Date: 09.24.98 fly— Margarei Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION, HILLSIDE AREA CONSTRUCTION PERMIT, SIDE SETBACK AND LOT COVERAGE VARIANCES RESO-49-98 RESOLVED, by the Planning Commission of the City of Burlingame that: / 11 . 1 " i / • 1 • 0ENRON WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on September 14, 1998 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and Categorical Exemption, per Article 19. Section: 15301 Class 1 - (e) additions to existing structures provided the addition will not result in an increase of more than 50% of the floor area of the structures before the addition is hereby approved. 2. Said hillside area construction permit, side setback and lot coverage variances are approved: subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such hillside area construction permit, side setback and lot coverage variances are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. I, Dave Luzuriaaa , Secretary of the Planning Commission of the certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 4 h day of September., 1998 , by the following vote: AYES: COMMISSIONERS: COFFEY, KEIGHRAN, KEY, LUZURIAGA, VISTICA AND DEAL NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: BOJUES SECRET. EXHIBIT "A" Conditions of approval for categorical exemption, hillside area construction permit, side setback and lot coverage variances 2810 TIBURON WAY effective SEPTEMBER 23, 1998 1. that the project shall be amended from what is shown on the plans submitted to the Planning Department and date stamped August 14, 1998, Sheets A1, A2, A3, A4, A5 and A6 with a maximum roof ridge height of 21'-5" as measured from average top of curb [elevation (-7'-3")], to include that the roof pitch on the new addition be reduced to 3:12 and the gable end replaced with a hip roof; 2. that the 4 % of lot coverage created by the deck shall never be enclosed in anyway or added to the hose and the deck area shall never be enclosed; 3. that any changes to the footprint, building height, window placement or building envelope shall require an amendment to this Hillside Area Construction Permit; and 4. that this project shall meet all the requirements of the California Building and Fire Codes, 1995 Edition, as amended by the City of Burlingame.
