HomeMy WebLinkAboutMin - PC - 1996.05.28CITY OF BURLINGAME PLANNING COMMISSION Tuesday, May 28, 1996 CALL TO ORDER A regular meeting of the Planning Commission, City of Burlingame was called to order by Acting Chairperson Ellis on Tuesday, May 28, 1996 at 7:30 p.m. ROLL CALL Present: Commissioners Coffey, Deal, Galligan, Key, Mink and Ellis Absent: Commissioner Wellford Staff Present: City Planner, Margaret Monroe; City Attorney, Jerry Coleman; City Engineer, Frank Erbacher; Fire Marshal, Keith Marshall MINUTES - The minutes of the May 13, 1996 meeting were approved as mailed. AGENDA - Item #4, a special permit for retail clothing store at 1500 Adeline Drive was withdrawn. The order of the agenda was then approved. FROM THE FLOOR There were no public comments. ITEMS FOR STUDY 1. APPLICATION FOR SIDE SETBACK VARIANCE AT 2101 RAY DRIVE, ZONED, R-1, (DAN AND CINDY GRIESEMER, PROPERTY OWNERS AND DAN GRIESEMER AND ALLISON KOHLER, STEWART ASSOCIATES, APPLICANTS) Requests: is location of the front door through the carport, where does the door parallel to the driveway go; if they are replacing the existing water heater why can they not relocate that enclosure to outside the side setback; Item set for hearing June 10, 1996. 2. APPLICATION FOR A TAKE-OUT PERMIT FOR A SNACK SHOP IN THE CHEVRON STATION AT 260 EL CAMINO REAL, ZONED C-1, SUBAREA A, (CHEVRON, USA, INC., PROPERTY OWNER AND NANETTE NAMES, REPRESENTING R. H. LEE & ASSOCIATES. APPLICANT). Requests: add a copy of the enforcement correspondence to the action packet; what is George Currie's relationship to the project; at the far right service bay the backup area scales to 23' from door to space, should be 24 % does the parking stall at the air and water area block use of air and water; can a car be parked in the Burlingame side parking space at the corner if El Camino Real side parking space has a car in it; if they are to install a microwave, list the items -1- Burlingame Planning Commission Minutes May 28, 1996 to be heated, no heated food is shown on miscellaneous items list; is this a health department concern about customers cooking their own food; Item set for hearing June 10, 1996. ITEMS FOR ACTION 3. APPLICATION FOR AN AMENDMENT TO A PREVIOUSLY APPROVED VARIANCE TO RECONFIGURE PARKING AND BALCONY AT 1212 EL CAMINO REAL, ZONED R-3, (JACK KLEIN, PROPERTY OWNER AND APPLICANT). CONTINUED FROM MAY 13, 1996. Reference staff report, 5.28.96, with attachments, item continued from previous meeting. CP Monroe discussed the request and applicants representatives comments after the last meeting, reviewed criteria, Planning Department comments, and study meeting questions. Four conditions were suggested for consideration. C. Ellis opened the public hearing. Mr. Kline, the applicant, 2630 Skypark Drive, Hillsborough and Mr. Yanaga, 1650 Boreal, San Mateo, the project architect were present to answer questions. The room they would like to keep is just a small, possibly 7' X 7', workroom or storage area. The room has electricity, heat and the walls are sheetrocked. Keeping this room caused the deck and exit stairs from the second floor to be rearranged; because of the 4' fire separation requirement the covering on one parking space was required to be removed. Mr. Kline expressed a desire to retain the space cover, if this would require a fire rated wall and he is willing to build that wall. Pictures of the improvements were presented for the record. There were no other comments and the public hearing was closed. Commission discussed the need for a variance for the four foot separation which was not noticed and suggested the applicant come back to commission with plans retaining the covered space and meeting all fire and UBC requirements; requesting a variance for the 4' separation. C. Galligan moved, by resolution, approval of this request to eliminate the covering on one parking space and to place a wall to separate this space from the patio area, with the added provision that the applicant may return with an application for a variance for the four foot fire separation for the covered garage within 30 days, with the following conditions: 1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped April 12, 1996, Sheets 1, 2, 3, 4 and 5 and the minimum width of the driveway shall be 10'-0" from property line for the length of the building and the new carport. Construction shall not create any obstruction to the maneuvering area at the rear of the lot or access to the adjacent property; 2) that