Request: Special Permit and Hillside Area Construction Permit for
Satellite Dish Antenna at grade, at the rear of the
house, at 2700 Summit Drive, zoned R-1. Antennas in the
residential (R-1) district require a special permit (C.S.
18.18.020) and any accessory structure in the hillside
area requires a hillside area construction permit (C.S.
25.61.020).

CEQA Status: Exempt; Sec. 15303 Class 3, Construction of minor
accessory structures including antennas.
Summary: The applicant is proposing to install a 6' diameter, 6'
tall, satellite dish antenna, on the ground at the rear of the
house. The antenna will be installed approximately 39' from Kenmar
Way, 17' from the side property line, and 14' from the corner of
the house and patio. The existing antenna installed without
permits, located in approximately the same location as the proposed
antenna, will be removed and replaced with the smaller 6' diameter
dish. The new antenna is perforated mesh painted black in color.
The antenna will be used for access to foreign language programs
not available on cable. Al1 other zoning code requirements have
been met.
History: When the applicant moved into the house several years
ago there was an existing satellite dish antenna located on a 21'
pole as measured from the ground, which extended the dish above the
roof of the house. The Planning Department code enforced and
notified the current owner that while an antenna could not be
placed on or above the roof , an antenna could be placed in the rear
yard with a specia� permit at a maximum height of 6' (April 23,
1992 letter from M. Monroe). The antenna was removed following the
Planning Commission denial of a second story addition to the house.
Later the owner relocated the same 10' diameter antenna at grade,
at the rear of the house but never applied for a special permit.
Based on a compliant and after a site inspection the Planning
Department noted that the antenna in place was taller than 6' and
still had no special permit. After the second enforcement action
the applicant is proposing to install a 6' diameter dish, 6' above
grade in the yard.

Staff Comments: The Chief Building Official notes (February 22,
1993 memo) that the antenna installation shall comply with
manufacturers requirements.
Required Findings for a Special Permit: In order to grant a Special
Permit the Planning Commission must find that the following
conditions exist on the property (Code Section 25.52.020 a-c):
(a) the proposed use, at the proposed location, will not be
detrimental or injurious to property or improvements in the
vicinity, and will not be detrimental to the public health,
safety, general welfare, or convenience;
(b) the proposed use will be located and conducted in a manner in
accord with the Burlingame general plan and the purposes of
this title;
(c) the Planning Commission may impose such reasonable conditions
or restrictions as it deems necessary to secure the purposes
of this title and to assure operation of the use in a manner
compatible with the aesthetics, mass, bulk and character of
existing and potential uses on adjoining properties in the
general vicinity.
Planninq Commission Action: The Planning Commission should hold a
public hearing. Affirmative action should be taken by resolution
and should include findings. The reasons for any action should be
clearly stated for the record. At the public hearing the following
condition should be considered:
Conditions:
1. that the dish antenna shall be installed on the ground as
shown on the plans submitted to the Planning Department and
date stamped February 17, 1993 Location Map and Plan, and
Antenna description sheet from Channel Master;
2. that as installed the antenna dish shall not have a diameter
greater than 6'-0", nor rise more than 6'-0" above the
adjacent grade, and shall be painted black in color with
nonreflective paint;

3. that the conditions of the Chief Building Officials' February
22, 1993 memo (that the installation of the antenna shall
comply with manufacturer's requirements) shall be met;
4. that the existing 10' diameter satellite dish antenna shall be
permanently removed;
5. that the applicant or property owner shall be responsible for
an amendment to this use permit if future construction on any
adjacent property requires relocation of the dish antenna,
removal and reinstallation costs shall also be borne by the
applicant and/or property owner; �
6. that the applicant shall permanently maintain the
nonreflective surface of the dish and its support structure,
or remove the facility;
7. that the project shall meet all the requirements of the
Uniform Building and Uniform Fire Codes as amended by the City
of Burlingame; and
8. any modification to the antenna or its location shall require
an amendment to this use permit.

Dear Mr. Khouri:
Enclosed is a refund of your $310.0o application fee for a use permit
for a satellite dish antenna at 2700 Summit Drive. This dish was
installed 21' above grade at the rear of your house without a Building
or Planning permit by a previous owner of the house. The current code
does not permit, at all, dish antenna which are higher than 6' above
grade and then only in the rear yard, not extending through the roof.
If you wish to relocate the dish so that it meets these requirements
you may apply for a use permit with the Planning Department. In the
interim you should remove the dish from its present location as soon as
possible.

We recently received a notice warning us that the
satellite antenna in our rear yard does not conform to the
provisions of Burlingame's Ordinance no. 1327. In response to
your warning, we have decided to purchase and install a smaller
satellite antenna, which will have a three foot radius and will
not exceed six feet from the ground level directly beneath it.
More information about this smaller satellite antenna can be
found in our enclosed application for a special permit.
We have decided to keep a satellite antenna because it
uniquely gives us access to a foreign language program that
cannot be provided to us by Pacific Cable Television, the local
cable company that serves Burlingame. As we state in our
application, the installation of this new, smaller satellite
antenna will not only follow the provisions of Ordinance no.
1327, but will also not be injurious or detrimental to public
health, safety, general welfare, convenience, or character of our
community.
For these reasons, we hope that you act favorably on

NOTICE OF HEARING
The CITY OF BIIRLINGAME PLANNING COMMISSION announces the
following public hearing on Monday, the 22nd day of March, 1993,
at 7:30 P.M. in the City Hall Council Chambers located at 501

RESOLUTION APPROVING CATEGORICAL EXEMPTION,
SPECIAL PERMIT AND HILLSIDE AREA CONSTRUCTION PERMIT
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application
has been made for a special permit and hillside area construction permit
for a satellite dish antenna at grade at 2700 Summit Drive
(APN 027,130-130�; (property owner: Adib and Svlvia Khouri, 2700 Summit
Drive, Burlingame, CA 94010 ); and
WHEREAS, said matters were heard by the Planning Commission of the
City of Burlingame on March 22, 1993 , at which time it reviewed
and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning
Commission that:
l. On the basis of the Initial Study and the documents submitted
and reviewed, and comments received and addressed by this commission, it
is hereby found that there is no substantial evidence that the project
set forth above will have a significant effect on the environment, and a
categorical exemption, Sec. 15303 Class 3, Construction of minor
accessory structures including antennas, is hereby approved.
2. Said special permit and hillside area construction permit are
approved, subject to the conditions set forth in Exhibit "A" attached
hereto. Findings for such approval are as set forth in the minutes and
recording of said meeting.
3. It is further directed that a certified copy of this resolution
be recorded in the official records of the County of San Mateo.
