Dear Mr. Glynn:
Since there was no appeal or suspension by the City Council of Planning
Commission action at their August 22, 1977 meeting, the condominium permit for
the Bellevue Condominiums in an R-4 District at 1210 Bellevue•Avenue became
effective September 7, 1977.
This condominium permit was approved unanimously by the Planning Commission
°to be built in conformance with the plans dated 17 August, 1977 and the
stipu7ations submitted in F�rchitect Woodson's letter dated 17 August, 1977."

This tentative and final parcel map was approved unanimously by the Planning
Commission on June 27, 1977. The action involved a simple abandonment of an
existing lot line to combine two existing parcels into one which would enable
the construction of one residential building.

CE Kirkup advised some conditions of tentative map approval have not been completed.
Staff recorrenended approval with a$12,000 guarantee until this work is completed.
Reference ACE's memo of 2/22/79. Lou Arata, representing the applicants, was present.
Chm. Jacobs opened the public hearing. There wer.e no comments and the public hearing
was closed. '
C. Mink moved for approval of this final subdivision map with the stipulation that
a$12,000 quarantee be provided to the City until the satisfactory completion of
ihe following: (1) sidewalk and driveway anproaches; (2) flood protection, including
earth landscaping fill and driveway reconstruction; and (3) complete landscape
planting. Szcond C. Cistulli and approved 7-0 on roll call vote.
OTHER BUSINESS
8. SITE DEVELOPMEMT PERMITS FOR ANZA AREA: PROGRESS REPQRT, FEBRUARY 14, 1978
ACP Yost discussed the Anza Area progress reports, noting Plan 4 had been chosen
by City Council with certain modifications. This third report sets out a`ramework
for implementation and will be discussed by Council March 14, 1979.

C. Taylor reported on the subjects discussed at this recent meeting.
CITY PLANNER REPORT
Staff reported City Council approved the appeal of Commission's denial of 24 hour
operation, 7-11 Store, 975 Rollins Road, subject to review in six months. Plannirrg
Commission approval of special permit for the Crown Coffee Shop, 875 Mahler Road was
sustained.

Re: Condo P. M. 77-25 - 1210 Bellevue Ave.
This condominium map conforms with the approved Tentative Map. There are
some construction details that remain to be done that are conditions of
Tentative Map approval. These include satisfactory completion of the
follovding:
1. Sidewalk and driveway approaches.
2. Flood protect�on, including earth landscaping fill and driveway
reconstruction.
3. Complete landscape planting.
I suggest a recommendation to the City Council for approval of this Map
provided a$12,000 guarantee is first provided to the City to be held
until completion of the remaining approval conditions are satisfactory to
the City Park Director and the City Engineer.

