Date: 04.18.02 AMauxgar�C' yplanner RESOLUTION APPROVING CATEGORICAL EXEMPTION, CONDITIONAL USE APPLICATION AND LANDSCAPING VARIANCE RESOLUTION 35-2002 RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a conditional use permit and landscaping variance for a basketball gymnasium at 1881 Rollins Road, Building E, zoned M-1, S.J. Amoroso Properties Companyproperty owner: APN: 025-166-240; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on April 8, 2002, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19. Categorically Exempt per Section: 15303 —Class I- the operation repair, maintenance, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that previously existing including but not limited to (a) interior or exterior alternations involving such things as interior partitions, plumbing, and electrical conveyances. 2. Said categorical exemption, conditional use permit and landscaping variance are approved, subj ect to the conditions set forth in Exhibit "A" attached hereto. Findings for such conditional use permit and landscaping variance are as set forth in the minutes and recording of said meeting. It is further directed that a terrified copy of this resolution be recorded in the official records of the County of San Mateo. I, Joseph Bojii6s, Secretary of the Planning Commission of the City of Burlingame, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 8th day of April , 2002, by the following vote: AYES: COMMISSIONERS: Auran, Bojues, Brownrigg, Keighran, Osterling and Vistica NOES: COMMISSIONERS: NONE ABSENT: COMMISSIONERS: Keele SEC AR3i/ Conditional Use Permit EXHIBIT "A" 1860 El Camino Real, Suite 100 Conditions of approval for categorical exemption, conditional use permit and landscape variance. 1881 ROLLINS ROAD, Building E effective APRIL 15, 2002 that the project shall be built as shown on the plans submitted to the Planning Department and date stamped March 29, 2002, site plan and floor plan; that the gym shall operate as indicated in the application dated stamped March 13, 2002, with hours of operation from 10:00 a.m. to 11:00 p.m., seven days a week, and no more than 4 employees; the gym shall be used for basketball only, any change to the operation of the business, including expanding hours of operations or services offered shall be brought to the Burlingame Planning Commission for approval; 3. that 1,772 SF of landscaping in the front setback area and 12,688 SF of total on -site landscaping shall be property maintained and irrigated; 4. that two 24-inch box size large scale trees, selected from the City's Official Tree List, shall be planted within the front setback area; that the landscape variance shall become void if there is any expansion to the existing of the buildings on site or if any of the buildings are removed; that the conditions of Chief Building Official's February 26, 2002 memo shall be met; that there shall be no more than 30 people (including staff and parents) on -site at any one time; 8. that the applicant shall purchase and maintain daily, more often if necessary, trash receptacles on -site which will be placed by the door in front of the gym; 9. that all existing and proposed landscape areas will be irrigated regularly and will require ongoing maintenance including weed control and replacement of plant materials as necessary to maintain the landscape design; and 10. that the project shall meet all the requirements of the California Building and Uniform Fire Codes, 1998 edition, as amended by the City of Burlingame. 2 ROUTING FORM DATE: February 25, 2002 TO: City Engineer 7Chief Building Official _Fire Marshal _Recycling Specialist _City Arborist _City Attorney FROM: Planning Staff SUBJECT: Request for conditional use permit for a gymnasium use at 1881 Rollins Road #C, zoned M-11 APN: 025.166-240.
