RESOLUTION 022-2003
RESOLUTION APPROVING CATEGORICAL EXEMPTION
AND FENCE EXCEPTION
RESOLVED, by the Planning Commission of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for a
fence exception for height for two new 8'-6" tall arbors located in the public right-of-way,
adjacent to the front and exterior side propertylines 1719 Easton Drive, zoned R-1, Samuel
and Susie Lahey, property owners, APN: 026-153-110;
WHEREAS, said matters were heard by the Planning Commission of the City of Burlingame on
March 10, 2003, at which time it reviewed and considered the staff report and all other written
materials and testimony presented at said hearing;
NOW, THEREFORE, it is RESOLVED and DETERMINED by this Planning Commission that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and
comments received and addressed by this commission, it is hereby found that there is no
substantial evidence that the project set forth above will have a significant effect on the
environment, and categorical exemption, per CEQA Article 19, Section 15303 -
construction and location of new, small facilities or structures - (e) accessory
(appurtenant) structures including garages, carports, patios, swimming pools and fences,
is hereby approved.
2. Said fence exception is approved, subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such fence exception are as set forth in the minutes and
recording of said !meeting.
3. It is further directed that a certified copy of this resolution be recorded in ;th7ffici'al
records of the County of San Mateo.

hereby certify that the foregoing resolution was introduced and adopted at a regular meeting of
the Planning Commission held on the 10`h day of March, 2003, by the following vote:

Effective March 18, 2003
that the arbors adjacent to the front (East Drive) and exterior (Cabrillo Avenue) property
lines shall be built as shown on the plans submitted to the Planning Department date
stamped January 30, 2003; and that the entrance arbors shall not exceed 8'-6" in height as
measured from highest adjacent grade to the top of arbor structure;
2. that the conditions of the City Engineer's memo, dated February 13, 2003, shall be met
and that a special encroachment permit shall be obtained from the Public Works
Department prior to construction and installation of the arbor and fence; and
3. that the project shall meet all the requirements of the California Building and Fire Codes,
2001 edition, as amended by the City of Burlingame.