REGARDING 7-ELEVEN STORE AT 975 ROLLINS ROAD
A memo from the City Attorney advised that the 7:00 A.M: to 11:00 P.M. hours of this
store were an implied condition of the use variance granted June 26, 1967; this memo
was discussed by Commission and David Carry attorney representing Southland Corporation.
It�was noted that complaints have been received regarding the present 24 hour o�eration
of this store. Attorney Carr`s contention was that the 1967 variance was granted on
the use, that as long as the store is operated as a conrrnercial use the variance is �
valid and that no specific limitations on operating hours were imposed by the City.
The Ci.ty Attorney's opinion was that the s�a�ement of the property owner filed with
the applica�ion in 1967 specif-ically identified the store hours to be from 7:00 A.M.
io 11:00 P.M. and was an implied condition in the gran�in� of this variance.
During discussion, two members of �he Commission noted they had been on the Commission
at the time of the 1967 variance approval and they concurred with staff's interpretation
concerning the h�urs of operation. Coir�nissioner Taylor moved'to sustain staff's
position that the hours of oaeration for this store are limited to 7:00 A.M. to 11:00 P.M.s
sEcond Commissioner Sine and�aoproved 5-0 on roll call vote, Commissioners Francard and
K;ndig absent. Mr. Carr was advised of his r�ght of appeal to City Counc77.
3. REQUEST FOR EXTENSION OF CONDITION TO SPECIAL PERMIT APPROVED SEPTEMBER 28, 1977
BY AMERICAR REfdTAL SYSTEM AT 1530 GILBRETH ROAD
Assistant City Planner Yost reviewed Commission approval of September 28, 1977
special permit with condiiions and the amendment of February 15, 1978 requesting
the requirement of a wash rack be deferred. The applicant is now requesting a further
deferment since the size of his f7ee� is stil7 less than one-third the 38 cars approved
under the 1977 permit and presently all vehicles are being gassed and washed elsewhere
at approved locations.
Commissioner Taylor moved for approval of an extension of condition to special permit
aoproved September 28, 1977 that a wash rack should be installed which will recycle
N�ater, this extension to expire September, 1979 or when the rental fleet reaches 38
cars, whichever occurs first. Second Cor,�nissioner Mink (wiih the understanding that
washing wi11 not be done at this site in the interim). Motion approved 4-1,
Commissioner Sine dissenting, Commissioners Francard and Kindig absent.
�4. REQUEST FOR EXTENSION OF TENTATIVE SUBDIVISION MAP, BELLEVUE CONDOMINIUMS,
1210 BELLEVUE AVENUE BY LOUIS ARATA
This extension was requested since the City requires condomin�um units be measured
as built, ihe building is still under construction and it is no� possible �or the
surveyor to prepare a final subdivision maa before the earlier approval of the
ientative map has expired. City Engineer recommended approval.
Commissioner Mink moved for approval of a 12 month extension of tentative subdivision
map 4vith the condition that there be no habitation on the subject property until the
final map has been filed and approved. Second Commissioner Taylor and approved 5-0,
Conimissioners Francard and Kindig absent.
Consideration of Item #5, Drafi Housing Flement, was dei'erred until after the
study items.

A regular meeting of the Planning Commission, City of Burlingame was called to order
by CF�airman Jacobs at 7:37 P.P�. `

Absent: Commissioners Francard (excused), Kindig (necessarily absent)

NiINUTES
The minutes of the September 25, 1978 meeting were approved with the follow�ing
correction: on page 3, item #,5, second paragraph, last line, change 1978 to "1979".
APPROVAL OF AGENDA
Commissioner Sine moved for approval of the order of the agenda.
MEETING ITEMS FOR ACTION
l. VARIANCE TO ENLARGE AND ENCLOSE AN EXISTING PORGH A'f 934 PALOMA AVENUE BY
ALINE BIER
Assistani City Planner Yost reviewed this application to enclose an existing porch on
a house with.substandard rear yard and side yards. He referenced his staff report,
applicant's affidavit -For variance, site plan and Fire Inspector`s memo of September 27,
I978. Staff recommended approval.
Commission concerns were expressed about whether the legal requirements for granting
this variance had been met, the recent improvements had been done.without a building
permit by unlicensed contractor, and the fact that the one hour fire wall requirement
of the Buildinq Code was rrot sa-cisfied. The publ�c hearing was opened; there were
no commenis from the audience. Commissioner Taylor read a communicai:ion from Alex
Girillovitch, Corpus Christi, Texas (oti�ner of nearby property) advising he had no
objection to this application. The public hearing was then closed.
Commissioner Cistulli moved for approval of this application, second Commissioner Sire.
City Attorney advised that four vates would be necessary for this motion to pass.
Upon roll ca11 vote, the motion was defeated on�a 3-2 vo�e, Commissioners Mink and
7aylor dissenting, Commi�sioners Francard and Kindig abs�nt.
After further discussion, Commissioner Mink moved this application be denied without
prejudice. Second Commissioner Taylor and approved 4--1, Gommissioner Cistulli
dissenting, Commissicners i=t•ancard arid Kindig absent. The applicant was advised
of ner right of app�al. .
