Summary: The applicant, Glenborough Partners, applied to the Public Works Department for a lot line
adjustment which will result in the creation oftwo reconfigured parcels: a separate 18,000 SF parcel at 350
Beach Road, and a larger parcel (15.82 Acres) at 301 Airport Boulevard. The applicant is requesting that
the new 18,000 SF parcel at 350 Beach Road be rezoned from C-4 to O-M.
In August of 2000, the City Council approved an office project on the whole site. As a part of that
proposal, the portion of the site fronting on Beach Road was proposed to be developed as a day care center.
The conditions of approval for that project required that a separate parcel be created for the day care center
site, and that the new parcel be rezoned from C-4 to O-M to match the zoning of the surrounding parcels on
Beach Road. Althou;h approval for the office pro�ect expired in August, 2002, the applicant has chosento
follow through on creating the separate parcel on Beach Road. The Planning Department required that the
applicant request rezoning of the smaller parcel at the same time as the lot line adjustment application is
processed.
General Plan and Specific Area Plan: Both the Burlingame General Plan and the Bayfront Specific Area
Plan designate this property and the surrounding properties on Beach Road for office uses. The C-4 and the
O-M zone districts are both consistent with this plan designation. The C-4, Waterfront Commercial zone
district was created to apply to land uses and site c�evelopment which will benefit from their proximity to the
open water areas of the San Francisco Bay and will be beneficial to the public use of this irreplaceable
natural resource. The O-M, Office/Manufacturing district, was created as an office/light industrial park area
which will serve as a transition between the C-� Waterfront Commercial and the M-1 Light Industrial
District. In its uses, the O-M District is consistent with the intent of the General Plan to provide
professional and administrative offices, distribution, service, light industrial and other uses supported by
access to San Francisco International Airport and the adjacent hotel, restaurant and other bayfront
commercial activ4ties.
Rezoning fram C-4 to O-M 350 Beach Roa�l
Sinc� the new parcel will not be directly adjacent to the bay, it is more appropriately placed in the O-M zone
dist�ict. In addition, it will be subject to the same use requirements and property development standards
(setbacks, height, lot coverage) as the O-M zoned properties which surround it on Beach Road.
If true new parcel were to remain zoned C-4, developme�t under the C-4 regulations would be inconsistent
witl� the pattern of the e�sting O-M zoned properties i� the area, since it would be the only parcel on the
block zon�d �C-4. It should also be noted that the creatiom of the new parcel on Beach Road would preclude
the 15.82 acre parcel from gaining access froyn Beach Road. This will help minimize the future traffic
i�mpacts from development of the larger site to the businesses on Beach Road.
Staff' Comments: The Chief Building Inspector, the Fire Marshal and the City Engineer had no comments
on this project.
Study Meeting: At the September 23, 2002 Planning C�mmission study meeting, the Comrnissioners asked
if t�e rez�ning will still allow a day care center on the site. Planning staff would note that the day care
center would require a conditional use permit in the �-M zone district for "a commercial use similar in
natuire to one for which a permit is required" in the O-1l�I or any other district (C. S. 25.43.030 (17). A day
car� center would also require a conditional use permit on the same basis in the C-4 zone district.
The Commgssion also asked if the parking requirement is different for a daycare center in C-4 as opposed to
O-M zoraing. Staffwould note that parking requirements are generally determined by use, not by the zone,
so t'he reclubrements would be the same in either district. The O-M district does have a provision that for
cl�ss or school use, the parking requirement is one space for each 300 SF of gross floor area, where the
ge�eral requirement for a school use is one space for �ach 50 SF of classroom area.
The Commission asked if this proposal would be considered spot zoning. Since the zoning of this parcel
would be the same as the parcels which surround it on lBeach Road, and since the zoning is consistent with
the General Plan and Specific Area Plan designations, it would not be considered spot zomng.
Fimdings for a Rezoning:
Ir� acting o� the request to rezone the property from C-4 to O-M, the Planning Commission should state the
reasons why they feel such action is appropriate and �consistent with the intent of the zoning ordinance.
Gade Sectian 25.04.010 states that the zoning ordinamce is established for the following purposes:
■ to promote public health, safety and welfare;
■,preserve a wholesome serviceable and attractive community which increase the safety and security
of home life;
■ promote harmonious character and economy among property, building construction and civic
services;
■ establish regulations to limit the location, uses, height, bulk, occupancy, lot coverage, street setback,
yard sizes and occupancy of building structu�-es and land;
■ er�courage remodeling of e�sting residential structures;
■ preserve residential neighborhood character af single family structures and accessory structures and
■ provide for the best general civic use to protect the common rights and interests of all.

Planning Commission Action:
It is recommended that the i'lanning Commission approve the attached lot line adjustment with
the following conditions:
1. The lot-line adjustment sha11 be recorded and a copy of the record shall be sent to the City.
2. The development of the new lot will be under design review by the Planning Commission
including the effects of site development, proposed paving, irrigation and storm drainage.

This application is requesting to remove an existing lot line and to add a new lot line among two
existing parcels. This lot line adjustment will result in two parcels. The purpose of this lot line
adjustment is to create a new lot, separate from the overall parcel, on Beach Road. A parcel map
is not required for the removal and addition of these lot lines.
The current Subdivision Map Act Section 66412 Map Act Exclusions (d) states:
"A lot line adjustment between two or more existing adjacent parcels, where the land talcen
from one parcel is added to an adjacent parcel, and where a greater number of parcels than
originally existed is not thereby created, provided the lot line adjustment is approved by the
local agency, or advisory agency. A local agency or advisory agency shall limit its review and
approval to a determination of whether or not the parcels resulting from the lot line adjustment
will conform to local zoning and building ordinances. An advisory agency or local agency
shall not impose conditions or exactions on its approval of a lot line adjustment except to
conform to local zoning and building ordinances, to require the prepayment of real property
fees prior to the approval of the lot-line adjustment, or to facilitate the relocation of existing
utilities, infrastructure, or easements. No tentative map, parcel map, final map shall be

required as a condition to the approval of a lot line adjustment. The lot line adjustment sha11
be reflected in a deed, which shall be recorded. No record of survey shall be required for a lot
line adjustment unless required by Section 8762 of the Business and professions Code."
The new parcel on Beach Road will be re-zoned from C-4 to O-M in order to be consistent with
the existing properties on Beach Road,
There are no public utilities nor public easements that will be affected and this application can be
approved by the Commission. The Commission action does not need to be forwarded to Council
except on appeal.
