SUBJECT: FENCE EXCEPTION FOR A FENCE WHICH EXCEEDS CODE
REQUIREMENTS FOR HEIGHT AT 2616 EASTON DRIVE
The applicants, Mr. and Mrs. Stevan Olian, are
requesting a fence exception in order to build a
redwood fence along a part of their rear and side lot
line which ranges in height from 8 feet to 10 feet (six
feet allowed). (Code Sec. 25.78.030). The new fence
is needed to replace an existing fence and lattice
structure. The additional height is requested to screen
the applicants' backyard from existing accessory
structures on the adjacent lot and to screen the
backyard from the public easement which is 4.3 feet
higher than the grade of the backyard area.
City staff have reviewed this request. The Fire
Marshal (March 26, 1984 memo) and Chief Building
Inspector (April 16, 1984 memo) have no comments. The
City Engineer (April 2, 1984 memo) notes that a property
line survey may be necessary before getting a building
permit.
In a March 22, 1984 letter the applicants review the
existing conditions on the site including the location
of the fence to be replaced, proximity to existing
structures and variation in grade elevations on site and
in the easement. Because of the grade, the 10 foot
fence on their side is required to achieve a 6 foot
fence on the easement side. They wish to protect their
rear yard from view as well as to block the view of
their neighbor's garage. They indicate they have
discussed the new fence with their neighbors including
the vegetation to be removed. The neighbors, Helen and
Mike Brosman, also signed the March 22, 1984 letter.
To grant a fence exception the Commmission must identify
exceptional circumstances which exist on the prop��r.ty
which make it different from other properties (Code Sec.
25.78.050):
1. that there are exceptional
circumstances;
2. that there is no public hazard;
3. that neighborinu properties will not be
materially damaged; and
4. that the regulations cause unnecessary
hardship upon the petitioner.
The Planning Commission should hold a public hearing.
At the hearing the following condition should be
addressed:
1. that the fence be built as described
in the staff report of May 14, 1984
and plans submitted and date stamped
March 22, 1984.

ENCE EXCEPTION
NOTICE IS HEREBY GIVEN that Monday, the 14th day of May, 1984 , at
the hour of 7:30 P.M., in the City Hall Council Chambers , 501 Primrose Road,
Burlingame, California the Planning Commission of the City of Burlingame will conduct
a public hearing on the application to allow construction of a redwood fence along
a portion of the rear and side lot lines which exceeds code requirements for hei ht;
at 2616 Easton Drive in the R-1 District
