S. SPECIAL PERMIT FOR RETAIL SALES AND REPAIRS OF BOAT�, BOAT
PARTS AND SUPPLIES AT 405 BEACH ROAD, ZONED M-1
Reference staff report, 9/12/88, with attachments. CP Monroe
reviewed details of the request, staff review, applicant�s letter,
property owner's letter in support, study meeting questions. Four
conditions were suggested for consideration at the public hearing.
Chm. Jacobs opened the public hearing. John Sofilos, Unlimited
Marine, applicant was-present. He submitted a letter (9/9/88) from
the property owner (Golden Gate Drywall) stating they were in the
process of resurfacing and striping the parking area, this should
be completed this month. Applicant comments:' there is an access
easement in back, 100' wide, 20' allocated to Fire Department; they
have side and front access also; he contacts customers at boat
shows but the contract is always finalized in Burlingame, tax goes
to Burlingame. A letter (9/11/88) was submitted from Howard
Hickey, 390 Lang Road, in support of the application. There were
no audience comments and the public hearing was closed.
With the statement this is a good use for this area, C. H.Graham
moved for approval of the special permit and for adoption of
Commission Resolution Approving Special Permit with the following
conditions: (1) that the business shall operate with a maximum of
two full time and two part time employees, 9:00 A.M. to 5:00 P.M.
Monday - Friday and 10:00 A.M. to 4:00 P.M. Saturdays with
occasional Sunday hours; (2) that a maximum of 10 boats shall be
kept on the property for servicing with an additional five boats
for sale; (3) that all employees shall park in the yard area; with
five parking spaces to be marked in the yard area and used either
for employee or customer parking; and (4) that the project comply
�with the conditions of the Chief Building Inspectar's August 15,
1988 memo, the Fire Marshal's August 22, 1988 memo and the City
Engineer�s August 31, 1988 memo.
Motion was secondsd by C. S.Graham and approved on a 6-0 roll call
vote, C. Garcia absent. Appeal procedures were advised.

John Sofilos is requesting a Special Permit for retail sales and
repairs of boats, boat parts and supplies from 405 Beach F2oad,
zoned M-1 (Code Section 25.42.030-g). The applicant is proposing
to use a 6,127 SF warehouse area for the operation of this
business. The business would operate Monday through Friday from
9:00 AM to 5:00 PM, Saturdays from 10:00 AM to 4:00 PM, with
occasional Sunday hours. There would be a maximum of two full
time and two part-time employees on the site. A maximum of 10
boats would be kept on the property for servicing with an
additional 4-5 boats for sale.
Staff Review
City staff have reviewed this request. The Chief Building
Inspector (August 15, 1988 memo) notes that the proposed use
would require a one-hour wall separation between the two tenant
spaces. The Fire Marshal (August 22, 1988 memo) also notes that
a one-hour wall separation will be required between this business
and the dry wall business next door. The City Engineer (August
31, 1988 memo) notes that as long as there is sufficient parking
on the site, the proposed use seems suitable for the area. He
suggests that should the project be approved, conditions be
added requiring an industrial waste permit; no repair of boats
outside of the building; oil absorbant pads to be placed and
maintained in all on-site storm drainage systems; and all parking
to be clearly marked.
Applicant�s Letter
In his letter of August 3, 1988 Mr. Sofilos explains that the
proposed property is ideal for a boat sales and service business.
due to its location near the tidal waters of the Bayfront Channel
and Lagoon as well as the large fenced in yard area. He notes
that this site is adjacent to the property at 390 Lang Road,
which was approved by the Planning Commission for the retail sale
and repair of boats in 1977. Mr. Sofilos explains that the site
consists of 4,600 SF of storage and service area, 837 SF of
display area, 690 SF of office space and a 9,000 SF fenced in
paved yard area. There are 8 parking spaces in front of the
building and the employees would park in the yard area.
A letter has also been submitted by D.M. Medeiros, president of
Golden Gate Drywall, property owner, in support of Mr. Sofilos
application.
Study Ouestions
The Planning Commission reviewed this request at their study
meeting on August 22, 1988 and asked several questions (Planning
Commission minutes August 22, 1988). The business at 390 Lang
Road was granted a Special Permit in 1977 for the sale and

service of boats at retail in the M-1 zoning district. Mr.
Sofilos, in a phone conversation (Planner memo, August 25, 1988),
noted that the property at 405 Beach Road would allow him to
consolidate his business which currently operates from locations
in South San Francisco and San Bruno. He has been in business
since 1957, has an established clientele, and does not expect his
business to grow over the next few years in terms of customers or
employees. Mr. Sofilos also expained that most of the boats are
sold at boat shows, therefore his customers are presold before
they come to the site. Customers would simply come to the site to
pick-up their boats.
Mr. Sofilos explained that the closest launch ramp in the area is
at Coyote Point. The boat hull currently on the property at 405
Beach Road is located in the driveway and will be moved to the
rear of the property once the business opens. The Fire Marshal
has noted that this boat hull, if moved to the rear of the
property, does not pose a fire hazard. The City Engineer has
explained that since there will be no washing of boats on the
site, no drain catches are required.
There is a gate in the chain link fence on this property ancl the
site is accessible from the rear. The applicant plans to use this
rear exit to get boats in and out. Plans submitted dated August
26, 1988 show a 20' wide non-exclusive access easement at the
rear of the property, which would allow access of the site from
the rear.
The applicant has submitted a revised site plan (dated August 30,
1988) which shows 5 parking spaces to be marked in the yard area.
In addition there are 7 parking spaces in front of the site for a
total of 12 parking spaces. Based on the square footage of the
area being used, a total of 9 parking spaces are required for
this use.
PlanninQ Commission Action
The Planning Commission should hold a public hearing.
Affirmative action should be taken by resolution. The reasons
for any action should be clearly stated. The following
conditions should be considered at the public hearing:
1. that the business shall operate with a maximum of 2 full time
and 2 part time employees, 9:00 AM to 5:00 PM Monday - Friday
and 10:00 AM to 4:00 PM Saturdays with occassional Sunday
hours;
2. that a maximum of 10 boats shall be kept on the property for
servicing with an additional 5 boats for sale;
3. that all employees shall park in the yard area; with 5
parking spaces to be marked in the yard area and used either
for employee or customer parking; and
4. that the project comply with the conditions of the Chief

I am hereby requesting a Special Permit to allow the establishment of a boat
related retail sales use at 405 Beach Road, Burlingame, which is currently
zoned M-1.
The property location is ideal for a boat sales and service business due to it
being located be the_tidal waters of the Bay Front Channel and Lagoon. The
Bayshore Freeway borders the parcel to the South and should provide good visual
business exposure. The existing building, warehouse and fenced blacktopped
area are ideal for the requested use.
I have discussed the situation with Mr. Howard G. Hickey who owns the property
immediately adjacent to 405 Beach Road. Mr. Hickey is also in the Boat & Marine
business and it is my understanding that he.acquired a Special Permit in October
1977 for the retail sales, repair and storage of boats, motors, trailers and
related parts, equipment and supplies.
The existing one story building has approx. 4,600 sq. ft. of warehouse and
storage service area. As well as approx. 837 sq. ft. for display and 690 sq. ft.
for offices. 9,000 sq. ft. of yard and entrance for service, storage and repair
of boats and equipment. Parking consists of eight stalls on Beach Road and
parking will be used in the yard area for employees. At present only one or two
part time employees are required. Gross area is 15,127 sq. ft. plus parking
area on Beach Road of 1,300 sq. ft.
In view of the above, I believe the property is, in all respects, suited for
this type of business. "

SUBJECT: 405 Beach Road - Study Meeting Questions
DATE: August 25, 1988
I spoke with Mr. John Sofilos regarding the Planning Commission
questions at the study meeting on August 22nd. Mr. Sofilos
commented that he has been in business since 1957, operating from
locations in South San Francisco and San Bruno. He does not
expect that his business will grow over the next few years in
terms of customers or employees, he is more interested in
consolidating his business in one location. His customers are
generally pre-sold before they come to the site. Boats are
demonstrated and sold at boat shows, and the customers only go to
the site to pick up the boats. Over the years he has
established a clientele, and therefore he does not expect much
more growth of the business in the future.
Mr. Sofilos explained that the closest launch ramp in the area is
at Coyote Point. The boat hull which is currently on the
property at 405 Beach Road is located on the driveway and will be
moved to the back of the property when the business opens up. The
Fire Marshal has noted that this boat hull does not pose a fire
hazard on the property. The City Engineer has noted that there
are no drain catches required since the applicant does not
indicate that there will be any washing of boats on the site.
There is a gate in the chain link fence and the site is
accessible from the rear. This rear exit will be used to get
boats in and out of the property. Plans submitted dated August
26, 1988 show a 20' wide non-exclusive access easement at the
rear of the property. The property to the rear of 405 Beach Road,
which consists of 390 Lang Road, received a Special Permit in
1977 for the sale and service of boats at retail in the M-1
zoning district.
