A special permit is required per CS 18.18.020-(a). The easement is 17'-0" wide along the right side property line and 21'-0" wide along rear property line. Satellite dish antenna would be located in the rear yard, 7'-0" from the left side property line and +36'-0" from the rear property line. The antenna would be 71- 0" wide (maximum) and would not exceed 6'-0" in height when measured from grade. The satellite dish will be screened by a fence, trees and a retaining wall. No other work is proposed, all other zoning code requirements are met. Satellite antennas can only be installed in the rear yard; no portion of the antenna can exceed 6'-0" in height from ground level beneath it and shall be screened from view from the first floor of buildings on adjacent properties and from any public right-of-way within 500 feet. Study Meeting Questions: Planning Commission reviewed this item at study and asked a number of questions (Planning Commission minutes, June 22, 1992). The designer responded by letter (June 26, 1992). She noted the satellite dish is flat black and therefore non - reflective. She also noted the dish is aligned to the southeast, and is limited to rotation to the left and right no more than 90 degrees. The maximum height is six feet at any angle. Required Findings for Special Permit: In order to grant a Special Permit the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020 a-c): (a) the proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; (b) the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planning Commission Action The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution and should include findings. The reasons for any action should be clearly stated. At the public hearing the following conditions should be considered: 1. the antenna shall be placed as shown on plans submitted to the Planning Department date stamped June 11, 1992; 2. that building permits for the antenna shall be obtained within 30 days of the date of this action; and 3. that this project shall meet all Uniform Building and Uniform Fire Codes as amended by the City. RESOLUTION APPROVING SPECIAL PERMIT RESOLVED by the Planning Commission of the City of Burlingame that: WHEREAS, application has been made for a special permit to install a satellite dish antenna at 2667 Summit Drive (APN 027-224-040); (property owner: Paul Ferrari, 2667 Summit Drive, Burlingame, CA 94010 ); and WHEREAS, this Commission held a public hearing on said application on July 13, 1992 , at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Planning Commission that said special permit is approved, subject to the conditions set forth in Exhibit "A" attached hereto. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo.
