Previous Use: Office Building . � Proposed Use: Office Building with excess parking spaces leased to off-site users. Allowable Use: Lease of excess parking spaces requires conditional use permit as a use determined to be compatible with the purposes of the district. History: This application was originally scheduled for Commission consideration at its October 23, 2000 meeting. The applicant requested a continuance to the November 13, 2000 in order to clarify the conditions of approval. The applicant then requested a continuance to the November 27, 2000 meeting. The conditions as drafted prohibited the use of the site for long-term airport parking. The applicant did not want to use the spaces as a free-standing long-term airport parking facility, but inquired if the spaces could be leased to hotels in conjunction with a"park and fly" promotion. This use would not be considered a free-standing long term airport parking facility, but would require an amendment to both the use permit for this site and the use permit for any participating hotel. The proposed conditions of approval have been amended to reflect this requirement. Summary: The applicant, Todd Green for 800 Airport Partnership, is requesting a conditional use permit to allow leasing of 23 parking spaces in excess of the required parking in an existing parking lot which serves a 47,700 SF gross floor area office building at 800 Airport Boulevard, zoned C-4. The following application is required: A conditional use permit is required to establish that the lease of parking spaces in excess of required parking is a use which is compatible with the purposes of the C-4 zone district. When the structure was built in 1981, a restaurant occupied the top floor. This space has since been converted to office use. The parking requirement for a restaurant in the C-4 zone district is 1 space per 100 SF, plus 1 space per 1000 SF. The parking provided on the site reflects the former use of the top floor as a restaurant. The parking requirement for the 47,700 SF offce building is 159 paxking spaces, and there are a total of 182 spaces on site in surface parking, lower level parking below the building and in the second floor parking area. There are 23 spaces in excess of the current parking requirement for the office building. The applicant proposed to lease these 23 parking spaces to businesses in the area. Conditional Use Permit for uses which are found to be desirable and compatible with the purposes of the C-4 zone district 182 spaces 1 space for each 300 SF of office area (159 spaces total required) * Conditional use permit for lease of parking spaces in excess of required parking. This project meets all other zoning code requirements. Staff Comments: The Chief Building Official, the Fire Marshal and the City Engineer had no comments on the proj ect. Study Meeting: At the October 10, 2000 Planning Commission study meeting, the commission asked how long would the lease be for the parking spaces; how will they decide what business could rent the parking spaces; will there be a restriction on the type of use of these parking space, for example, no car rental storage, does the applicant have a tenant in mind. The commission also asked what would happen to the leased spaces if a restaurant returned to this building. The applicant has responded in the attached letter date stamped October 13, 2000. The applicant notes that the leases would be on a month-to-month basis with a thirty-day termiriation: They intend to lease the spaces to businesses within a short distance from the parking lot, and the majority of those businesses are hotels and restaurants within the hotels. They do not intend to lease the spaces to a car rental company. Planning staff would note that a condition of approval has been added which would prohibit the lease of these spaces to a car rental company. � The applicant notes that there has not been a restaurant on the fifth floor. since 1984, and they do not intend to return the fifth floor to that use. If that were to occur, the code requirement for parking would have to be met. Planning staff has added a condition of approval that states that if any restaurant or other use which requires additional parking is proposed in this building, an amendment to this use permit shall be required. Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit the Planning Commission must find that the following conditions exist on the properiy (Code Section 25.52.020 a-c): (a) the proposed �use, at improvements in the or convenience; (b) (c) the proposed location, will not be detrimental or injurious to property or vicinity, and will not be detrimental to the public health, safety, general welfare, the proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; the Planning Commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the ' 2 Conditional Use Perntit for Lease of Parking Spaces 800 Airport Boulevard aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. . Findings: Based on the fact that there are adequate parking spaces available on site for the current office use of the building, that the spaces will only be leased to area businesses, and that conditions of approval have been proposed to prohibit the lease of the spaces to a car rental agency or for a free standing long-term airport parking facility, and to ensure that the permit is amended if the use of the building is intensified, the proposed use is found compatible with the required findings for a conditional use permit. � Planning Commission Action: The Planning Commission should hold a public hearing. Affirmative action should be taken by resolution and should include findings. The reasons for any action should be clearly stated. At the public hearing the following conditions should be considered: Conditions: 1. that the project shall operate as shown on the plans submitted to the Planning Department and date stamped September 13, 2000, Sheet A-1, site plan, and date stamped August 14, 2000, sheets A2.1, A2.2, A2.3, A2.5 and S-6, floor plans, and that 24-hour security shall be provided to the building and parking area should any of these parking spaces be leased separately to an off-premise tenant; 2. that the applicant shall lease no more than 23 parking spaces to businesses in the area as delineated on Sheet A-1 date stamped September 13, 2000, site plan and that it shall be designated on each of the leased parking spaces that they are reserved for the lessee; the total number shall not exceed 23; 3. that the lease of these spaces to a car rental company or an automobile sales facility for vehicle storage shall be prohibited; 4. that these spaces shall not be leased as a free-standing, long-term airport parking facility; 5. that if the paxking spaces are leased to a hotel other than for