The legal status of your new detached accessory living unit at 2301 Easton Drive Avenue, zoned R-1, is subject to the following conditions of approval: that the project shali be built as shown on the plans submitted to the Planning Division and date stamped June 23, 2020; 2. that prior to issuance of a building permit for the new accessory dwelling unit, a deed restriction shall be filed with the County Recorder. The deed restriction shall state that the accessory dwelling unit shall not be sold separately from any part of the property on which it is located; and that it is restricted to the standards specified in the Accessory Dwelling Unit municipal code provision 25.59; 3. that demolition or removal of the existing structures and any grading or earth moving on the site shall nat occur until a building permit has been issued and such site work shall be required to comply with all the regulations of the Bay Area Air Quality Management District; 4. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration projects to submGt a Waste Reduction plan and meet recycling requirements; any partial or fuli demolition of a structure, interior or exterior, shall require a demolition permit; 5. thaf the project shall meet all the requirements of the California Building and Uniform Fire Cades, in effect at time of building permit submittal, as amended by the City of Burdingame; and �� Register online for the City of Burlingame list serve at www.burlinaame.ora � DocuSign EnvelopelD:1998F83B-256A-4F02-B591-DF640B7B8283 n - _ A July 10, 2020 2301 Easton Drive Page 2 6. that the accessory dwelling unit permits may be revoked on any one or more of the following grounds: a. The accessory dwelling unit requirements are not being met; or b. The accessory dwelling unit is no longer used for residentiai purposes; or c. The parking required is no longer provided; or d. The primary singie family dwelling on the site is purposely demolished. This approval is valid for one year during which time a building permit must be issued. An extension of up to one year may be considered by the Community Development Director if applica#ion is made before the end of the first year. The deeision of the Community Development Director fs a final administrative decision pursuant to Code of Civil Procedure Section 1094.6. If you wish to challenge the decision in a court of campetent jurisdiction, you must do so within 90 days of the date of the decision unless a shorter time is !required pursuant to state or federal law.
