CALL TO ORDER
A regular meeting of the Planning Commission, City of Burlingame was called to order by Chairman
Ellis on Monday, June 24, 1996 at 7:30 p.m.

The minutes of the June 10, 1996 meeting were approved as mailed.
The order of the agenda was approved.
There were no public comments.
ITEMS FOR STUDY
APPLICATION FOR 6 SPECIAL PERMITS FOR THE RECONSTRUCTION OF AN EXISTING
ACCESSORY BUILDING AT 839 WALNUT AVENUE, ZONED R-1, (DEBORAH HALL,
PROPERTY OWNER AND APPLICANTI.
Requests: before public hearing applicant should submit plans to scale with all structures located
properly on the site with proper setbacks, etc.; floorplans of accessory structure should be accurate
showing all walls at exterior and interior at existing depth; applicant needs to submit reasons having
to do with the property for each of the exceptions requested since it may be physically easier to build
anew structure placed properly on the site than to retain the present one; what hobbies are designated
for recreation room; If all information is available for the next public hearing the item will be set for
hearing July 8, 1996, otherwise it will be carried over until the information is complete.
2. APPLICATION FOR A TAKE-OUT PERMIT FOR PREPARED DRINKS AT 274 LORTON
AVENUE, ZONED, C-1 SUBAREA A (SANDRA YORK, PROPERTY OWNERS AND
CHERYL ENRIGHT, DBA CALIFORNIA CANDY COMPANY APPLICANT.)
Requests: has an encroachment permit been requested for the bench and wooden statue under that
permit and could tables and chairs be added; are the windsocks on the sides of the awning a code
enforcement issue; are there any plans to sell other food items in the near future; Item set for hearing
July 8, 1996.

ITEMS FOR ACTION
3. APPLICATION FOR A VARIANCE FOR SEPARATION AT 1212 EL CAMINO REAL,
ZONED R-3. (JACK KLEIN PROPERTY OWNER AND APPLICANT)
Reference staff report, 6.24.96 with attachments. CP Monroe discussed the request, reviewed criteria,
Planning Department comments, and study meeting questions. Five conditions were suggested for
consideration.
C. Ellis opened the public hearing. Jack Klein, the applicant, 2630 Skypark Drive, Hillsborough, was
present to explain that he has done the work as originally planned and asked that the 4' clearance be
waived as the sheet rock and plywood will add a 11/2 to a 3 hour fire wall. There were no other
comments and the public hearing was closed.
C. Deal noted this plan follows the intent of the Planning Commission to provide all covered parking
as well as give tenants a useable patio area, it streamlines egress and improves the project and meets
the fire separation requirements, he then moved, by resolution, approval of this request with the
following conditions: 1) that the project shall be built as shown on the plans submitted to the Planning
Department and date stamped April 12, 1996, Sheets 1,2,3,4 and 5 as amended by revised sheet 1 date
stamped May 31, 1996 showing a minimal vertical separation between the landing and stair from the
second floor over and beside the carport/garage structure, and the minimum width of the driveway
shall be 10'0" from property line for the length of the building and the new carport. Construction
shall not create any obstruction to the maneuvering area at the rear of the lot or access to the adjacent
property; 2) that there shall be 6 covered parking spaces dimensioned to current code requirements and
any changes to the carports shall require an additional review by the Planning Commission; 3) that all
the conditions of the Chief Building Inspectors June 3, 1996 memo shall be met; 4) that the small
room being retained on the second floor shall be improved to meet all the requirements of the
California building and Fire Code 1995 Edition as amended by the City of Burlingame and if present
construction of the room was not done with a building permit then a retroactive building permits shall
be obtained; and 5) that the entire project shall meet the California Building and Fire Code, 1995
Edition as amended by the City of Burlingame.
Motion was seconded by C. Galligan and passed on a 7-0 roll call vote. Appeal procedures were
advised.
4. APPLICATION FOR ASIDE SETBACK VARIANCE AT 1568 ALTURAS AVENUE, ZONED
R-1. (STEVEN B. GROUBERT, PROPERTY OWNER AND MARY DUNLAP APPLICANT.
Reference staff report, 6.24.96 with attachments. CP Monroe discussed the request, reviewed criteria,
Planning Department comments, and study meeting questions. Three conditions were suggested for
consideration.
C. Ellis opened the public hearing. Steven and Nella Groubert, property owners, 1568 Alturas
Avenue, were present to explain the project and their preference for having the deck/spa as close to
the bedroom as possible for accessibility and also so the distant view from the bedroom would not be

