History: At the March 12, 2001 Planning Commission meeting, the Commission voted 6-0-1(Cmrs. Dreiling
abstaining) to approve a design review and side setback variance for a first and second story addition at 2627
Easton Drive. The project is currently under construction. The applicant is requesting a design amendment
in order to change windows along the east elevation.
During the original review of this project it was noted that there was a 5.15' X 150' piece of land located
along the east (left) side of the property that was not a part of the legal lot. The existing east (left) side wall
was determined to be non-conforming, coming within 2'-8'�Z" of the east (left) side property line. The
original proposal included adding bedrooms on the ground floor and changing out windows in part for design
and in part to meet egress requirements for bedrooms. Because of this configuration the Chief Building
Official only allowed replacement of existing windows, but prohibited new windows an increase in the area
of the existing window opening because the east side wall was less than 3 feet from property line.
The applicant recently completed a Quiet Title and gained ownership of a 2'-6" wide by 150' deep portion
of the 5' wide piece of land next to this property. This acquisition caused an adjustment to the location of the
east side property line and increases the left side setback of the existing structure from 2'-8'�Z" to 5'-3". The
need for a side setback variance for the proposed project is now eliminated. The left side wall is now more
than 3 feet from the side property line, which will allow an increase in window area along this side property
line.
The applicant is requesting a design review amendment for the following changes along the left side:
Ground Floor
- enlargement of (2) 2'-6" X 3' bedroom windows to (2) 2'-11" X 3'-11";
- enlargement of 2'-6" X 3' bedroom window to 2'-11" X 3'-11";
- addition of one 2'-5" X 4'-5" bedroom window below existing bay;
Second Floor
enlargement of (3) 1'-6" X 2'-6" kitchen windows to (3) 2'-1" X 2'-11" windows with the
addition of (3) 2'-1" X 1'-5" transom windows above; and
relocation and enlargement of (1) 1'-6" X 2'-6" kitchen nook window to (3) 1'-11" X 3'-5"
windows.

Staff Comments: The Department of Public Works is requiring the applicant to provide a survey by a
licensed land surveyor, and submit an application for a Lot Line Adjustment. See attached memo dated
September 27, 2001. Staff would like to note that because of the nature of this request to amend a project
that currently under construction, it is being brought forward directly to the action calendar.
Design Review Criteria: The criteria for design review as established in Ordinance No. 1591 adopted by the
Council on April 20, 1998 are outlined as follows:
Compatibility of the architectural style with that of the existing character of the neighborhood;
2. Respect for the parking and garage patterns in the neighborhood;
Architectural style and mass and bulk of structure;

4. Interface of the proposed structure with the structures on adjacent properties; and
5. Landscaping and its proportion to mass and bulk of structural components.
Planning Commission Action: The Planning Commission should hold a public hearing. Affumative action should
be made by resolution and should include findings. The reasons for any action should be clearly stated for the
record. At the public hearing the following conditions should be considered:
1. that the project shall be built as shown on the plans submitted to the Planning Depaxtment date stamped
February 14, 2001, Sheets A1.1 through A4.4; except for the revisions documented on the plans date
stamped September 10, 2001 reflecting the following changes: addition of bedroom window below existing
bay and enlargement of existing bedroom windows on ground floor, enlargement of kitchen windows on
second floor and relocation and enlargement of kitchen nook window on second floor;
2. that the conditions of the City Engineer's December 18, 2000, January 11, 2001, February 5, 2001 and
September 27, 2001, and the Chief Building Official's February 5, 2001, and September 12, 2001 memos
shall be met;
3. that any increase to the habitable basement floor area and any changes to the size or envelope of the first or
second floors, which would include expanding the footprint or floor area of the structure, replacing or
relocating window(s), adding a dormer(s), or changing the roof height or pitch, shall be subject to design
review;
4. that doors shall never be added in the master bedroom on the first floor to form a hall between the master
bedroom and the offce and/or door shall never be placed at the entrance to the office area so that two
separate bedrooms are created; and
that the project shall meet all the requirements of the California Building and Fire Codes, 1998 edition, as
amended by the City of Burlingame.

