ROLL CALL Present: Commissioners Deal, Ellis, Galligan, Jacobs, Key, Mink and Wellford Absent: None Staff Present: City Planner, Margaret Monroe; City Attorney, Jerry Coleman; City Engineer, Frank Erbacher and Fire Marshal, Keith Marshall MINUTES - The minutes of the January 8, 1996 Planning Commission meeting were approved. AGENDA - The order of the agenda was approved. It was noted for the record that the application for Item #1, 260 El Camino Real was incomplete. The. application was not withdrawn and will be heard as a study item on February 12, 1996. FROM THE FLOOR There were no public comments. ITEMS FOR STUDY 1. APPLICATION FOR A SPECIAL PERMIT, PARKING VARIANCE AND TAKE-OUT PERMIT FOR A SNACK SHOP IN THE CHEVRON STATION AT 260 EL CAMINO REAL, ZONED C-1, SUBAREA A, (CHEVRON, USA, INC., PROPERTY OWNER AND NANETTE NAMES, REPRESENTING R. H. LEE & ASSOCIATES, APPLICANT). APPLICATION INCOMPLETE Item set for study February 12, 1996. -1- CITY OF BURLING"E PLAAWNG COMMISSION MINUTES January 22, 1996 approval of this project with the following amended conditions; 1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped December 1, 1995, Sheet 1, General Floor Plan; 2) that the conditions of the City Engineer's memo dated December 4, 1995 shall be met and that the applicant shall purchase and maintain daily, or more often if necessary, a trash receptacle or receptacles of a type approved by the City and identified as the selected trash receptacle for the enhancement of Burlingame Avenue. These trash receptacles shall be placed at the door along Burlingame Avenue and/or at locations as required and approved by the City Engineer and Fire Department; 3) that World Wrapps shall be open 8:00 a.m. to 10:00 p.m. Monday through Sunday with a maximum of 10 employees on site including the manager at any one time and that the number of customers and employees on this site at any one time shall never exceed fire department occupancy requirements; 4) that the applicant shall remove once a day, or more frequently if determined to be necessary by the City Engineer, all take-out debris on the sidewalk and on sidewalk tables and chairs, in the gutter, and in planters, in front of the store along Burlingame Avenue, and within 50' of the store front, and shall arrange and pay for additional BFI pick up service if necessary as determined by the City Engineer; and 5) that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Motion was seconded by C. Galligan and approved on a 5-2 (C. Wellford and Jacobs dissenting) roll call vote. Appeal procedures were advised. 4. APPLICATION FOR A VARIANCE FOR DRIVEWAY WIDTH FOR THE CONSTRUCTION OF 6 NEW CARPORTS AT THE REAR OF 1212 EL CAMINO REAL, ZONED R-3, (JACK KLEIN, PROPERTY OWNER AND APPLICANT) Reference staff report, 1.22.96, with attachments. CP Monroe summarized the request and reviewed criteria and Planning Department comments. Four conditions were suggested for consideration. Chin. Jacobs opened the public hearing. Mr. Klein, P. O. Box 508, Burlingame, CA, the applicant was present. He presented pictures and related to the commission that he acquired this property in 1995 and is trying to rehabilitate it. There were no other comments and the public hearing was closed. C. Deal noted this project is not detrimental to the neighborhood, he then moved approval of this project, with the following conditions; 1) that the project shall be built as 'shown on the plans submitted to the Planning Department and date stamped December 18, 1995, Sheets 1, 2, 3, and 4 and the minimum width of the driveway shall be 10'-0" from property line for the length of the building and the new carport. Construction shall not create any obstruction to the maneuvering area at the rear of the lot or access to the adjacent property; 2) that the conditions of the Associate engineer's memo dated January 16, 1996 shall be met; 3) that any changes to -3- CITY OF BURLINGAME PLANNING COMMISSION MINUTES January 22, 1996 the carports shall require an additional review by the Planning Commission; and 4) that the, project shall meet all the requirements of the Uniform Building and Uniform Fire Code requirements as amended by the City of Burlingame. Motion was seconded by C. Ellis and approved on a 7-0 voice vote. Appeal procedures were advised. 5. APPLICATION FOR A SPECIAL PERMIT FOR WHOLESALE AUTOMOBILE SALES AT 808 BURLWAY ROAD, UNIT #2, ZONED O-M, (NICHOLAS AND STELLA CRISAFI. PROPERTY OWNER AND VWN DALEY, APPLICANT) Reference staff report, 1.22.96, with attachments. CP Monroe summarized the request and reviewed criteria and Planning Department comments. Eight conditions were suggested for consideration. ,Chm. Jacobs opened the public hearing. There was no one present to represent the applicant. Commission asked if outdoor designated parking spaces could be used to display cars. Staff responded that such use would violate zoning regulations. It was also noted that the conditions should be amended so it is clear that none of the on site outdoor parking can be used for auto display. There were no further comments and the public hearing was closed. v:. C. Galligan moved to continue this item to the February 12, 1996 Planning Commission meeting so the applicant could be present. Motion was seconded by C. Jacobs and failed on a 2-5 (Cmsrs. Deal, Ellis, Key, Mink and Wellford dissenting) roll call vote. C. Deal then moved approval of this project stating that the use as proposed would not be detrimental to the area and