ROLL CALL Present: Commissioners Deal, Ellis, Galligan, Key, Mink, Wellford and Jacobs Absent: None Staff Present: City Planner, Margaret Monroe and City Engineer, Frank Erbacher MINUTES - The minutes of the February 26 Planning Commission meeting were approved as mailed. AGENDA - The order of the agenda was approved. It was noted for the record that the M-1 discussion was moved to an action item. FROM THE FLOOR There were no public comments. ITEMS FOR STUDY There were no study items. ACTION ITEMS 1. APPLICATION FOR A FRONT SETBACK, EXTERIOR SIDE SETBACK AND UNCOVERED PARKING VARIANCES, FOR NEW CONSTRUCTION AT 2 ANITA ROAD. ZONED R-3 (MARK CURTIS, PROPERTY OWNER AND APPLICANT Reference staff report, 3.11.96, with attachments. CP Monroe summarized the request and reviewed criteria and Planning Department comments. Two conditions were suggested for consideration. CITY OF BURLINGAME PLANNING COMMISSION MINUTES March 11, 1996 Chm. Jacobs opened the public hearing. Mark Curtis, 2 Anita Road, was present to explain his application. He presented a letter of support from his immediate neighbor to the south who would be most affected by the project. There were no other comments and the public hearing was closed. C. Galligan noted this application is less intensive than could be requested in an R-3 zone. It is also in a buffer area across the street from the C-1 zone and on a corner lot facing Peninsula. Any construction would require variances because of the preexisting condition, that is the original placement of the house and the size of the lot. Noting for these reasons this would not be a grant of special privilege, he moved approval, by resolution, with the following amended conditions; 1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped February 2, 1996, Sheets 1,2,3 and 4 with the garage moved back toward the interior side so it is flush with the first floor of the existing structure and the interior side setback is maintained at 3'-5"; and that the project shall meet all California State Building and Fire Codes, 1995 Edition as amended by the City of Burlingame. On the motion the Commissioners noted: that the relationship of the existing garage to the adjacent property is not bad, declining height envelope can me bet; there is a fence between properties; moving the garage back to the line of the existing house would add 2' to the dwelling and make it 18' to the edge of the sidewalk instead of 16' which is really marginal for standard cars, not want to approve a condition which has potential for blocking pedestrians on the sidewalk; a cantilever on the front of the house over the new garage can be aesthetically pleasing by visually breaking up a very long wall; with proposal uncovered parking space will be 13'-4" with 2' of right-of-way would be 15'-4", a compact stall is 17'; really no uncovered parking; could maintain room site with a cantilever; Commissioner Galligan stated he would add a condition to his motion stating that the garage me moved back toward the interior side property line to match the existing side setback of the house, maintaining the 3'-5" interior side setback dimension. Second agreed. The motion was seconded by C. Ellis and was approved on a 7-0 roll call vote. Appeal procedures were advised. 2. M-1 REGULATION CHANGES AND RECOMMENDATIONS The Planning Commissioners reviewed and discussed by section the proposed committee recommendations and changes which they had previously suggested. Among the key issues discussed under uses were: performance criteria for vibration and odor; whether recreational vehicle and truck rental should be a permitted or conditional use; the maximum size of food ma CITY OF BURLINGAME PLANNING COMMISSION MINUTES March 11, 1996 establishments in multi -use buildings; the percentage of office space in warehouse structures which should be permitted; the definition of permitted service businesses, required fencing for automobile storage for car rental vehicles; establishing retail sales as a conditional use so long as they are in association with a warehouse use and do not display products for sale, maximum size of sales area was still undetermined; prohibited uses were modified to disallow automobile rental but to allow automobile leasing because of its close relationship with automobile sales. The commission discussed the fact that the proposed draft from the committee introduced the concept of an overlay zone based on the characteristics of the original subdivision standards. The industrial area was developed in three phases each with more restrictive development standards: Rollins Road to Easton Creek, Easton Creek to Mills Creek, and Mills Creek to the northern city boundary (Millsdate Industrial Park). The overlay concept was incorporated into the limitations on several of the uses ( i.e. auto repair, outdoor storage) and development standards (i.e. side setback). The planning commissioners accepted the concept but were more restrictive in their application than the committee, limiting the more intensive uses and more permissive development allowances to the area between Easton Creek and Rollins Road. On the development standards the discussion focused on wording for reducing side setback requirements for properties south of Easton Creek. Conceptually the other changes the committee proposed to the development standards were not changed. Finally the Commissioners discussed the changes needed to other parts of the zoning chapter in order to implement the revisions to the M-1 district regulations. These included directing staff to see how other jurisdictions define incidental retail sales; modifying the proposed parking regulations for gymnasiums and health clubs so there is no stated parking requirement for outdoor court facilities provided; modifying the proposed parking standard for group instruction (classes) to 1:50 GSF of instruction area; extending the concept of extending a nonconforming use or structure to include expansion of floor area within a structure; modifying the concept of performance zoning so that criteria for conditional uses are subject to variance except the criteria for landscaping and parking. The Commission directed staff to prepare a clean copy of the draft M-1 district regulations for their review and action at their next meeting, March 25, 1996. Action on recommendation to the city council on the proposed revisions to the M-1 district regulations was continued to the meeting of March 25, 1996.
