Zoning: RR General Plan: Industrial & Associated Office Use — Auto Row Overlay District Environmental Review Status: The project is Categorically Exempt from review pursuant to the California Environmental Quality Act (CEQA), per Section 15301, which states that existing facilities, consisting of the operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination are exempt from environmental review. Existing Use: Warehouse — Vacant Proposed Use: Retail Showroom/Warehouse — Balsam Brands (artificial Christmas trees) Allowable Use: Air courier service, light industrial or manufacturing use, labs, office uses in conjunction with a permitted use, warehouses, retail sales and display areas in conjunction with a permitted use and commercial recreation uses are all allowed with a Conditional Use Permit Property Background: The site consists of four commonly owned parcels at the corner of David and Adrian Roads with the addresses 1541 and 1561-1565 Adrian Road. Two existing buildings and their associated parking spaces, which extend across the property lines, cause a de facto merger of all four parcels. There is a 10-foot public utility easement (PUE) running the length of the left (west) side of the site. The PUE is within the property lines of the site. The owner of the project site also owns a 646 feet (length) x 140 feet (width) portion of the drainage easement located west of 1541 and 1561-1565 Adrian Road. There are two buildings on the project site. The building at 1541 Adrian Road contains the Go-Kart Racerfacility which was approved by the Planning Commission with a Conditional Use Permit, Parking Variance and Landscape Variance in March, 2003. The building at 1561-1565 Adrian Road contains office, warehouse and storage and was previously leased to The Chronicle. The conditions of approval for the Go-Kart Racer facility tie the building at 1541 Adrian Road, to the building at 1561-1565 Adrian Road. Because of this arrangement, both parking and landscaping for these buildings and their uses has been analyzed for all four parcels as a whole. Project Description: The applicant, Balsam Brands, is requesting a Conditional Use Permit to allow a non-auto related retail showroom and warehouse use (artificial Christmas trees) at 1561 Adrian Road, zoned RR, Automobile Sales and Service Overlay Area. Within the Auto Overlay Area, a Conditional Use Permit is required for non-auto related retail showroom and warehouse (Code Section 25.44.050 b, 2). The applicant is proposing to use 2,506 SF of existing warehouse space for a retail showroom and to continue to use the remaining space for warehouse. Balsam Brands sells home decor products, most specifically artificial Christmas trees, and has operated seasonal showrooms for their products at various malls around the Bay Area for the past several holiday seasons. They are looking to locate a permanent showroom in Burlingame to eliminate the need for their pop-up showroom locations. There will be no manufacturing conducted on the premises. The proposed business will be open on Monday through Friday from 7:00 am to 9:00 pm and on the weekends from 9:00 am to 9:00 pm. The proposed retail showroom will not be open for the first couple of years of operation and then will only operate on a seasonal basis. In their letter of explanation, the applicant states that they anticipate that when the seasonal retail showroom is open, there will be no more than 20-25 guests at a time. The number of employees Conditional Use Permit 1561 Adrian Road on site will range from 3 to 8 depending on the time of the day and the day of the week. The maximum number of people expected on site at any one time for this business, including the owner and employees, is estimated to be 37 persons. There are currently 44 striped parking spaces designated to the building at 1561-1565 Adrian Road, where 43 spaces are required based on the use breakdown for that building. The applicant is proposing to re-stripe the portion of the lot adjacent to the building, which will increase the number of parking spaces designated to the building by 4 spaces, for a total of 48 spaces. With the proposed intensification of use, the number of required spaces on-site will increase from 43 spaces to 45 spaces, where 48 spaces will be required. The proposed project therefore complies with the on-site parking requirements. All other Zoning Code requirements have been met. Planning staff would note that because of the nature of the request, it was determined that this request could be brought forward directly as an action item. If the Commission feels there is a need for more study, this item may be continued with direction to the applicant. Findings for a Conditional Use Permit: In order to grant a Conditional Use Permit, the Planning Commission must find that the following conditions exist on the property (Code Section 25.52.020, a-c): (a) The proposed use, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity and will not be detrimental to the public health, safety, general welfare or convenience; (b) The proposed use will be located and conducted in a manner in accord with the Burlingame general plan and the purposes of this title; (c) The planning commission may impose such reasonable conditions or restrictions as it deems necessary to secure the purposes of this title and to assure operation of the use in a manner compatible with the -2- Conditional Use Permit 1561 Adrian Road aesthetics, mass, bulk and character of existing and potential uses on adjoining properties in the general vicinity. Planning Commission