San Mateo GPP staff have determined that the water quality objectives of the San Francisco Bay Regional Water Quality Control Board have been satisfied. However, an area immediately adjacent to the former excavation to a depth of five feet below the ground surface contains contaminated soil above 120 mg/kg total petroleum hydrocarbons as gasoline. Should any change in use of the property or development of the subject site occur which may impact these soils or groundwater, city building departments must notify the Environmental Health Division for approval pursuant to Government Code Section 65850.2. (800) 327-9337 Government Code Section 65962.5 List of Hazardous Waste and Substance Sites; Submission to California Environment Protection Agency Office of Environmental Information (A) The State Department of Health Services shall compile and update as appropriate; -but at least annually, and shall submit to the Office of Cal/EPA Office of Environmental Information, a list of all of the following: (1) All hazardous waste facilities subject to corrective action pursuant to Section 25187.5 of the Health and Safety Code. (2) All land designated as hazardous waste property or border zone property pursuant to Article 11 (commencing with Section 25220) of Chapter 6.5 of Division 20 of the Health and Safety Code. (3) All information received by the State Department of Health Services pursuant to Section 25242 of the Halth and Safety Code on hazardous waste disposals on public land. (4) All sites listed pursuant to Section 25356 of the Health and Safety Code (5) All sites included in the Abandoned Site Assessment Program. (6) A list of all public drinking water wells which contain detectable levels or organic contaminants and which are subject to water analysis pursuant to Section 4026.2 or 4026.3 of the Health and Safety Code. (B) The State Water Resources Control Board shall compile and update as appropriate, but al least annually, and shall submit to the California Environmental Protection Agency, a list of all of the following: (1) All underground storage tanks for which an unauthorized release report is filed pursuant to Section 25295 of the Health and Safety Code. (2) All solid waste disposal facilities from which there is a migration of hazardous waste and for which California regional water quality control board has notified the State Department of Health Services pursuant to subdivision (e) of Section 13273 of the Water Code. (3) All cease and desist orders issued after January 1, 1986, pursuant to Section 13301 of the Water Code, and all cleanup or abatement orders issued after January 1, 1986, pursuant to Section 13304 of the Water Code, which concern the discharge of wastes which are hazardous materials. (C) The local enforcement agency, as designated pursuant to Section 18051 of Title 14 of the California Administrative Code, shall compile as appropriate, but at least annually, and shall submit to the California Waste Management Board, a list of all solid waste disposal facilities from which there is a known migration of hazardous waste. The California Waste Management Board shall compile the local lists into a statewide list which shall be submitted to the California Environmental Protection Agency and shall be available to any person who requests the information. (D) The California Environmental Protection Agency shall consolidate the information submitted pursuant to this section and distribute it in a timely fashion to each city and county in which sites on the lists are located. (E) Before a local agency accepts as complete an application for any development project which will be used by any person, the applicant shall consult the lists sent to the appropriate city or county and shall submit a signed statement to the local agency indicating whether the project is located on a site which is included on any of the lists compiled pursuant to this section. A fuel pump pad and fill pipe for a former underground storage tank (UST) were observed in the vehicle entrance to the shop area. The UST served by these devices was removed in 1993 from the northeast comer of the showroom area. The supply and vent pipes have been filled with concrete. In addition, a newly repaired concrete area near the hydraulic lift was observed and is the result of the removal of a former 350-gallon oil tank. No other visual or physical evidence of existing USTs or above ground storage tanks (ASTs) was discovered during the on -site investigation. The subject Property has been identified as a LUST site. A 350 gallon waste oil tank was reaxl Ccdon February 22,1993, and an ROO gallon gasoline tank was removedon December 91993.L levels of petroleum hydrocarbons were detected in soil in both excavations. Contaminated soil was subsequently removed and disposed of off -site. A November 9, 1994 letter from the San Mateo County Health Services Agency, Environmental Health Services Division (SMCEHD) to Mr. Joseph Galligan, owner of the subject Property. stated that further investigation and cleanup of soil will not be required due to the removal of the contaminated soil excavated during the removal of the USTs. . However, Desert Petroleum, owners of the BP Gasoline Service Station on the eastern adjoining Property at 1100 Broadway, is muted in this SMCEHD letter as the responsible party for an unauthorized release from their former underground storage tanks. Desert Petroleum currently uses a groundwater extraction system to rernodiate the contamination from their site. Groundwater monitoring wells have been placed on adjoining properties down gradient from the former tank excavations on the subject Property. The SMCEHD states, in the November 9. 1994 letter regarding the subject Property. "By default, their (Desert Petroleum) quarterly reporting includes the minimum data required for your site (subject Property)". The letter continues, stating, "...case closure can not be issued until a ininimttm of fair consecutive quarters of groundwater monitoring are reported below the detection linlit for the required analysis." The NWE Assessor interprets the SMCF,HD statement to imply that the owner of the subject Property is not required to con%rruct monitoring wells or to subunit groundwater analysis reports due to the fact that the placement of groundwater monitoring wells and groundwater samplinglanalysis tequirementq relating to the Desert Petroleum cleanup of the 1100 Broadway site are suffrcient'to provide the data required for the subject Property. In other words, when the 1100 Broadway site attains closure, a final closure for groundwater will be issued to the subject Property. Additionally, SMCEHD states, "In the June 27, 1994 sampling of the groundwater monitoring well down gradient from the former waste oil on (the subject Property), Chromium (Cr) and Tetrachloroethene (PCE) were reported at 430 and 9 ppb respectively. These contaminants are most likely a result from a release front a.waste oil tank. While these levels appear to show that a (serious) threat does not exist in the shallow ground water, this level is still above the California Dtinldng Water Standards.- A copy of this letter is included in the appendix of this report.
