Since there was no appeal, a minor modification to extend an existing first floor wall with a 3'-0" setback where 5'-0" is required at 1011 Toyon Drive, zoned R-1, was approved effective July 5, 2000. The project shall be built as shown on the plans submitted to the Planning Department and date stamped June 26, 2000. Any changes to these plans shall be subject to further minor modification procedures. The minor modification was approved with the following findings: the original house was built with a 3'-0" side setback which does not meet current code requirements and the proposed addition represents a minor encroachment (2'-0") into the required side setback; 2. that the proposed addition will be located at the rear of the existing residence, and therefore will have a minimal impact on the appearance of the residence from the street; 3. that the first floor addition is designed within the allowed building envelope, complies with floor area ratio, parking, height and all other current development requirements and is therefore compatible with the aesthetics, mass, bulk and character of existing and potential uses of properties in the general vicinity; arid 4. the proposed project meets all other zoning code requirements and will meet the requirements of the California Building and Fire Codes, 1998 Edition as amended by the City of Burlingame, and therefore will not be detrimental to public health, safety or welfare. M1NOR MODIFICATION 1011 Toyon Drive page -2- All site improvements and construction work will require separate application to the Building Department. This approval is valid for one year during which time a building permit must be issued. One extension of up to one year may be considered by the Planning Commission if application is made before the end of the first year.
