conuitional use permit from the City Council.
The original Special Permi� su'r,mitted by Tidelands Development Co. on
Septeriber 6, 1963 ivas to "construct and operate a drive-in theater
facility in accordance t��ith plans ancl renderin�s sabmitted by Vincent
Rai.7ey." T}iose plans slioiaed two screens; a tneater for 1030 cars i�rithin
855 foot radius anc? a smaller theater for 55 cars within a 622 f:oot radius.
The plan on file gave no indication of the size or iieight on the t�vo screens.
The Special Perriit i:Tas approl-ed by the Planning Cor�mission at Public
Ifearing on SeptemLer 23, 196� and it became effective October �, 19G3.
The screens t}lat were built are 60'x 130` in size �ti-ith the top of screen
heing 90 feet above ground. The twin drive-in tlleaters are r.early syr;imetri-
cal about a central projector bootil/co7lcession building.
Proposed plansx include: A projection booth addition; one nela screen -
44'x 96' in size and 62 feet hibh to �e located at the northi�=est proi�erty

The City Attorney �vas requesf.ed to clarify the City's responsiri]_i�y

Revised plans for zhe proposed new drive-in theater
evic�ence a substantial change from the plans con-
sidered by the Ci�y Planning Commission at their
hearing on June 2b, 1972. Anza Pacific Corporation
for tenant Syufy Enterprises no�a reauests one acidi-
tional screen rather than two.
It appears appropriate and reasonable for tr�e City
Council to refer the rnatter back to the Planning
Conmission for reconsideration of the modified ap-
plication.

Dear Mr. Swan:
Thank you for your letter of July 6, 1972 indicating that the
Special Permit for adding two screens and alterations at the
Burlingame and Peninsula Drive-in Theatres was set for public
hearing at the regular Council Meeting to be held on July 17th.
I will plan to be at that meeting; however, I enclose herewith
a set of revised plans for the purposed Drive-in Theatre eliminating
the additional proposed screen in the northwest corner of the
property.
It is my understanding that by modifying the application so as
to provide for a request for one additional screen, rather than
two, that this will be an appropriate modification to justify the
City Council's referral of this application back to the Planning
Commission, and I request that this be done.
I will appear at the nex� Planning Commission Meeting, and request
that this application be reconsidered as modified.

On behalf of our client, Anza Pacific Corp.,
appeal is hereby taken from the action of the
Planning Commission on June 26, 1972, denying the
application for a special permit to add two screens
and to alter Burlingame and Peninsula Drive-In
Theaters at 350 Beach Road.
We are advised that since the time of the
Planning Comraission meeting, the plans submitted have
been modified. On the basis of the modifications,
which were made as the result of comments made by
some of the Planning Commissioners, we respectfully
request that the application be referred back to the
Planning Commission. Ii you do not agree with this
request, it is our understanding of your established
procedure that the matter will be set for public
hearing on your meeting of July 17.

This application was announced for hearing. Mr. David Keyston of
Anza Pacific addressed the Com*�lission, and introduced Mr. Jack Hague,
vice president of Syufy Enterprises. Mr. Keyston stated this appli-- .
cation involved the addition of two small screens at the bac}: corner
of the theater, and added he had contacted the State Hiqhwuy Depar_tmerit
about the visi.bility from the freeway. State Highway regul.ations
prohibit theater screens withi.n 600' of the freeway, but the original
screens are 800' from the free��:ay, and the ne�r screens 4�ould be 1/3
ot a mile. He stated this request was brought about by a substantial.
chanqe in the theater industry with the necessity for mul-�iple
units to attract the public. He conunerited �1nza Pacific would be happy
to limii: any consideration to the present tenant and to the present
lease, wha.ch will not be e�tended; ana that the same conditions applying
ta the original pennit wauld apply to this one.
7'here was no audience comrnent ea.ther for or ac�ainst. The public
hearinq was declared closed.
Commissioner Taylor questioned �he size of the screens and was in-
formed that they woul.d be 1/2 the square footaqe of the presenf: ones,
which are 90' high. New screens �vould be 60' high. Conunissioner Sine
asked about the lease and was told it was for_ 25 years origir.ally
and that 14 years remain.
Commissianer Norberg had no cornmen�. Commissioner Nink qttes�ioned
the conditiona.nq of the old and the ne�� permit and was inform�d by
the CiL-y Attorney that the old permit could no lonaer b� conditi.oned.
Commissioner Taylor stated th�t the use had alreaUy been �ccepted,
and that this additian could not make tlie situation much worse.
Commissioner Kindiq c�id not agree with this comment, particularl.y with
regard to boat traf£ic. Comrnissioner Jacobs stated he did not
condone the theater usage, but felt the variance would be acceptable
since the screens would have to come c3own at the end of the lease.
Commissioner Cistulli thought it would be more acceptable if the olc�
screens were cut do���n to the size of the new ones.
Mr. Keyston stated that the ac3ditian of the screens would cost
$�00,0�0, Cutting down the s�.ze of the old screens, with attendant
work of relocation of prajection booths and regrading of parking
to different angles would cost half again that much. He quest�oned
that it orould be econo;nically feasible far the balance of this
lease.
Coinmissioner Kindig moved tha� this application for special permit
for adding tt��o screens and alteratians to Burlingarne and Peninsul.a
Drive-in 2'heaters at 350 Beach P,oad be denied, Commissioner Pdink
