Dear Mr. Woerz,
Since there was no appeal to or suspension by the City Council, the March 10,
1997 Planning Commission approval of your hillside area construction permit
and lot coverage variance application became effective March 19, 1997. This
application was to allow for a 250 SF patio cover at 2829 Tiburon Way, zoned
R-1.
The March 10, 1997 minutes of the Planning Commission state your
application was approved with the following conditions:
1. that the 10'-0" x 25'-0" patio cover (250 SF), as built over the existing
concrete patio area, shall conform to the size and location shown on the
plans submitted to the Planning Department and date stamped January
21, 1997; and
2. that this project shall meet all the requirements of the California Building
and Fire Codes, 1995 Edition, as amended by the City. of Burlingame.
All site improvements and construction work will require separate application
to the Building Department. This approval is valid for one year during which
time a building permit must be issued. One extension of up to one year may
be considered by the Planning Commission if application is made before the
end of the first year.
The decision of the Council is a final administrative decision pursuant to Code
of Civil Procedure Section 1094.6. If you wish to challenge the decision in a

court of competent jurisdiction, you must do so within 90 days of the date of
the decision unless a shorter time is required pursuant to state or federal law.

C. Wellford noted that he had made a site visit and had seen the existing deck and the location for the
new reQk and that he did not see a problem, that the deck would be a benefit, it would improve the
safety fort ildren using the rear yard because the culvert has steep sides and it would be hard to
get a child who ha len in, out; the deck as prop ed at top of the bank of the culvert would not
have a negative effect o the flow or capacity of the cr or on the ability to maintain or repair the
creek. He then moved, y resolution, and with the conditi in the staff report as follows; 1) that
the deck, as built, shall c nform to the plans submitted to the P ing Department and date stamped
January 21, 1997; 2) that he property owner shall keep the ports of the creek located at 1249
Cabrillo Avenue clear of de s and shall maintain the channel and p tection structures on their
property to insure free flow of t creek and to minimize erosion; 3) at the deck shall remain
independent of the retaining walls as desi d, and shall be constructed to b removable to clear debris
if necessary; 4) that the conditions of the Par irector's memo of January 2 , 997 shall be met; and
5) that this project shall meet all the requireme is of the California Building an e Codes, 1995
Edition, as amended by the City of Burlingame.
The motion was seconded by C. Coffey and approved 6-0-1 (C. Deal abstaining) on a voice vote.
Appeal procedures were advised.
APPLICATION FOR A HILLSIDE AREA CONSTRUCTION PERMIT AND A VARIANCE FOR
LOT COVERAGE AT 2829 TIBURON WAY, ZONED R-1, (EBERHARD WOERZ, APPLICANT
AND KRISTINA WOERZ DOOMAN, PROPERTY OWNER)
Reference staff report, 3.10.97, with attachments. CP Monroe discussed the request, reviewed
criteria, Planning Department comments, and study meeting questions. Two conditions were suggested
for consideration.
There were no questions of staff.
Chairman Ellis opened the public hearing. Eberhard Woerz, property owner, stated that they wanted
the arbor in order to provide a sunshade so that they could keep the curtains open on that side of the
house; the arbor will not be visible from the street or from other adjacent properties. There were no
othercomments and the public hearing was closed.
C. Deal commented that he had looked at the site and one would have to go out of one's way to see
this trellis; no one complained about the hillside area construction (view obstruction) request; the trellis
does cause lot coverage to be exceeded but it is an open structure, it is needed for shade and the air
passes through it, and it fits the design and arrangement of the existing house.. On the basis of these
findings he moved to approve the hillside area construction permit and lot coverage variance by
resolution with the findings in the staff report and the following conditions; 1) that the 10'-0" x 25'-0"
patio cover (250 SF), as built over the existing concrete patio area, shall conform to the size and

APPLICATION OR A SPECIAL PERMIT AND PARKING VARIANCE FOR AN ADDITION TO
A CHURCH AT 15WEASTON DRIVE, ZONED R-1 R-3, AND A SPECIAL PERMIT TO
USE AN R-3 ZONED T FOR PARKING AT 150 EASTON DRIVE, (BOB DAVIDSON,
APPLICANT AND ARTHLTP. D. GIMBEL PROPERTY R .

criteria, Planning Department co ments, and study meeting questions. total of seven conditions
on the two properties were Bugg sted for consideration. Commission asked i he church was required
in 1983 to buy the lot now used for parking at 1501 Easton, staff noted that ch ch was not required;
commissioner noted that these Aditional spaces are now being included in the exis 'ng non -conforming
parking count rather than being ked to offset the proposed expanded use on the site.
Chairman Ellis opened the public he Bob Davidson, church member and r ident of Redwood
City, representing the Presbyterian Chur spoke noting that they have review the conditions
suggest and agree with them; Charles Kavan his presently doing the survey toN

He also note that there were people in the audience teresenting the nursery schools of the
adjacent neighb ood and members of the congregation, all willing to answer any questions the
Commission might e. He was asked if the 24 parkin spaces off -site were available for parents
picking up children at th ursery school; yes they can b when they are not needed the are gated

off to keep the lot from being ed by others, if there is a neral during the day the extra lot is open;
it was noted that the hour betw n nursery school sessio was enough to avoid overlap between
parents picking up and dropping of hildren; school sessions ill never be spaced closer because they
need to set up for the next class.
Faye Boyes, 909 Lurline Drive, Foster City, Director of the N ery school, spoke she discussed
staffing noting that each class had two teachers and a parent voluntN for the 20 students enrolled;
it was noted that initially only the two classrooms on the first floor oT,,the new building would be
finished and used by the nursery school, the two rooms on the second floor uld be completed later.
Staff noted that the use permit and conditions addressed the full developme .and use of the new
building, as well as including the existing facilities and a separate use permit for using the lot across
the street, zoned R-3, for parking so long as the church use continued at 1500 Easton.
