RESOLUTION APPROVING CATEGORICAL EXEMPTION,
HILLSIDE AREA CONSTRUCTION PERMIT AND DESIGN REVIEW
RESOLUTION 49-2002
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for desial
review and hillside area constrriction_peri-lit for a first and second story addition at 2501 Ha)nvard Drive.
zoned R-1, David F and Laura L. Elmore, property owners, APN: 025--182-070;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on May
28, 2002, at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and continents received
and addressed by this commission, it is hereby found that there is no substantial evidence that the project set
forth above will have a significant effect on the envirormlent, and categorical exemption, per CEQA Article
Article 19. Categorically Exempt per Section: 15301 Class 1 - (e) additions to existing structures provided
the addition will not result in an increase of more than 50 % of the floor area of the structures before the
addition.
2. Said design review and hillside area construction permit are approved, subject to the conditions
set forth in Exhibit "A" attached hereto. Findings for such design review and hillside area construction permit
are set forth in the minutes and recording of said meeting.
It is further directed that a certified copy of this resolution be recorded in the official records of
the Courity of San Mateo.

Conditions of approval for categorical exemption, hillside area construction permit and design
review.

that the project shall be built as shown on the plans submitted to the Planning Department
date stamped May 10,2002, Sheets Al through A5, site plan, floor plans and building
elevations;
2. that the floor area measurement for the first floor should be checked for compliance with the
approved building plans by submittal of a survey of the foundation framing prepared by a
licensed engineer, and that the City Engineer shall accept the survey as being in conformance
with the approved plans prior to the scheduling the inspection for the foundation and that a
licensed engineer shall also survey the second floor framing and that the survey shall be
accepted by the City Engineer, prior to scheduling the final framing inspection, to confirm
that the structure as built has the same floor area as shown in the approved building plans;
that the tree protection plan prepared by Mayne Tree Expert Company, dated April 25, 2002,
shall be implemented prior to issuance of a building permit; the installation of these tree
protection measures shall be approved by the City Arborist prior to the issuance of a building
permit; failure to follow the protection plan shall result in not scheduling inspections until
the plan has been fully complied with;
4. that any changes to the size or envelope of the basement, first or second floors, which would
include adding or enlarging a dormer(s), moving or changing windows and architectural
features or changing the roof height or pitch, shall be subject to design review;
that because this proposed house is within 7 SF of the maximum FAR allowed any future
conversion of the attic area to living space shall require review by the Planning Commission;
that the project shall comply with the Construction and Demolition Debris Recycling
Ordinance which requires affected demolition, new construction and alteration projects to
submit a Waste Reduction Plan and meet recycling requirements; any partial or full
demolition of a structure, interior or exterior, shall require a demolition permit;
that the conditions of the Recycling Specialist's and the City Engineer's April 1, 2002
memos shall be met; and
8. that the project shall meet all the requirements of the California Building and Fire Codes,
1998 edition, as amended by the City of Burlingame.
