Date: 06.04.02 Marg et Monroe, City Planner RESOLUTION APPROVING CATEGORICAL EXEMPTION AND CONDITIONAL USE APPLICATION RESOLUTION 52-2002 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a conditional use permit for real estate use at 329 Primrose Road, suite 208, zoned C-11 ,Subarea A, G.W. Williams Company, property owners, APN: 029-122-150; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on May 28, 2002, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and connnnents received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the enviromnent, and categorical exemption, per CEQA Article 19. Categorically Exempt per Section: 15303 —Class I- the operation repair, maintenance, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that previously existing including but not limited to (a) interior or exterior alternations involving such things as interior partitions, plumbing, and electrical conveyances. 2. Said categorical exemption and conditional use permit are approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such conditional use permit are as set forth in the minutes and recording of said meeti -1g. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. a __ CHAI IAN 1, Ralph Osterling, Secretary of the Plamning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Conanission held on the 28th day of May, 2002 , by the following vote: AYES: COMMISSIONERS: `"�►n, Bojues, Brownrigg, Keele, Keighran, Osterling and Vistica NOES: COMMISSIONERS: ABSENT: COMMISSIONERS: NONE I SECRETARY / EXHIBIT "A" Conditions of approval for categorical exemption and conditional use permit. 329 Primrose Road, suite 208 effective June 3, 2002 that the real estate office use shall be limited to 264 SF at 329 Primrose Road, second floor, suite 208, as shown on the floor plan submitted to the Plaar ing Department and date stamped April 8, 2002; 2. that the real estate office shall have regular business hours from 9:00 a.m. to 5:00 p.m. Monday through Friday, with weekend use to be limited from 9:00 a.m. to 12:00 p.m., Saturday and Sunday; that the maximum number of employees in this tenant space, suite mmzber 208-second floor, shall be limited to 1, and that no more than 10 customers will be on the site each day; 4. that any changes to the floor area, use, hours of operation, or number of employees which exceeds the maximums as stated in these conditions shall require an amendment to this conditional use permit; and 5. that any improvements for the use shall meet all California ,Building and Five Codes, 1998 Edition as amended by the City of Burlingame and occupancy ofthis suite shall never exceed Fire Department requirements.