obstructed. They also noted their desire to keep the only green space on the lot, at the rear, free for
lawn use. There were no other comments and the public hearing was closed.
Commission reviewed the measurements as shown on the plans and asked for clarification of the side
yard shown at 17' on the plans; there was some discussion about the exact size of the sideyard next
to the bedroom, it was noted that if the area is in fact not 17' then the variance it granted would stand
at 2' and they would have to make the deck narrower; the 13' dimension mentioned is the length of
the deck at 2' parallel to the side property line; the commissioners noted that the trees adjacent to the
side property line are on public property, the property owner cannot remove them; lot is very steep
limited space to put a spa; no one lives on this side of the property it is next to Mills Canyon and
screened by trees from people across canyon.
C. Galligan for the reasons stated noted this placement is not detrimental, gives the maximum use of
the property and is reasonable protection is provided to adjacent properties. He then moved, by
resolution, approval of this request with the following amended conditions: 1) that the project shall
be built as shown on the plans submitted to the Planning Department and date stamped May 13, 1996,
Sheets 1, 2 and 3; 2) that any changes to the deck or hot tub which affect the side setback on the west
side of the lot shall require Planning Commission review again; 3) that the fence line on the west side
of the property shall not be changed nor shall the trees adjacent to the fence on public property be
removed; and 4) that the project shall meet all the requirements of the California Building and Fire
Codes, 1995 edition as amended by the City of Burlingame.
Motion was seconded by C. Key and passed on a 7-0 roll call vote. Appeal procedures were advised.
5. APPLICATION FOR A SPECIAL PERMIT TO ALLOW A HEALTH SERVICE USE AT 405
PRIMROSE ROAD, #203, ZONED, C-1, SUBAREA Bl (TERRY HORN, PROPERTY
OWNERS AND KATHLEEN L. ADDISON MFCC, APPLICANT.)
Reference staff report, 6.24.96 with attachments. CP Monroe discussed the request, reviewed criteria,
Planning Department comments, and study meeting questions. Six conditions were suggested for
consideration. A letter objection to the application from Alan Horn was read into the record.
C. Ellis opened the public hearing. Terry Horn, the applicant, 405 Primrose Road, was present to
answer any questions. The mix in the building is about half health service. The new use is across
the hall from the previous area which will no longer be used for health service and the parking
requirement is the same as the previous use. There were no other comments and the public hearing
was closed.
C. Galligan noted based on the fact that the parking impact for the new area is virtually the same as
for the area no longer being used for health care and that there were no complaints about parking from
the previous use, he moved, by resolution, approval of this request with the following conditions: 1)
that the project shall occupy suite #203 at 405 Primrose Road as shown on the floor plan dated May
28, 1996 and submitted to the Planning Department and may move to a smaller suite within the
building under these same conditions of approval but shall not be expanded or moved to a larger suite
without an amendment to this use permit and parking variance application; .2) that the maximum
number of people on the premise at one time shall be the applicant and a single client (i.e. one person,
one family) and that all clients shall be seen by appointment only and there shall be a minimum of a

ten minute interval between appointments; 3) that the hours of operation shall not exceed 9:00 a.m.
to 9:00 p.m. Monday through Saturday with a maximum of 25 clients per week in 5 years; 4) that a
partner or clerical staff shall not be added to this operation without an amendment to this use permit;
5) that with the approval of this application the previous health service use approved for 405 Primrose
Road, suite #206 shall be rescinded of this application and a separate special permit and variance
application would be required if any similar use were proposed for this area in the future; and 6) that
any improvements made to the office space shall receive the appropriate permits and shall meet the
conditions of the California Building and Fire Codes, 1995 Edition as amended by the City of
Burlingame.
Motion was seconded by C. Key and passed on a 7-0 voice vote. Appeal procedures were advised.