it is similar to other uses allowed in the past in the area. Motion included amending the conditions to clarify that none of the outdoor parking should be designated for this tenant and that no cars for sale shall be displayed in any of the outdoor, uncovered parking spaces. The approval would be it has no significant effect on the environment. The approval of this application would be by resolution, with the following conditions; 1) that the project shall be built as shown on the plans submitted to the Planning Department and date stamped December 1, 1995, Site Plan (81/2" X 11") and floor plan (81/2" X 11"); 2) that the conditions of the Fire Marshal's December 18, 1995 memo shall be met; 3) that none of the uncovered on site parking shall be used for automobile display or to store cars for sale from this business, and none of the required parking spaces shall be signed or designated to Unit #2; none of the parking on site shall be leased for a fee to any other business, use or activity without amendment to this use permit; 4) that the business shall be open 1:00 p.m, to 5:00 p.m., Monday through Friday and 12:00 p.m. to 4:00 p.m., Saturday with a maximum of 0 CITY OF BURLING"E PLANNING COMMISSION MINUTES January 22, 1996 two employees on site at any one time including the proprietor; 5) that at least one space for displaying a vehicle shall be provided inside the building in accordance with the Department of Motor Vehicle dealer's license requirements; 6) that vehicles to be sold or displayed by this business shall be delivered before or after regular business hours of other tenants on site; no cars shall be off loaded on the public street, in shared driveways or in such a way that required on site parking is blocked; 7) that any changes to this business operation and floor area (square footage) as outlined in the application materials date stamped December 1, 1995, shall require an amendment to this special permit; and 8) that the project shall meet all the requirements of the Uniform Building and Uniform Fire Codes as amended by the City of Burlingame. Motion was seconded by C. Ellis and approved on a 5-2 (C. Galligan and Jacobs dissenting) roll call vote. Appeal procedures were advised. 6. APPLICATION FOR A SPECIAL PERMIT TO INCREASE THE OFFICE AREA AT 1 ADRIAN COURT, WHERE THE OFFICE SPACE ALREADY EXCEEDS THE MAXIMUM ALLOWED BY CODE IN THE M-1 ZONE, (OCOTILLO INVESTMENT COMPANY, NO. 1 C/O BIRTCHER PROPERTY SERVICES, PROPERTY OWNER AND SPRINT, APPLICANT). Reference staff report, 1.22.96, with attachments. CP Monroe summarized the request and reviewed criteria and Planning Department consideration. comments. Five conditions were suggested for Chm. Jacobs opened the public hearing. Stan Sedilko, project architect, 1321 Howe Street, #202, Sacramento addressed the commission and asked that the condition addressing parking configuration be specific state parking to current city code so that the compact parking ratio of 20% could be provided according to code. He also noted that phase I was under construction but that phase was a remodel of existing office and needed no permits from the planning department. There were no other comments and the public hearing was closed. C. Deal moved for the approval of this project. It is a minute increase and is not detrimental to the neighborhood. The approval of this application is by resolution, with the following amended conditions; 1) that the interior remodel shall be built as shown on the plans submitted to the Planning Department and date stamped December 28, 1995, Sheets A100, A101 and A102; 2) that the amount of office area in the building shall not exceed 38% (9,562 SF) without an amendment to this special use permit and any other change in use or additions to the building will require an amendment to this special permit; 3) that 52 parking stalls on -site shall be properly striped showing a depth of 20'-0" and width of 9'-0" or 10'-0" as required to meet current dimensional standards for parking spaces and back-up aisles and there shall be 49 standard stalls and 3 disabled accessible stalls among the 52 required; additional spaces provided but not meeting the city's current required dimensions shall be marked as compact stalls; this -5- CITY OF BURLINGAME PLANNING COMMISSION MINUTES January 22, 1996 stripping shall meet the city's current code required dimensions including compact stall allowances and stripping shall be in place before the building permit is finaled for occupancy; 4) that the project shall meet all the requirements as set forth in the Fire Marshals memo of December 26, 1995 and the Chief Building Officials memo of December 28, 1995; and 5) that all construction on site shall meet the requirements of the Uniform Building Code and Uniform Fire Code as amended by the City of Burlingame. Motion was seconded by C. Ellis and approved on a 7-0 voice vote. Appeal procedures were advised. PLANNER REPORTS CP reviewed City Council regular meeting of Wednesday, January 17, 1996 The M-1 committee members asked that the scheduled discussion of the Planning Commissioners review of the proposed revisions to the M-1 district regulations be moved to 8:30 p.m., February 12, 1996, after the Planning Commission meeting in Conference Room A. Some of their members did not get enough notice before tonight's meeting and were unable to attend. The commission reset the discussion for 8:30 p.m., February 12, 1996, at the close of the Planning Commission meeting.
