Dear Mr. Glynn:
Since there was no appeal or suspension by the City Council of the Planning
Commission action at their October 26, 1977 meeting; the special permit to
construct a building that exceeds 35 feet in height, a 25-unit condominium
at 1210 Bel7evue Avenue, in the R-4 District became effective November 8, 1977:
This special permit was approved unanimously by the Planning Commission.
Any site improvements or construction work will require separate application
to ihe BuiTding Department.

Subject: 1210 Bellevue Condominiums
Commissioners:
We are requesting a Special Permit to allow a building
height in excess of 35' for the subject project at this
time because we were unaware, at the time the Condominium
Perm'it was issued, that our project did noi- conform urith
this requiremen�. We had the ir_correct impression that
the Lot Grade �aas measured at the building 1.�_r_e, rather
than at the property line.
vJe are prevented from depressing the building into the
ground any further, because the garage ramp slope would
become too steep.
The project is no different than when we originally sub-
mitted it, and we would have asked for this permit at
that time had we been a��are of this_nonconforming item.

Respondinr to �1r. Sine's ques�:ions regardinc� a statement about dirt mounds covering
the parking, I�fr. 4Joodson er,plained that the grade slopes evenly from the back o�
the sidel-ralk up �:o the face of the building, providing an on-grade Wd1l;way or steps
follo��ing the contour up to the building. The driveway, he stated, is circular
because of the narro4r space betv�een the eucalypi;us trees. He noted there v�ould be
little mounds with landscaping on the slope; no trees would be removed.
C. Jacobs movcd the special permit be granted, noting the trees and the location>
i.e., the creek and �rater table levels and the ingress and egress saiety. C. Mink
seconded the motion and it carried unanimously upon a roll call vote (7-0).
It Uras noted that this item could be appealed to the Council; however, if not
appealed, it S�rould be effective I�ovember 8, 1977.

Chm. Taylor read the item. C. P. Savan stuted that this item has basically ti�e
same circumstances as Item �6.except there are no eucalyptus t��2es, and noted that
the condominium permit plans satisfied zoning re;ulations and cla;med the buildirg
would be 35 feet in height. Upon review of canstruciion plans the projeci:�,�as
found�to be more than 35 feet in height. He reemnhasized tnat 55 feet is alloti�r<�d
in R-3. (Ed. 75 feet is allo�ved in R-4.) He also noted that lo;:eri�,g of the
building l��ould cause difficult entry to the lower level parl:ing�and ine ramp to
the upper level would have a flatter yrade. He stated that the d�si�n being
considered is the best one for the s�te and recommended app•roval of the special permit.
Responding to C. Jacobs' request for further explanation of the problem ���itt� the
driveti��ays, Mr. Woodson explaine.d that the problem t,ras mainly ��rith the slope of the
driveway and he also irentioned a condition for flood cortrol on Bellevue Avenue
which ti�ras placed on the condominium permit. Ne staied that in order co comply v�ith
that condit�on the ground h�as been sloped up 6 inches higher than the back of the
sidewalk ��rhich causes a loss in the length of the driveway, making the slope more
severe. The design, he continued, was felt �:o be the most desirable in that the
driveway is easier t� negotiate and safer. Chm. Taylor opened the public hearinq.
There being no one 4vishing to speak and no correspondence, ihe public hearing �,�as
closed.
C. Sine moved that the special permit be granted, noting the facts presented during
staff rev�ew. C. Cistulli seconded the motion and it carried unaniinously (7-0)
upon a roll call vote. It ti�ras noted that the decision of the Con�mission would be
effective November 8, 1977 unless appealed to the City Council. C. Kindig requested
that staff ta�e necessary stcps io see that such misunderstandings do not occur again.
Mr. Woodson apoloqi�ed for i:akinc� un the Commission`s time, emphasizing again �;hat
it was not �n intentional mistake.
Commission had a brief discussion about landscaping and some �;ype of assurance to
the City that landscaping would �e installed as presented ard bond posted. It ��,�as
decided that this is a just concern and soi>>ething to discuss at a future study
meeting. �
