The legal status of your new detached accessory living unit at 2517 Easton Drive, zoned R-1, is subject to the following conditions of approval: that the project shall be built as shown on the plans submitted to tlie Planning Division and date stamped October 22, 2020; prior to submitting for a Building Permit, the plans for the accessory structure must be modified to reflect a second uncovered parking space at the front of the property; and that the owner shall submit a letter to acknowledge they have been informed of California Fish and Wildlife permits for creek area improvements; and that the accessory dwelling unit shali be restricted to no more than 850 SF (for studio/one-bedroom units) or 1,000 SF (for two-bedrooms or more u n its); 2. that prior to issuance of a building permit for the new accessory dwelling unit, an agreement of restriction shall be filed with the County Recorder. The Agreement of Restriction shall state that the accessory dwelling unit shall not be sold separately from any part of the property on which it is located; and that it is restricted to the standards specified in the Accessory Dwelling Unit municipal code provision 25.59; 3. that demolition or removal of the existing structures and any grading or earth moving on the site shall not occur until a building permit has been issued and such site work shall be required to comply with all the regulations of the Bay Area Air Quality Management District; 4. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration projects to submit a Waste Reduction plan and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall require a demolition permit; 5. that the project shall meet all the requirements of the California Buiiding and Uniform Fire Codes, in effect at time of building permit submittal, as amended by the City of �° Register online for the City of Burlingame list serve at www.burlinqame.ora �a DocuSign �nvelope ID: E3294EE2-E837-496B-69D6-238D6E868E5B December 18, 2020 2517 Easton Drive Page 2 Burlingame; and 6. that the accessory dwelling unit permit may be revoked on any one or more of the following grounds: a. The performance standards are not being met; or b. The accessory dwelling unit is no longer used for residential purposes; or c. The parking required is no longer provided; or d. The primary single family dwelling on the site is purposely demolished; or e. For those accessory dwelling units approved with reduced parking because the owner has entered into an agreement for continued affordability of the unit, the agreement between the owner and the city regarding affordability of the accessory dwelling unit has been breached by the owner and covered parking ins not being provided. This approval is valid for one year during which time a building permit must be issued. An extension of up to one year may be considered by the Community Development Director if application is made before the end of the first year. The decision of the Community Development Director is a final administrative decision pursuant to Code of Civil Procedure Section 1094.6. if you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is required pursuant to state orfederai law.