there shall be 5 covered parking spaces and 1 uncovered parking space dimensioned to current code requirements and any changes to the carports shall require an additional review by the Planning Commission; 3) that a 36' wall shall be placed between the uncovered parking space and the new at grade patio area and the small room being retained on the second floor shall be improved to meet all the requirements of the California Building and the Fire Code 1995 Edition as amended by the City of Burlingame and if present construction of the room was not done with a permit then a retroactive building permit shall be obtained; and 4) that the entire project shall meet the California building and Fire Code, 1995 Edition as amended by the City of Burlingame. -2- Burlingame Planning Commission Minutes May 28, 1996 Motion was seconded by C. Mink and passed on a 5-1-1 (C. Key dissenting and C. Wellford absent) roll call vote. Appeal procedures were advised. 4. APPLICATION FOR A SPECIAL PERMIT FOR RETAIL CLOTHING STORE AT 1500 ADELINE DRIVE, ZONED C-1, (MARMORA TERRELL, PROPERTY OWNER AND YOLANDA C. KIDSON. APPLICANTI. The application was withdrawn. 5. APPLICATION FOR A SPECIAL PERMIT FOR AUTO REPAIR AT 1369 ROLLINS ROAD, ZONED, M-1, (GLYNNE LEWIS AND LEO BOGER, PROPERTY OWNERS AND STEPHEN WU, APPLICANT). Reference staff report, 5.28.96 with attachments. CP Monroe discussed the request, reviewed criteria, Planning Department comments, and study meeting questions. Five conditions were suggested for consideration. Chin. Ellis opened the public hearing. Stephen Wu, the applicant was present to explain his application. The business at present is auto repair on North Carolan and would be expanded into the tenant space at the rear which fronts on Rollins Road. The added tenant space would be used for an auto body shop. The interior wall currently separating the two businesses will have a man door in it for fire exiting purposes. How the required parking spaces provided inside the building would be used was discussed. Concerns about dust and other impacts on customers cars was noted. The applicant stated most customers left their cars to be repaired and were not concerned about dust. There were no other comments and the public hearing was closed. C. Galligan noted the parking problems in this area impacted by auto repair uses. Cars waiting to be repaired should not be parked in the required parking spaces, therefore this interior parking plan is not realistic. He then made a motion to deny this application. Commission noted for the record that, if approved, this special permit runs with the land and another tenant who would be less consciences about parking off the street could use this site; this is really an intensification of use from the previous warehouse use. Also the second floor area above office is not built like the plans show, there is a 7' ceilinged area now being used as living space. Should be corrected. The motion to deny was seconded by C. Mink and failed 3-3-1 (C. Coffey, Key and Ellis dissenting and C. Wellford absent) roll call vote. C. Coffey commented the applicant is providing parking to code requirements on site, between the spaces outside and in. He then made a motion to approve this application, by resolution, with the following conditions: 1) that the project shall be laid out in accordance with the plans submitted to the Planning Department and date stamped May 14, 1996 Sheet 1, Site Plan and Floor Plans; 2) that the conditions of the Chief Building Official's and Fire Marshal's memo dated April 29, 1996 shall be met; 3) that the auto body shop will be open 5 days per week or 40 hours per week with a maximum of 4 employees including the business owner on site at one -3- Burlingame Planning Commission Minutes May 28, 1996 time; 4) that there shall be two standard parking spaces available, to current code dimensions, for use by the employees or customers inside the warehouse at 1369 Rollins Road, and maintenance and repairs shall not be made to any vehicles while parked in these two spaces; nor shall any of the required parking spaces designated for this tenant outside the building be used for auto storage or repair; and 5) that the project shall meet all the requirements of the California Building and Fire Code, 1995 Edition as amended by the City of Burlingame. Motion was seconded by C. Key and failed on a 3-3-1 (C. Deal, Galligan and Mink dissenting and C. Wellford absent) roll call vote. Appeal procedures were advised. VIH.
