HomeMy WebLinkAbout2810 Tiburon Way - Staff ReportSTAFF REPORT January 5, 1981 TO: PLANNING COMMISSION FROM: CITY PLANNER SUBJECT: VARIANCE TO ALLOW INCREASE OF TOTAL LOT COVERAGE TO 42.8% AT 2810 TIBERON WAY The applicant, Dr. Donald Odone, is requesting a variance from the 40% maximum lot coverage regulation, Code Section 25.66.010 to 42.8% in order to add a 419 square foot room at gound level for his parents. The application has been reviewed by the City Engineer,the Fire Marshall and Chief Building Inspector, all of whom had no comment. In his letter of December 28, 1981, the applicant points out the purpose of the addition is to provide space for his wife's parents. The current proposal is made because the stairs to a second story addition would be difficult for his parents to use. He states that the area occupied by the addition is little used yard area and more than ample yard area remains. He also states that the addition at this location would not be visible from the street, nor will it visually affect the architectural style of the house. A memo to the file from the Planning Staff (12/30/81) indicates that the roof covering the concrete patio area would be removed keeping lot coverage to 42.8%. In all other ways this project conforms to code. In granting a variance the Commission must make the following findings. (Code Section 25.54.020). (a)That there are exceptional or extraordinaly circum- stances applicable to the property or class of uses in the district, so that a denial of the application would result in undue property loss; (b) That such a variance would be necessary for the pres- ervation and enjoyment of a property right of the owner of the property involved; (c) That the granting of such variance would not be mat- erially detrimental to the public health, safety or welfare, or injurious to the property or improvements of other property owners, or the quiet enjoyment of such property or improvements; (d) That the granting of such variance will not adversely affect the comprehensive zoning plan of the city. If following a public hearing the Planning Commission can make findings to grant a variance to lot coverage, Staff recommends the following conditions;l.that the cover/roof on the cement patio be removed; 2. that no kitchen facilities or plumbing and/or electrical wiring which would specifically facilitate later installation of such kitchen facilities be allowed in this addition. The room, as planned, does not disrupt the architectural integrity of our home and utilizes an area of yard space for which we have very little use. The addition of this room would, however, give a land coverage of 42.80, which is 2.8% above code allowance. Alternate plans would involve a second story which, aside from not being optimal esthetically, would create a problem with stairs, which would be difficult for our parents to use. Other than this minor amount of coverage, it will en- hance the home and will leave more than ample yard space. The addition will not be visable from the street, nor will it in anyway disrupt the architectural style of the house or the zoning plan of the city. We would like a varience for this 2.8% overage.