employee or conference parking, that hotel shall be required to amend their use permit to describe how the leased spaces are to be used by the hotel, and the use of these 23 parking spaces shall be linked to the hotel use permit by amendment to this use permit; 6. that there shall be no separate fee charged to the office building's tenants for required on-site parking and office tenants parking shall be limited to a maximum stay on site of 24 hours; 7, that if any restaurant or other use which requires additional parking is. proposed in this building, an . amendment to this use permit shall be required; and 8. that any improvements for the use shall meet all California Building and Fire Codes, 1998 Edition as amended by the City of Burlingame. The Commission is concerned about the length of any lease we enter into in regards to the excess parking spaces. We believe in allowing ourselves as much flexibility with those spaces as possible. And as the Commission was made aware of in our application, we actually had a lease in place with Red Roof Inn for those extra spaces prior to being informed that we needed a conditional use permit to rent them out. The lease with Red Roof Inn was a month-to-month agreement with a thirty (30) day termination and that is the manner in which we intend to continue to rent out those spaces. The Commission was also interested in our intentions to continue renting out the excess spaces if the fifth floor was ever returned to use as a restaurant. While we have no plans to return the fifth floor of 800 Airport Boulevard to a restaurant, we do understand the Commission's concerns and know that we can never write the future in stone. Therefore, we have no problem with the Commission making the conditional use permit contingent on 800 Airport Boulevard continuing to be operated solely as an office building. Although we believe that any owner of the building wanting to return a portion of the building to restaurant use would have to allot those excess spaces for restaurant parking in order to comply with City of Burlingame code, a restriction would ensure that in the unlikely event that either we or a future owner chose to make the iifth floor a restaurant again the excess parking would simply revert to it's original status as restaurant parking. Our location on Airport Boulevard is unique because there are so many businesses up and down the Airport Boulevard corridor. However, the excess parking spaces are going to be most desirable to only those business within in short distance from our parking lot and the majority of those businesses are hotels and restaurants within those hotels. Being that those spaces were previously rented out to a neighboring hotel, those are certainly going to be the business we intend on approaching first to rent out the excess parking spaces. We have never thought about renting to a car rental company nor has one ever approached us about renting out spaces. A car rental company would not have a desire to use our parking lot for the simple reason that we are not located by the new SFO car rental center, nor near any of the SFO off-site car rental offices. The likelihood is that if they were looking to use a portion of someone else's parking facility it would be a facility in closer proximity to their main rental center, which we are not. We are too out of their way for our location to make any sense for them. Once again, we appreciate the Commission's willingness to review this application and the opportunity to respond to their comments and concerns. Burlingame, CA 94010 Re: Conditional Use Permit for 800 Airport Boulevard Dear Commissioners: When the office building at 800 Airport Boulevard was constructed in 1981, the first two floors were parking, the two floors above the garage were office and the top floor was a restaurant. Burlingame's code required the builder to provide more parking spaces per square foot for restaurant than for office use, which was done. In fact, as the figures on the site plan shows, the original builder planned on constructing even more parking spaces than the number that was actually built. Regardless, the restaurant closed years ago and the entire facility has been office since 1984. Thus, because of the City parking requirement for restaurant use, we have had more parking spaces than the code requires for over fifteen years. During this period we have had parking spaces consistently vacant and have rented them out with no detrimental effect on anyone. In fact, the availability of extra spaces has had a positive effect on the area by allowing other businesses to more easily accommodate customers than they otherwise would have been able to do. Until recently we were unaware of the need for city approval to rent these spaces, which is the reason for this application. We are asking for a conditional use permit for the twenty-three (23) spaces we have in our parking lot in excess of what code requires for an office building so that we may continue to rent them out to area businesses. Our building is currently compatible with Burlingame's general plan and zoning requirements and would remain so if the conditional use permit was granted because we are not asking to change or expand our current use. Further, our request has no effect on the building, landscaping or the surrounding property area because the commission would simply be allowing us to continue doing what we have been doing for so long without negative impact on anyone. , Thank you for your time and consideration. The proposed use with have no detrimental or injurious consequences. There is adequate parking based upon the number of spaces Burlingame code currently requires for office use. The excess spaces consistently go unused. The use will remain the same as it has been since the construction of the facility. When the office building was built, the top floor was a restaurant, two floors were office and two floors were parking. Burlingame city code required (and continues to require) a higher density of parking for restaurant than office. The restaurant was removed and replaced with offices. Thus, the building has twenty-three (23) parking spaces more than necessary by code. We are simply asking to be able to rent out these spaces to businesses in the area. 2. The requested permit will not change the existing location or use of the facility. The building's parking spaces remain compatible with the current City General Plan and Zoning Ordinance even after separating out the twenty-three (23) excess spaces. The requested permit does not ask for an expanded use of the ofiice facility. 3. The proposed use of the parking lot does not represent a change in the parking lot's current use and does not affect any of the exterior landscaping and current building structure.
