structural wall to seismically reinforce an existing apartment building, the front setback variance
request was taken directly to the action calendar. If the Commission requires any additional
information before action, this item can be continued or discussed as a regulaz action item. Story poles
will be installed before the action meeting to show the envelope of the proposed structural wall.
Required Findings for Variance: in order to grant a front setback variance the Planning Commission
must find that the following conditions exist on the property (Code Section 25.54.020 a-d):
a) there aze exceptional or extraordinary circumstances or conditions applicable to the property
involved that do not apply generally to property in the same district;
b) the granting of the application is necessary for the preservation and enjoyment of a substantial
property right of the applicant, and to prevent unreasonable property loss or unnecessary
hazdship;
c) the granting of the application will not be detrimental or injurious to properiy or nnprovements
in the vicinity and will not be detrimental to the public health, safety, general welfare or
convenience; and
d) that the use of the property will be compatible with the aesthetics, mass, bulk and chazacter of
existing and potenrial uses of properties in the general vicinity.
Planning Commission Action: The Planning Commission should hold a public hearing. Affirmarive
action should be by resolution and include findings made for the front setback variance. The reasons
for any action should be cleazly stated. At the public hearing the following conditions should be
considered:
1. that the project shall be built as shown on the plans submitted to the Plamiing Department date
stamped January 24, 2006, sheets A0.1, Al, S-1 and S-2, and that any changes to building
materials, exterior finishes, footprint or location of the structural shall require an amendment to
this permit;
2. that the conditions of the Cluef Building Official's January 25, 2006 memo, the City Engineer's
January 27, 2006 memo, the Recycling Specialist's January 30, 2006 memo and the NPDES
Coordinator's January 19, 2006 memo shall be met;
3. that the project shall meet all the requirements of the California Building and Uniform Fire
Codes, 2001 Edition, as amended by the City of Burlingame; and
4. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water
Management and Dischazge Control Ordinance.

This variance is being requested to provide protection for a major steel seismic reinforcing brace
to support the lower floor of this two-story apartment building over a covered garage. At the
time of original construction, such a lateral reinforcing was not provided, and more recent
experience has shown that, in the event of a major earthquake, the lower garage level might
collapse causing the two apartment floors to fall as well. This steel reinforcing brace will provide
the resistance necessary to avert such a disaster. Due to the City requirements for off-street
parking, none of the existing garage spaces could be given up and thus the reinforcing brace
had to be located as shown on the plans. As the photographs show, the new wall enclosure will
have minimal visual effect, and judicious planting would cover much of it. Thus it would have no
effect on neighborhood views and further screen the garage space on the adjacent building.
In light of the beneficial effect for the residents of the building and the adjacent structures, we
would appreciate your approval of this improvement to this structure.

This project is for the safety of the residents and preservation of the building. The added wall height

1) Any construction project in the City, regardless of size, shall comply with the City
NPDES permit requirement to prevent stormwater pollution including but not
limited to ensuring that all contractors implement construction Best Management
Practices (BMPs) and erosion and sediment control measures during ALL phases
of the construction project (including demolition). include appropriate stormwater
BMPs as Project Notes. These BMPs include but are not limited to the following:
• Store, handle, and dispose of construction materials and wastes properly
to prevent contact and contamination of stormwater;
• Control and prevent the discharge of all potential pollutants, including
pavement cutting wastes, paints, concrete, petroleum products, chemicals,
wash water or sediments, and non-stormwater discharges to storm drains
and watercourses;
• Use sediment controls or filtration to remove sediment when dewatering
site and obtain all necessary permits;
• Avoid cleaning, fueling, or maintaining vehicles on-site except in a
designated area where wash water is contained and treated;
• Protect adjacent properties and undisturbed areas from construction
impacts using vegetative buffer strips, sediment barriers or filters, dikes,
mulching, or other measures as appropriate;
• Pertorm clearing and earth moving activities only during dry weather;
• Limit and time application of pesticides and fertilizers to prevent polluted
runoff;
• Limit construction access routes and stabilize designated access points;
• Avoid tracking dirt or other materials off-site; clean off-site paved areas
and sidewalks using dry sweeping method;
• The Contractor shall train and provide instruction to all employees and
subcontractors regarding the construction BMPs.

RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
front setback variance for a structural wall at an existing apartment buildin� at 1830 Sequoia
Avenue, zoned R-3, Georee Williams III Trust, 3190 Clearview Wav #200, San Mateo, CA,
94402, nronertv owner. APN: 025-112-170;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
February 27, 2006, at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this coxnmission, it is hereby found that there is no
substantial evidence that the project set forth above will have a significant effect on the
environment, and categorical exemption, per CEQA Article 19, Section: 15301 - Existing
Facilities, Class 1(d), Restoration or rehabilitation of deteriorated or damaged structures,
facilities, or mechanical equipment to meet current standards of public health and safety,
is hereby approved.

5 additional sets of full size plans (include correct address, 1830 Sequoia Avenue); and
4 additional sets of color photographs.
I will be able to confirm next week whether this project will be reviewed at a Study and Action meeting,

Also aflached are preliminary comments from the Chief Building Official, Fire Marshal, City Engineer,
Recycling Specialist and NPDES Coordinator. These comments can be addressed at time of building
