RESOLUTION OPPOSING LEGISLATION
ABRIDGING THE RIGHT TO SUE SAN
FRANCISCO INTERNATIONAL AIRPORT
AB 2909
RESOLVED by the CITY COUNCIL of the City of Burlingame,
WHEREAS, for many years this City and others in the
vicinity of San Francisco International Airport have attempted
to improve the quality of life by working with the facility in
reducing the level of airport noise; and
WHEREAS, those efforts have had slight success and citizen
of these cities therefore filed personal civil actions against
the airport through Small Claims Court; and
WHEREAS, the City and County of San Francisco has, through
the process of last minute conference committee amendments,
obtained passage by the Legislature of a bill which would prevent
all Small Claims and virtually all Municipal Court and Superior
Court actions regarding airport noise damages, and is blatantly
designed to apply only to San Francisco International Airport;
and
WHEREAS, in the opinion of the City Attorney of Burlingame
and the District Attorney of San Mateo County, this bill severely
impedes the ability of citizens to pursue individual actions;
NOW, THEREFORE, the CITY COUNCIL of the City of Burlingame
urges the veto of Assembly Bill 2909, and directs the City Clerk
to transmit to the Governor a certified copy of this Resolution
and of the opinion of the San Mateo County District Attorney.
