East�n Drive Burlingam�, CA 9�010 Dear Property Owners, Planning Staff has � eviewed your request for a new accessory dwelling unit and determined that t�e proposed proje�t, which includes a new detached accessory dwelling unit located in the rear yard �f th� property, meets the perFormance standards set forth in Burlingame Municipal Code Chapfer 2�.59 �Accessory Dwelling Units). The legal status of your new detached accessory living unit at 2517 Easton Drive, zoned R-1, is subject to the following conditions of approval: 1. thaf the project shall be built as shown on the plans submitted to the Pfanning Division and date stamped August 6, 2019; prior to submitting for a Building Permit, the plans f�r the accessory structure must be modified to reflect a second uncovered parking space at the front of the property; and that the owner shall submit a letter to acknowledge they have been informed of California Fish and Wiidlife permits for creek area improvements; 2. that prior to issuance of a building permit for the new accessory dwelling unit, an agreement of restriction shall be filed with the County Recarder. The Agreement of R�striction shall state that the accessory dwelling unit shail not be sold separately from any part of the property on which it is located; and that it is restricted to the standards specified in the Accessory Dwelling Unit municipal code provision 25.59; 3.. th�t demoGtion or remova! of the existing structures and any grading or earth moving on the site shall not occur until a building permit has been issued and such site work shall be r�quired to comply with all the regulations of the Bay Area Air Quality Management District; 4. th�t the project shall comply with the Construction and Demolition Debris Recycling Ordinance �nrhich requires affected demolition, new construction and alteration projects to submdt a Waste Reduction plan and meet recycling requirements; any partial or full demolition of a s�ructure, interior or exterior, shall require a demolition permit; 5. that the pr�ject shall meet all the requirements of the Cafifornia Building and Uniform Fi�e Codes, in effect at time of building permit submittal, as amended by the City of Burlingame; and o� Register online for the Gity of Burlingame list serve at www:burlinqame.ora a� a August 15, 2019 2617 Eastan Drive Page 2 6. t�at the accessory dwelling unit permit may be revoked on any one or more of the foliowing grounds: a. The performance standards are not being met; or b. The accessory dwelling unit is no longer used for residentiai purposes; or c. The parking required is no longer provided; or d. The primary single family dwelling on the site is purposely dernolished; or e. For those accessory dwelling units approved with reduced parking because the owner has entered into an agreement for continued affordability of the unit, the agreement between the owner and the city regarding affordability of the accessory dwelling unit has been breached by the owner and cavered parking ins not being provided. This approaal is valid for one year during which time a building permit must be issued. An extension o� up to one year may be considered by the Community Development Director if application is made before the end of the first year. The decisic�n of the Community Development Director is a final administrative decision pursuant to Code of Civid Procedure Section 1094.6. If you wish to challenge the decision in a court of competent gurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is required pursuant to state or federal law.
