Date: 04.22.03 �kjw KV- Margar t Monroe, City Planner RESOLUTION 033-2003 RESOLUTION APPROVING CATEGORICAL EXEMPTION AND VARIANCE RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for lot coverage variance for construction of a new single -car detached garage at 753 Acacia Drive, zoned R-1, Remy Sijbrant, property owner, APN: 029-043-070; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on April 14, 2003, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19, Section 15303 - New Construction or Conversion of Small Structures Class 3 (e), Accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences, is hereby approved. 2. Said lot coverage variance approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such lot coverage variance are as set forth in the minutes and recording of said meeting, 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. I, Ralph Osterlin , Secretary of the Planning Commission of the Cfty of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 14`h day of April, 2003, by the following vote: AYES: COMMISSIONERS Auran; Bojues; Vistica : Osterling; Keele NOES: COMMISSIONERS NONE ABSENT: COMMISSIONERS Brownrigg; Kerighran ABSTAIN: COMMISSIONERS NONE Secretary EXHIBIT "A" Conditions of approval for categorical exemption and lot coverage variance. 753 Acacia Drive Effective April 21, 2003 that the project shall be built as shown on the plans submitted to the Planning Department and date stamped March 12, 2003, sheet 1, and date stamped February 13, 2003, sheet 2 through 4, and that the detached garage shall not exceed 228 SF in area (10'-11 "W x 20'- 11"D) and shall not exceed an overall height of 12'-2" measured from adjacent grade to the roof ridge, and a maximum plate height of 9'-0" measure from adjacent grade; 2. that the detached garage shall contain shingle siding and a composition shingle roof to match the existing house on the lot; that the conditions of the City Engineer's, the Chief Building Official's, and the Recycling Specialist's February 18, 2003 memos, memo shall be met; 4. that the project shall comply with the Construction and Demolition Debris Recycling Ordinance which requires affected demolition, new construction and alteration projects to submit a Waste Reduction Plan and meet recycling requirements; any partial or full demolition of a structure, interior or exterior, shall require a demolition permit; and 5. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 2001 Edition, as amended by the City of Burlingame.
