Dear Applicant,
Since there was no appeal to or suspension by the City Council, the May 27, 2025, Planning Commission
approval of your application for Hillside Area Construction Permit and Variance for front setbacks
became effective June 6, 2025. This application was for a single-story addition to an existing single-unit
dwelling at 19 El Quanito Way.
Attached is the Planning Commission resolution of approval which includes the associated conditions
of approval and project plans. The project must adhere to all site improvements and construction work
will require a separate building permit application to the Community Development Department prior to
work being performed.
This approval is valid for two years during which time a building permit must be issued (by June
6, 2027). One extension of up to one year may be considered by the Community Development Director
if a written application and filing fee is submitted to the Community Development Department at least 30
days prior to the expiration date listed above.

APPROVING HILLSIDE AREA CONSTRUCTION PERMIT AND VARIANCE
FOR 19 EL QUANITO WAY
PROJECT NO. HACP25-0001
WHEREAS, an application has been made by Tim Raduenz, Form+ One Design, on behalf of
Property Owners, Angelique and Chris Rypinski, for Hillside Area Construction Permit and Variance
for front setbacks for a single-story addition to an existing single-unit dwelling in the R-1 (Low Density
Residential) zoning district, APN: 027-130-320; and
WHEREAS, on May 27, 2025, the Planning Commission of the City of Burlingame held a duly
noticed public hearing at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing; and
WHEREAS, on May 27, 2025, the Planning Commission of the City of Burlingame reviewed
and considered a Categorical Exemption under Section 15301 (e)(1) for the Project; and
NOW, THEREFORE, the Planning Commission of the City of Burlingame does here by resolve, find,
determine and order as follows:
SECTION 1: The project is Categorically Exempt from the California Environmental Quality Act
(CEQA) pursuant to Section 15301 (e)(1) of the CEQA Guidelines, which states that additions to
existing structures are exempt from environmental review, provided that the addition will not result in
an increase of more than 50% of the floor area of the structures before the addition.
SECTION 2: City of Burlingame Municipal Code (BMC) authorizes the Planning Commission
to grant Hillside Area Construction Permit and Variance upon making certain findings. The Planning
Commission finds the following:
HILLSIDE AREA CONSTRUCTION PERMIT FINDINGS (BMC SECTION 25.70.040)
1. The project is consistent with the purpose of the Hillside Overlay Zone.
The proposed project is consistent with the purpose of the Hillside Overlay Zone and does not
have a substantial impact on adjacent properties or on the character of the immediate
neighborhood in that the proposed project is located on a sloping lot, which slopes downward
approximately 10’-0” from the left side of the property to the right side and downward
approximately 20’-0” at the rear half of the site, with the proposed additions located on the flat
portion of the lot. The proposed additions are only 2’-3” higher than the existing highest ridge of
the house and do not obstruct existing distant views.
2. The project complies with the development standards found in Section 25.20.040.B through I.

project locates the additions where there is minimal disturbance to grading and is at the lowest
feasible elevation on site. The project is designed in a manner that preserves existing distant

additions are single-story and designed to be consistent with the character of neighboring
properties.
VARIANCE FINDINGS – FRONT SETBACKS (BMC SECTION 25.84.030)
1. There are exceptional or extraordinary circumstances or conditions applicable to the property
involved that do not apply generally to property in the same zoning district.

the confines of the slope of the lot to maintain neighborhood consistency and compatibility, and
to minimize impacts to surrounding properties.

hardship.

hardship in that the additions at the front of the house with proposed front setbacks of 10’-3”
and 15’-4” do not significantly impact neighboring properties, and provide single-story
horizontal additions to prevent obstruction of existing distant views.
3. The granting of the application will not be detrimental or injurious to property or improvements
in the vicinity and will not be detrimental to the public health, safety, general welfare or
convenience.

convenience in that the proposed front setbacks of 10’-3” and 15’-4” (where 20’-0” is the
minimum required) create minimal impacts to adjacent neighbors because the additions follow
the general outline of the exterior of the front facade.
4. That the use of the property will be compatible with the aesthetics, mass, bulk, and character of
existing and potential uses of properties in the general vicinity.

bulk of the proposed single-story additions do not affect the pedestrian-friendly interface of the
front elevation with the street, and that the proposed design is aesthetically cohesive with the
design of the house and respects existing neighborhood character.
SECTION 3: The Planning Commission of the City of Burlingame after conducting the public
hearing HEREBY APPROVES HACP25-0001 subject to the following conditions:

1. that the project shall be built as shown on the plans submitted to the Planning Division and
date stamped April 10, 2025, sheets T1.0, GN, SW, CG, topographic survey, A1.0 through
A5.0, and A9.0;

2. that any recycling containers, debris boxes or dumpsters for the construction project shall be
placed upon the private property, if feasible, as determined by the Community Development
Director;
3. that demolition for removal of the existing structures and any grading or earth moving on the
site shall not occur until a building permit has been issued and such site work shall be required
to comply with all the regulations of the Bay Area Air Quality Management District;
4. that all air ducts, plumbing vents, and flues shall be combined, where possible, to a single
termination and installed on the portions of the roof not visible from the street; and that these
venting details shall be included and approved in the construction plans before a Building
permit is issued;
5. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance
which requires affected demolition, new construction and alteration projects to submit a Waste
Reduction plan and meet recycling requirements; any partial or full demolition of a structure,
interior or exterior, shall require a demolition permit; and
6. that the project shall meet all the requirements of the California Building and Uniform Fire
Codes, in effect at time of building permit submittal, as amended by the City of Burlingame.
SECTION 4: The Hillside Area Construction Permit and Variance approval shall be subject to
revocation if the applicant fails to comply with the conditions listed herein at any time. If, at any time,
the Community Development Director or Planning Commission determine that there has been or may
be a violation of the findings or conditions of this approval, or of the Zoning Regulations, a public
hearing may be held before the Planning Commission to review this approval pursuant to Zoning
Regulation Section 25.88.050. At said hearing, the Planning Commission may add conditions, or
recommend enforcement actions, or revoke the approval entirely, as necessary to ensure compliance
with the Zoning Regulations, and to provide for the health, safety, and general welfare of the
community.
