REQUEST FOR TWO MINOR MODIFICATIONS AND A HILLSIDE AREA
CONSTRUCTION PERMIT
Dear Property Owner,
The Burlingame Planning Department has received an application for a Hillside Area Construction Permit
and Minor Modifications at the following address:

APPLICATION FOR TWO MINOR MODIFICATIONS AND A HILLSIDE AREA
CONSTRUCTION PERMIT FOR A 483 SF FIRST FLOOR ADDITION AND TO
CONVERT EXISTING CRAWL SPACE TO LIVING AREA (555 SF) AT 2810
TIBURON WAY, ZONED R-1.
1. Minor Modification to extend an existing first floor wall with a 6'-0" side setback. The
existing wall at the left side of the house would be extended another 23'-0" to add a bedroom.
The addition would have a 6-0" side setback where T-0" is required without a minor
modification.
2. Minor Modification for 40.8% lot coverage where 40% is required without a minor
modification. An existing deck at the rear of the house will be removed to reduce lot
coverage.
3. Hillside Area Construction Permit. This permit is required for any addition to an
existing residence in the affected area.
Your property is located within 100 feet of this property. Two minor modifications and a hillside area
construction permit have been requested to allow this addition based on Municipal Code Sections 25.55
and 25.61.

A copy of the site plan, floor plans and building elevations are enclosed for your review. Unless review
of the application is requested it shall be determined that the placement of the proposed construction shall
not have a substantial impact on the views from adjacent properties. The minor modifications shall be
approved based upon the following findings:
1. exceptional circumstances on this property are that the original house was built with a 6'-0" side
setback which does not meet current code requirements and would be difficult to remove and that the
proposed addition represents no greater an impact on the adjacent property than the existing side
setback;
2. that the first floor extension will match the existing side setback of the existing wall and that the first
floor extension is at the rear of the house and will not be visible from the street, and is therefore
compatible with the aesthetics, mass, bulk and character of existing and potential uses of properties
in the general vicinity. It should be noted that the lot slopes down 9'-0" from left to right along the
front property line and 10'-0" along the rear property line which reduces the visibility of the addition
from the street;
3. that with the project lot coverage will be reduced from 44.2 % to 40.8 % by demolishing the existing
above grade deck at the rear of the house which will reduce visual obstructions; and
4. that the proposed addition complies with height, parking and all other current development
requirements and will meet the requirements of the California Building and Fire Code, 1995 Edition
as amended by the City of Burlingame, and therefore will not be detrimental to public health, safety
or welfare.
Unless review of the application is requested it shall be determined that the placement of the proposed
construction shall not have a substantial impact on the adjacent properties or on the character of the
