Date: 04.11.03 OY2 NI M argar t Monroe, i-ty Planner RESOLUTION 025-2003 RESOLUTION APPROVING CATEGORICAL EXEMPTION AND FENCE EXCEPTION RESOLVED, by the Planning Commission of the City of Burlingame that: WHEREAS, a categorical exemption has been proposed and application has been made for a fence exception for height for two new 6'-2" tall pillars and a 6-0" tall wrought iron gate at the the driveway entrance to the site at 1532 Burlingame Avenue, zoned R-1, Robert and Jessica Fellows, property owners, APN: 028-283-080; WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on March 24, 2003, at which time it reviewed and considered the staff report and all other written materials and testimony presented at said hearing; NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that: 1. On the basis of the Initial Study and the documents submitted and reviewed, and comments received and addressed by this commission, it is hereby found that there is no substantial evidence that the project set forth above will have a significant effect on the environment, and categorical exemption, per CEQA Article 19, Section 15303 - construction and location of new, small facilities or structures - (e) accessory (appurtenant) structures including garages, carports, patios, swimming pools and fences, is hereby approved. 2. Said fence exception is approved, subject to the conditions set forth in Exhibit "A" attached hereto. Findings for such fence exception are as set forth in the minutes and recording of said meeting. 3. It is further directed that a certified copy of this resolution be recorded in the official records of the County of San Mateo. I, Ralph Osterling , Secretary of the Planning Commission of the City of BurlingafM'e, do hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of the Planning Commission held on the 24r' day of March, 2003, by the following vote: AYES: COMMISSIONERS Auran; Bojues; Brownrigg; Kerighran; Vistica : Osterling NOES: COMMISSIONERS NONE ABSENT: COMMISSIONERS Keele ABSTAIN: COMMISSIONERS NONE /4 Se retary EXHIBIT "A" Conditions of approval for categorical exemption and fence exception. 1532 Burlingame Avenue Effective April 7, 2003 1. that the pillars and wrought iron gate at the entrance driveway shall be built as shown on the plans submitted to the Planning Department date stamped March 10, 2003, sheet A-1; and that the pillars at either side of the driveway gate shall not exceed 6'-2" in height and the wrought iron gate shall not exceed 6-0" in height, as measured from highest adjacent grade; 2. that the wrought iron gate at the driveway entrance shall be remotely operated by an electric motor activated from a motor vehicle and that an electrical permit from the Building Department shall be issued prior to installation of the electric gate; 3. that the conditions of the Chief Building Official's and Fire Marshal's March 17, 2003 memos, and the City Engineer's March 19, 2003 memo shall be met; and 4. that the project shall meet all the requirements of the California Building and Fire Codes, 2001 edition, as amended by the City of Burlingame.