Subject: Conditions for 2627 Easto Dri e
1. A property boundary survey shall be performed by a licensed land surveyor. The survey
shall show all property lines, property corners, easements, topographical features and
utilities. Applicant shall also submit a copy of the latest preliminary title report of the
subject property.
2. Applicant shall submit a Lot Line Adjustment with lot closure calculations and a legal
description of the proposed sewer easements to the Public Works Department - Engineering
Division. Upon approval, applicant shall record the Lot Line Adjustment and the sewer
easements in the County Recorder's Office and provide a copy of the same to the City.
3. The proposed sewer easements and the City's existing right-of-way shall be kept
clear from any obstruction including fences to provide access for maintenance of City
utilities. No permanent structures or fences shall be allowed in these areas.
4. The plans shall show the existing and proposed easements within the subject property. The
proposed easements sha11 be labeled on the plan as sewer easements.
5. No trees shall be planted within the sewer easements and the City's right-of-way.
Applicant shall obtain approval from the Public Works Department - Engineering Division
for any work within these areas.
6. The site and roof drainage shall be designed to drain towards the street frontage.
7. A sanitary sewer lateral test is required for the project in accordance with the City's
standards.

March 12, 2001
Chairman Luzuriaga set the public hearing for the March 26, 2001, action calendar. This item concluded
at 7:25 p.m.

CP Monroe presented a summary of the staff report. Commissioners asked: there is some suggestion of
signage on the plans, want to make sure applicant is aware of the sign code and that their action does not
address signage; application notes that the objective is to provide delivery service for food, could applicant
expand on this, are they providing parking for delivery trucks, if so, where; applicant proposes to provide
cooking classes in the afternoon, can they do that and if so, how many people will be on site; the area of
the restaurant is expanding quite a bit, is the number of employees shown correct; the application states
that there will be 75 people on site at any one time, do we have a study on the number of public parking
spaces available in that area after 5:00 p.m.; provide information on where all the employees of current
business park. There were no further questions and the item was set for action on March 26, 2001
provided all the information can be submitted and reviewed by the Planning Department in time. This item
concluded at 7:30 p.m.

resolution. The motion was seconded by C. Bojues. Chair called for a voice vote on the motion; Item 3a,
2627 Easton Drive passed on a 6-0-1 (C. Dreiling abstaining) and #3b, 164 Pepper Avenue passed 7-0.
Appeal procedures were advised.

CP Monroe briefly presented the project description. C. Dreiling noted that he would abstain from this item
because of a business relationship with the applicant, he stepped down from the dias. Commission asked
that the staff report indicates a total of five bedrooms, but only sees four. Staff noted that the proposed
office off the master bedroom qualifies as a potential bedroom because of the hallway access.
Chairman Luzuriaga opened the public comment. Richard Terrones, CSS Architecture, was present to
answer questions, noted delayed action from last meeting to simplify the application, eliminated the problem
with the egress windows in the basement level, existing windows can be replaced with egress qualified
windows within the same size opening; office is the fi$h bedroom, do not agree with staff determination but
will accept and asked for parking variance, will be difficult to use the office as a bedroom and keep the
privacy for the master bedroom, would like to provide the office as an auxilary space to the bedroom; side
setback variance is to extend an existing nonconforming wall; there is potential mitigation in the future for
the side setback, property owner has applied to transfer 5' wide strip of property along left side property line,
could take up to one year to complete the transfer, this area houses sewer and water lines but was never
deeded to the City. Commission asked the applicant if there is any way to open up the wall in the office by
more than 50% so that it does not qualify as a bedroom, suggested switching the location of the office and
bathroom; the applicant noted that it was considered but that it would complicate the floor plan, would make
the office too open, and the bathroom would have an odd configuration and size.
Commissioners noted: the FAR is being decreased with this remodel, there is an inconsistency in the roof
and floor plans, roof plan shows a new projecting bay along the left side of the house. Applicant agreed and
will revise the roof plan so that it reflects the floor plan. There were no other comments from the floor and
Chairman Luzuriaga closed the public hearing.
Commission noted that this is an excellent project, the side setback variance is warranted since it is only
a 7' extension of an existing wall, there will be no openings in the extension; the parking variance is
moot since one has to walk through the master bedroom to get into the office, only see 4 bedrooms,
someone could convert this office into a bedroom in the future, but that would be illegal. C. Deal moved
to place this item on the consent calendar for the meeting of March 12, 2001. The motion was seconded
by C. Bojues.
Comment on motion: should add condition that doors shall never be added in the master bedroom to form
a hall which would create two separate bedrooms. The maker and second of the motion agreed to the
amendment.
Chairman Luzuriaga called for a voice vote on the amended motion to place this item on the March 12,
2001, consent calendar with the suggested conditions. The motion passed on a voice vote 5-0-1-1 (C.
Dreiling abstaining and C. Keighran absent). The Planning Commission's action is advisory and not
appealable. This item concluded at 9:25 p.m.

