HomeMy WebLinkAboutReso - CC - 096-1983RESOLUTION NO. 96-83 AUTHORIZING PARTIAL PRETREATMENT EXEMPTION AGREEMENT BETWEEN THE CITY OF BURLINGAME AND THE TOWN OF HILLSBOROUGH RESOLVED, by the CITY COUNCIL of the City of Burlingame, California, and this Council does hereby FIND, ORDER and DETERMINE as follows: 1. The public interest and convenience require execution of the agreement cited in the title above. 2. The City Manager be, and he is hereby, authorized to sign said agreement for and on behalf of the City of Burlingame. 3, The City Clerk is hereby ordered and instructed to attest such signature. HILL, City Clerk of the City of Bprlingame, do hereby certify that the foregoing Resolution was introduced at a regular meeting of the City Council held on the 17th day of October 19 83, and was adopted thereafter by the following vote: AYES: COUNCILMEN: AMSTRUP, BARTON, MARTIN NOES: COUNCILMEN: NONE ABSENT: COUNCILMEN: CROSBY, MANGINI juity Clerk e- 74-73 Partial Pretreatment Exemption Agreement Between City of Burlingame And Town of Hillsborough_ This Partial Pretreatment Exemption Agreement has been entered into this 17th day of October , 1983 by City of Burlingame and Town of Hillsborough Whereas, RECITALS City of Burlingame owns and operates a wastewater treatment system which is permitted by the State Regional Water Quality Control Board (Permit # CA0037788 ); and Whereas, City of Burlingame must, as required in its Dermit, develop a pretreatment program applicable to all industrial users of its wastewater treatment system wherever located; and Whereas, City of Burlingame has entered into a service agreement with Town of Hillsborough dated December 8, 1975 whereby City of Burlingame treats at its treatment plant wastewater discharges from Town of Hillsborough ; and Whereas, Town of Hillsborough desires to continue to utilize City of Burlingame treatment plant and to cooperate with City of Burlingame in the implementation of a pretreatment program. In consideration of the following terms and conditions contained herein, City of Burlingame and Town of Hillsborough agree that; I. Town of Hillsborough shall certify and document that there are no ✓ industrial users, as defined by City of Burlingame , connected to Town of Hillsborough sewer system. This certification and documentation shall be based on an industrial waste survey performed according to procedures established by City of Burlingame 2. Town of Hillsborough shall designate an appropriate official or employee to review, on a quarterly basis, all pertinent records (e.g., connection permits, business licenses, water use records), to determine whether an industrial user will be locating within Town of Hillsborough's service area. If a prospective industrial user is identified, Town of Hillsborough shall report this fact to City of Burlingame and the provisions of paragraph 6 will be invoked. Town of Hillsborough shall provide City of Burlingame access to these records for independent verification of both Town of Hillsborough review procedures and records. 3. Any authorized officer or employee of City of Burlingame may enter and inspect, sample, and monitor any part of the sewer system of Town of Hillsborough The right of entry and inspection, sampling, and monitoring shall extend to public streets, easements, and property within which the system is located. All reasonable expenses incurred by City of Burlingame in performing any of these functions may be assessed upon Town of Hillsborough City of Burlingame agrees to provide Town of Hillsborough with a detailed accounting of sampling expenses prior to their assessment. 4. Town of Hillsborough shall not authorize any industrial user located within its jurisdictional boundaries to connect to any sewer line, pipe or other conveyance which carries wastewater to the City of Burlingame's Treatment Plant without the City of Burlingame's written approval. Failure to obtain the City of Burlingame's approval prior to connection, may result in disconnection of the industrial user at the sole discretion of the City of Burlingame. 5. After the City of Burlingame has given its approval for any industrial user within the Town of Hillsborough's jurisdiction to connect, the Town of Hillsborough shall not authorize industrial user to commence discharge until provision has been made between the Town of Hillsborough and the City of Burlingame to oversee the industrial user's compliance with all applicable Federal, State and local pretreatment requirements. This shall be accomplished by renegotiation of this Agreement to es- tablish and designate administrative responsibilities between the Town of Hillsborough and the City of Burlingame for all pretreatment, legal and programmatic functions required by 40 CFR 403. The City of Burlingame may develop a schedule of activities to be undertaken by the Town of Hillsborough to develop its own pretreatment program. 6. Any disputes arising out of this Agreement shall be submitted to binding arbitration performed in accordance with the rules of the (The American Arbitration Association). Council authorized the City Manager and the City Attorney to negotiate an Interjurisdictional Agreement on behalf of the Town for pretreatment of industrial waste.
