Date: 12.11.02 Ma a t Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION AND PARKING VARIANCES RESOLUTION 121-2002 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for arp king variances for construction of a new three-story mixed use structure with a duplex on Edgehill Drive and an attached sin le-�stOry commercial space on California Drive at 808 Ed�ehill Drive, zoned C-R Mike Jalilie, property owner 1117 Paloma Avenue #3, Burlingame, CA 94010, APN: 029-022-170; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on December 9. 2002, at which time it reviewed and considered the sta.ff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted anci reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19, Section: 15303 - New Construction or conversion of small structures, Class 3(b and c), construction and location of limited numbers of new, small facilities or structures including (b) a duplex or similar multi-family residential structure totaling no more than four dwelling units. In urbanized areas, this exemption applies to apartment, duplexes and similar structures designed for not more than six dwelling units; and including (c) a store, motel, office, restaurant or similar structure not involving the use of significant amounts of hazardous substances...and not exceeding 10,000 SF combined in floor area on sites zoned for such use, is hereby approved. 2. Said parking variances are approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such parking variances are as set forth in the minutes and recording of said meeting. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. CHAIRMAN I, Ralph Osterlin�, Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 9th day of December, 2002 , by the following vote: AYES: COMMISSIONERS: NOES: COMMISSIONERS: Bojues, Osterling, Auran, Keighran, and Vistica NONE ABSENT: COMMISSIONERS: Brownrigg, and Keele � ` s �- 'i � SECRE ARY Z �l � 60¢ I�N� �� Nm �- 00 IN (V N� - CV N m 1� N � �v a N�T � EXHIBIT "A" Conditions of approval for categorical exemption and parking variances. 808 Edgehill Drive effective January 6, 2003 2 3. 4. that the project shall be built as shown on the plans submitted to the Planning Department and date stamped November 15, 2002, sheets A1 though A5, and L-1, and that all landscaping o this site shall be installed and automatically irrigated as shown on sheet L-1, date stamped November 15, 2002; that the four parking spaces provided in the tandem garages front on Edgehill Drive shall only be used by the residential tenants for parking of their vehicles and shall not be used as storage for the residential or commercial tenants; that the applicant shall receive a Tree Removal Permit from the City before removing the existing 14- inch diameter liquid amber street tree on Edgehill Drive, and that a building permit shall not be issued before such a permit is issued; that the City Engineer's August L i, 2002 memo, the Recycling Specialist's October 15, 2002 memo, and the city Arborist's November 4, 2002 memo shall be met; 5. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration project to submit a Waste Reduction Plan and meet recycling requirements; and partial or full demolition of a structure, interior or exterior, shall require a demotion permit; G 7. : that all runoff created during construction and future discharge from the site shall be required to meet National Pollution Discharge Elimination System (NPDES) standards; that the project shall meet all the requirements of the California Building Code and California Fire Code, 1998 edition, as amended by the City of Burlingame; that the curb cut along California Drive shall be eliminated and curb restored to provide on-street parking space; and R' � �a h.N^ �� Nm� 00 �Nm N� o..
