Dear Mr. Kavanagh:
At their meeting of August 3, 1992 the City Council held an appeal
hearing on your application to allow a 14 foot rear setback variance
and a hillside area construction permit to make a deck extension at
2606 Summit Drive, zoned R-1.
Following a public hearing Council approved your application with the
following conditions:
1. that the deck as built shall conform to the plans submitted to the
Planning Department and date stamped July 8, 1992 Sheet C-1 and
June 4, 1992 Sheets SK-1 and SK-2;
2. that the highest point on the new deck shall not exceed elevation
387.70' and that the beams and joists shall be surveyed to confirm
this elevation and the survey accepted by the City Engineer before
the final inspection is called for the decking material is
attached;
3. that the conditions of the Chief Building Inspector's memo of June
8, 1992 (stairs from the house requires a landing at the door; and
the pool requires a safety enclosure approved by the Building
Department) shall be met;
4, that the pump and any other pool equipment located on the property
line shall be enclosed in a soundproof structure; and
5. that the project shall meet all the requirements of the Uniform
Building and Uniform Fire Codes as amended by the City of
Burlingame.
All site improvements and construction wor}c will require separate
application to the Building Department. This approval is valid for one

year during which time a building permit must be issued, One extension
of up to one year may be considered by the Planning Commission if
application is made before.the end of.the first year.

exceptional circumstances in that the rooms are small in this
house; the applicants would have to take too many feet off the ;
add�tion to make the second bedroom useable if it fit into the�'(
decli�ning height envelope; she appreciated the neighbors support
of project; the addition'would not appear too large and �s
compatible with the neighborhood; every application is,unique and
in this c�se she could approve. Councilman Harrison,ragreed; this
four bedroofi house would be only 1,584 square feet ih size,
council has 'seen four bedroom homes over 3,500 squ'�re feet in
size; there is�:no mass or bulk problem, he could^'support approv-
al. Mayor Pagliaro said this is a lovely hou,�e� on a relatively
small lot and the��eclining height envelope�:�as established to
apply to small lots;�the illustration on p�lans is not clear; he
was not concerned about the window as th�re are large trees in
the neighbors yard but �e had a problem' in granting variance to
declining height envelope.� Councilm�n Harrison said council
looked at each request indi�vidualL�, granting this would not set
a precedent. Councilwoman Kr�igh� could not see another way to
add on; she recognized the rear neighbor's complaint about
privacy but she was convince�d"�this was a necessary addition, it
stayed within the tudor st.y�le and�he window was no impact.

Councilman Harrison mo�ced to grant ��e variances. Reluctantly
seconded by Councilwoman Knight. The`�notion failed 1-3 on roll
call vote, Council n Harrison the onlyw•�aye vote. Councilman
Harrison then mov�e�to deny the project w�thout prejudice.
Seconded by Cou cilwoman O'Mahony. After eonsiderable further
review of the,�awings council directed the � plicants to improve
the drawings+,and provide working blueprints shb.�ing comparisons
and altern�tives for the declining height envelo variance.
Councilma� Harrison changed his motion and moved t uphold the
approva �of the side setback variance and to deny wi out preju-
dice e declining height variance and to allow the app 'cants to
retu to council for reconsideration of the declining hei-ght
ex�eption when they had full plans and studies of alternatives to
tL�'e declining height envelope variance. Seconded by Council-
�oman o�Mahony. The motion carried 4-0 on roll call vote.

City Planner's memo of July 23 recommended council hold public
hearing and take action. The administrator of the estate of
William Walker and Kavanaugh Engineering are requesting a permit
to build a 354 square foot addition to a 125 square foot existing
deck two to thirteen feet above grade in the rear yard of the
house at 2606 Summit Drive. The existing deck and the proposed
new deck both extend into the rear setback one foot from the
property line (15 foot setback required). The Planning Commis-
sion denied the reguest without prejudice at its meeting of July
13; they directed the applicant to discuss project with neighbor
and resubmit design but the applicant decided to appeal to
council. In response to Councilwoman O'Mahony, City Planner
explained the slope of the lot under the deck and height of the
structure.
Mayor Pagliaro opened the public hearing.
John Goldberg, estate administrator, asked council to waive the
requirement to rebuild the step, since they were not changing it
they should not have to change it, there is another landing at
the patio; the house will not sell as a family home in its
present condition, it has very small steep yard area. Council-
woman Knight asked if he had attempted to contact the neighbor to
the rear; Goldberg had attempted but never reached the neighbor
to the rear; he sent copies of the plans to all neighbors and
discussed the project with others. Councilwoman Knight was
concerned about the concrete around the pool, would it be re-
placed; Goldberg said yes, there is a drainage problem and a new
drain system will be installed.

Charles Kavanaugh, engineer, reviewed the survey and design;
Councilwoman O'Mahony was concerned about the stability of the 13
piers and asked if there could be a retaining wall; Kavanaugh
explained the piers would be placed in firm soil and the founda-
tion posts strengthened with 2/8 inch cable bracing which would
be stronger and less visible than timber cross beams, no retain-
ing wall was planned. Mayor Pagliaro noted the cable was not
shown on plans, he also asked how deep the piers would be into
soil; Kavanaugh shared working drawings which included the
cables, piers would be minimum of one foot deep; they are working
with a soils engineer who will approve the final design.
Charles Mahnken, 2614 Summit, neighbor to west of property; said
he reviewed plans and the visual impact would be small; he
approved of the project. John Moran, 2616 Summit, said'the deck
would have no impact on his property; this is a view house on a
view lot without a view because of trees, the deck will allow the
owner to regain the view; he requested approval.
Leo Jacopi, 2600 summit, was opposed to having a structure one
foot from his property line; his parcel is very large but the
only level area if he ever subdivided is below the applicant's
property; he was concerned about earthquakes and land movement,
feared people Palling off the deck; this would be a huge high
structure and would be an eyesore to those who lived across the
canyon. Council asked if he had discussed the project with the
applicants; he responded he has been on vacation and just re-
turned; he was not interested in selling any portion of his land.
Council noted there was debris on Jacopi's property which could
be a fire danger; Jacopi said the debris has been cleared recent-
ly; council asked if he would trim his trees to improve views, he
said trimming in past has damaged the trees; council asked about
a satellite antenna dish in his front yard; Jacopi said it was
installed 12 years ago.
Alan Horn, 1325 Paloma,.spoke in opposition to a variance.
Mayor Pagliaro closed the public hearing; he expressed concern
about the trees blocking views, but council does not dictate tree
trimming; he could not see how the deck would have any effect on
Sacopi. Councilwoman Knight said viewing parcel map shoc�s the
odd narrow shape and relatively small size of this lot as com-
pared to neighbors; she couldn't envision a family living there;
she was reassured.the applicants would repair cement and improve
the deck; the neighbors affected are not concerned and Jacopi
cannot see the deck; the owner should be able to enjoy a yard.
Councilwoman O'Mahony agreed, the property really needs help and
the variance is needed; she would like to see the piers substan-
tially buried; she moved for approval of the variance with
conditions by adoption of RESOLUTION 67-92. Seconded by Council-
man Harrison, carried unanimously by roll call vote.
