Date: J 05.21.02 / Marg et onroe, City Planne RESOLUTION APPROVING CATEGORICAL EXEMPTION AND ONE YEAR EXTENSION RESOLUTION 43-2002 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a one year extension of an approved design review for a new one-story single family dwelling at 1337 Paloma Avenue, zoned R-1, Alexander and Gloria Hidchenko, property owners, APN: 026-085-050; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on May 13, 2002, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19. Categorically Exempt per Section: 15303 - Class 3 - construction and location of limited numbers of new, small facilities or strictures including (a) single-family residences not in conjunction with the building of two or more such units, is hereby approved. 2. Said one year extension is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such one year extension are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution he recorded in the official records of the County of San Mateo. EXHIBIT "A" Conditions of approval for categorical exemption and one year extension. 1337 Paloma Avenue effective May 20, 2002 that the one-story single family dwelling shall be built as shown on the plans submitted to the Planning Department date stamped May 3, 2001, sheets 1-5 and A, with the exception of the detached garage as shown on the Site Plan (see conditions #2 and #3), and that any changes to the footprint or floor area of the building shall require an amendment to this permit, and all windows shall have muntin divided lights; 2. that a new detached garage shall be built to meet the off-street parking requirements of the approved house (one covered and one uncovered parking spaces minimum required) and that a building permit shall not be issued for the house until the plans submitted to the building department show that the new detached garage complies with all accessory structure zoning code requirements; that if review is required by the Planning Commission for the detached garage, a building permit shall not be issued for the house until the detached garage is approved by the Planning Commission and constriction plans have been submitted to the Building Department; 3. that a final inspection for the house shall not be scheduled until the garage structure is also ready for final inspection; 4. that any changes to the size or envelope of the basement or first floor, which would include adding or enlarging a dormer(s), moving or changing windows and architectural features or changing the roof height or pitch, shall be subject to design review; that the conditions of the City Engineer's and Recycling Specialist's March 19, 2001, memos shall be met; 6. that the basement space below the first floor shall not be used as sleeping quarters or bedrooms; and that the project shall meet all the requirements of the California Building Code and California Fire Code, 1998 edition, as amended by the City of Burlingame.