We are submittfng this application for minor revisions to the east wall of the previously approved residence at 2627
Easton Drive.
Please recall that this parcel was originally understood to include a 5' easement at the east property line that
generated an adequate setback to allow window modifications at this wall. During the original design review, it was
discovered that the easement did not exist and was, in fact, a parcel that had been dedicated for easement but never
actually recorded. The parcel was not deeded to 2627 Easton.
As a result, our original Design review Application included replacement of these windows, but no change in size or
location was allowed. Additionally, the lower bedroom windows were not allowed to be added.
The owner of 2627 Easton has recently completed a Quiet Title for the parcel and the court has judged that 2'6" of
the parcel is now deeded to 2627 Easton. That judgment is included for reference. -

This judgment now removes the UBC setback restriction and makes modification of the windows Fossible. We are
submitting revised plans showing the windows as originally intended. This revision does not affect Lot Coverage or
FAR in any way. '

RESOLUTION APPROVING CATEGORICAL EXEMPTION AND
DESIGN REVIEW AMENDMENT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for desi
review amendment to change windows along the east side for a first floor and second floor addition at 2627
Easton Drive, zoned R-1, Tricia Godowski, property owners, APN: 027-195-150;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
October 9, 2001, at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that the
project set forth above will have a significant effect on the environment, and categorical exemption, per
CEQA Article 19. Categorically Exempt per Section: 15303 - Class 1-(e) additions to existing structures
provided the addition will not result in an increase of more than 50% of the floor area of the shuctures before
the addition, is hereby approved. �
2. Said design review amendment is approved, subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such design review amendment are as set forth in the minutes and recording of
said meeting.
3. It is further directed that a certified copy of this resolution be recorded in the official records
of the County of San Mateo.

1. that the project shall be built as shown on the plans submitted to the Planning Department
date stamped February 14, 2001, Sheets A1.1 through A4.4; except for the revisions
documented on the plans date stamped September 10, 2001 reflecting the following
changes: addition of bedroom window below existing bay and enlargement of existing
bedroom windows on ground floor, enlargement of kitchen windows on second floor and
relocation and enlargement of kitchen nook window on second floor;
2. that the conditions of the City Engineer's December 18, 2000, January 11, 2001, February
5, 2001 and September 27, 2001, and the Chief Building Ofiicial's February 5, 2001,
and September 12, 2001 memos shall be met;
3. that any increase to the habitable basement floor area and any changes to the size or
envelope of the first or second floors, which would include expanding the footprint or
floor area of the structure, replacing or relocating window(s), adding a dormer(s), or
changing the roof height or pitch, shall be subject to design review;
4. that doors shall never be added in the master bedroom on the first floor to form a hall
between the master bedroom and the of�ce and/or door shall never be placed at the
entrance to the office area so that two separate bedrooms are created; and
5. that the project shall meet all the requirements of the California Building and Fire Codes,
1998 edition, as amended by the City of Burlingame.
