Since there was no appeal to or suspension by the City Council, the February 9, 2004 Planning Commission
approval of your application for design review became effective February 19, 2004. This application was to
allow a first and second story addition at 1008 Toyon Drive, zoned R-1.
The February 9, 2004 minutes of the Planning Commission state your application was approved with the
following conditions:
1. that the project shall be built as shown on the plans submitted to the Planning Department date stamped
January 28, 2004, Sheets A-1 through A-5, site plan, floor plans, building elevations; that all skylights
shall be tinted to reduce the impact of night glow on the neighbors and neighborhood;
2. that any increase to the habitable basement floor area and any changes to the size or envelope of the first
or second floors, which would include expanding the footprint or floor area of the structure, replacing or
relocating a window (s), adding a dormer (s) or changing the roof height or pitch, shall be subject to
design review;

that the conditions of the Recycling Specialist's, Fire Marshal's, and City Engineer's memos of
November 24, 2003, shall be met;
that prior to scheduling the roof deck inspection, a licensed surveyor shall establish the height of the roof
ridge and provide certification of that height;
5. that prior to scheduling the framing inspection, the project architect, engineer or other licensed
professional shall provide architectural certification that the architectural details such as window
locations and bays are built as shown on the approved plans; if there is no licensed professional involved
in the project, the property owner or contractor shall provide the certification under penalty of perjury;
certifications shall be submitted to the Building Department;
6. that prior to final inspection, Planning Department staff shall inspect and note compliance of the
architectural details (trim materials, window type, etc.) to verifythat the project has been built according
to the approved Planning and Building plans;
7. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single termination and
installed on the portions of the roof not visible from the street; and that these venting details shall be
included and approved in the construction plans before a Building permit is issued;
8. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which
requires affected demolition, new construction and alteration projects to submit a Waste Reduction Plan
and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall
require a demolition permit;
9. that the applicant shall comply with Ordinance 1503, the City of Burlingame Storm Water Management
and Discharge Control Ordinance; and
10. that the proj ect shall meet all the requirements of the California Building and Fire Codes, 2001 edition, as
amended by the City of Burlingame.
Reimbursement of the design review deposit has been processed and will be mailed to the property owner under
separate cover.
All site improvements and construction work will require separate application to the Building Department. This
approval is valid for one year during which time a building permit must be issued. One extension of up to one
year may be considered by the Planning Commission if application is made before the end of the first year.
The decision of the Council is a final administrative decision pursuant to Code of Civil Procedure Section
1094.6. If you wish to challenge the decision in a court of competent jurisdiction, you must do so within 90 days
of the date of the decision unless a shorter time is required pursuant to state or federal law.
