The meeting was called to order at 7:40'P.M. James H.
Mitchell presiding; other members present: G.W.Coleman,
Miss rogers,A.J.Rapp,u.Macdonald,Mayor Hunt;_�cting City
Attorney,I.Karmel,Jas Watson,Dr Maoomber,appearing
later.
Regarding the application of Mr E.K.Howe and Mr.E.E.Simpson
requesting permission to construct and operate a gag filling
sattion at Oak Grova -Ivenue and Bayshore Bouvalard,whieh
had a Final Hearing on April 27,but final decision witheld
pending further study. upon telephone request from `d+.R.
Hoag,final decision was held over one month further,which
was agreeable to the mamb=rs of the Commission,as well as,
to Mr Kreis who represented.the petitioners.
Final Hearing was conducted on the Application of mr Clay
Helzel to rezone for business lot T3,block „tb,situate on
the westerly side of Capuohino A.Vanue,near Broadway.
Strong protests, to the petition were voiced by kembers
of the Broadway Development Association on the ground
that there is now sufficient business property available
on Broadway and that any further expansion is not desirable
until such time as the vacant property now on Broadway
is developed.
Lr `.S.1j i1son stated 90 of the Brod-: ),y Property owners
were against rezoning; also that they understood it would
result in taking a store off Broadway.
Mr Neilson expressed his opinion that if Mr Helzel was to
use th4 building for his own business use,no opposition
would have been encountered. Similar expressions were
voiced by Mr Robert Levy and b Mr Harry Parks.
Mr Helzel argued that. to deny his applicatiob would be
an injastioe to him,in as much as the property in question
is now'adjoinigg businessproparty on three sides.
A motion submitted by Chas Macdonild,ssconded by G.W. Coleman
That the application og mr HAlseio rezone the property to
business be denied without pre4udice !d was carried
unanimously : Ayes- Coleman-Rapp-Rogers-litchell-IJa.odonald,
Noes -None.
Mr Helzel intimated that he would seek redress through the
V purts.

The Commission by unanimous vot6 approved the applioation
of Mr Charles Ma,skell requesting a permit to operate
a gas filling station at 951 -bayshore Bouvelaird.
Air Haskellfs applioation was addressed; to the City Gounoil,
who in turn referred same to the Planing Commission
for an opinion.
There being no further business the meeting adjourned
at 8 : 4 5 PM.