Action: The Planning Commission should conduct a public hearing on the application, and consider public testimony and the analysis contained within the staff report. Action should include specific findings supporting the Planning Commission's decision, and should be affirmed by resolution of the Planning Commission. The reasons for any action should be stated clearly for the record. At the public hearing the following conditions should be considered: 1. that the retail showroom/warehouse shall be limited to 2,506 SF of retail showroom area at 1561 Adrian Road, as shown on the plans submitted to the Planning Division and date stamped June 19, 2012; 2. that the retail showroom/warehouse business may not be open for business except during the hours of Monday through Friday from 7:00 am to 9:00 pm and on the weekends from 9:00 am to 9:00 pm; 3. that the number of people on site at 1561 Adrian Road at any one time, including the owner, employees and customers shall not exceed 37 persons; 4. that the maximum number of employees, including the business owner, in 1601 Adrian Road shall be limited to 8 persons; 5. that any changes to the floor area, use, hours of operation, or number of employees which exceeds the maximums as stated in these conditions shall require an amendment to this conditional use permit; and 6. that any improvements for the use shall meet all California Building and Fire Codes, 2010 Edition, as amended by the City of Burlingame. Balsam Brands is excited to submit this CUP to convert up to 2,500 sq. ft. of 24,000 sq. ft. of warehouse space at 1561 Adrian Road (in between Go Kart Racer and All Natural Stone Granite & Fine Tile) to a retail showroom for our home decor products. Balsam Brands, a Bay Area company founded in 2006, is a leading online reta'iler of home decor products, led by its flagship brand, Balsam Hill. Balsam Hill is the leading national brand of artificial Christmas trees, featured in publications and broadcasts ranging from the San Francisco Chronicle, San Jose Mercury News, New York Times, The Wall Street Journal, Oprah, Ellen, Rachel Ray, The Today Show, Good Housekeeping, and many others. Balsam Brands is one of the fastest growing internet retail companies and is part of the Internet Retail Top 500 index of the SOO largest online retailers in the United States. The company has signed a long term lease with Bob Edwaxds of Pacific Power & Equipment Company for 24,000 sq. ft. of space to use as a warehouse. This warehouse will support our specialized warehousing including small item pick and pack, returns, and warranty service. (The company leases >200,000 sq. ft. of space in public warehouses across the country as its primary distribution network.) As part of the Burlingame facility, we intend to open a retail showroom to allow local Bay Area customers to see our products first hand and place orders for them in person. In addition, we expect on a seasonal basis to offer a limited number of surplus items for sale through a factory outlet store. Historically, Balsam Brands has operated seasonal showrooms across the Bay Area to allow local customers to view our products in person and order them for delivery by FedEx. For the 2006, 2007, and 2008 holiday seasons, Balsam Brands operated a seasonal showroom in the Stanford Shopping Center. Seasonal showrooms were also located in San Francisco Centre, Town Center Corte Madera; Broadway Plaza Mall in Walnut Creek, and Stoneridge Mall in Pleasanton. The installation of a permanent showroom in Burlingame will allow for a single seasonal showroom to serve customers in the Bay Area without the added expense and hassle of seasonally setting up "pop up" showrooms in shopping malls. Balsam Brands expects the showroom to have an extremely low impact on the neighborhood. Pea.k moments at retail showrooms at the local malls had at 20-25 guests at one time, many of whom were passersby who stopped into the store while browsing the mall. Given that the Burlingame showroom will only serve those who actively seek out these products, it is expected to be very low traffic. Economically this still is viable for the company as the average purchase price per sale is quite high (�$800). The majority of truck traffic to/from the building will be by FedEx, which would already be driving past the building. We do not expect to employ any office staff in this warehouse as our main offce is nearby in downtown San Mateo. Relative to the Adrian Road neighborhood, this use is less traffic intensive than the sports venues (Go Kart Racer and the Badminton center) and is consistent with the retail showroom use of the marble and tile centers. Since the expected use of the showroom is seasonal and the overall load on the building (total employees plus total expected customers) is low, not to mention that most deliveries will be by FedEx, we expect this to be a very non-intensive use of this property. CP Monroe pointed out that there was a 9,620 square foot area on the west side of the building at 1541 Adrian next to the SP right-of-way and E City of Burlingame Planning Commission Approved Minutes March 24, 2003 including the PUE on the Adrian site which was visible from the street and also from the parking in the dxainage area which could be landscaped. Adding irrigated landscaping to this area, along with the landscaping proposed by the applicant, would increase total landscaping on the site to the required 10%. CA Anderson asked that a condition be added that parking in the drainage ar�a is at the risk of the people who park there because the purpose of the drain is flood control, and that the city should be held harmless. There were no other comments or questions on the staff report. Chair Keighran opened the public hearing. Steve Markulin and Shaina Markulin applicants, Bruce Shelling, 1575 Adrian Road; Tony Van Arkel, 228 Stanley Road. Applicants noted that this was a good location and there was a need for more recreation opportunities in this area; asked for a clarification that children under 18 be allowed on the site after 6 p.m. with a parent or guardian in order to spectate, they would not be allowed to drive or play video games; the reaso� for the requested change is to further promote the activity as a family activity, family can come see father or mother drive; presence would be limited to the viewing area. Commission asked if the applicant would be willing to add the landscaping along the west side of the building, it would be good to eliminate a variance and meeting the landscape requirement is consistent with the objectives for this Subarea in the planning studies on going in the Rollins Road area at this time. Applicant noted that they were not aware they could landscape this area, and would do so if they could. Commission asked about the requested change in persons under 18 on the site after 6 p.m. Applicant noted want young people to be able to observe the activity any time when there with a parent or guardian but do not want unaccompanied children under 18 hanging out in the viewing area or arcade. The core of the business is adults, especially in the evenings. Other testimony: have a business in the area and was concerned about having to secure parking area because the Go Kart business would be a Mecca for kids, with alcohol and litter. Reassured to hear that it is an adult oriented facility, look to the commission to protect adjacent properties from impacts; for the past 6 or more years the area has been secure, without litter and graphite free. Been involved with this type of recreational activity, participants don't drink or use drugs; good activity for a family everyone is involved. Applicant responded appreciate concern about loitering, use should not be negative to the area, a clean, positive experience. There were no further comments from the floor and the public hearing was closed. C. Vistica moved approval of the conditional use permit for recreation use in the M-1 zone and for a 41 space on-site parking variance with the mitigation that 43 parking spaces be paved and improved in the drainage area and connected by lease agreement with the commercial recreation use at 1541 Adrian Road to expire should the conditional use on the site be changed; and with the added conditions that the city be held harmless for damage to vehicles parked in drainage area, that 9, 600 SF of landscaped area be provided on the west side of the building between the building and SP right-of-way in order to eliminate the variance for 10% of the site being landscaped, that the permit shall be reviewed upon complaint and that the children under the age of 18 be allowed only in the viewing area, on the site after 6 p.m. so long as they are accompanied by a parent or guardian; and with the conditions in the staff report, as modified, by resolution. The motion was seconded by C. Auran. The amended conditions of approval are: 1) that the proj ect shall be built as shown on the plans submitted to the Planning Department and date stamped February 27, 2003, sheets A-1 through A-3, and date stamped March 13, 2003, sheet L-l; with a total of 90 % of the required on-site landscaping and 2,981 SF of landscaping in the front setback along David Road and that landscaping on the west side of the property include an automatic irrigation system and large scale shrubs, trees and vines on the building; that 32 parking spaces shall be provided and rnaintained on site and used only for the proposed commercial recreation use in the building at 1541 Adrian Road; and that the existing chain link fence separating the 32 parking spaces for the cornmercial recreation use at 1541 Adrian Road from the 49 parking spaces for 1565 Adrian Road shall remain and be maintained by the property owner; 2) that the 10 City of Burlingame Planning Commission Approved Minutes March 24, 2003 variance for on-site parking spaces and the variance for total site landscaping, providing 90% of the total required, shall expire with the termination of the conditional use permit for the Go Kart use; shall be reviewed with any amendment to the conditional use permit granted to the Go Kart use; and shall expire should any one or all of the three buildings on the site be demolished; 3) that because the purpose of the drainage area is for flood control before issuance of a building permit for any ofthe construction for the Go Kart use at 1541 Adrian Road, , the owners of the property on which the drain is located shall draft an agreement on behalf of themselves and their successors in interest and in favor of the City of Burlingame holding the City of Burlingame, its officers and employees harmless for the approval of the parking within the drainage area for any future loss, damage, or claim that may arise because of the location, methods, and construction of the paxking use within the drain area and that fully represents that the owners are relying solely on their own ienowledge and the representations of their own experts and consultants in constructing the parking and in no way relying on any representations or analyses of the City or any of its officers or employees in proceeding with the construction and use.
